Home My WebLink AboutORD 1973-057 ' ORDINANCE �3-5� AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, REPEALING ORDiNANCE NO. 71-24, GRANTlNG TO GEr1ERAL TELEPHONE COMPANY OF THE SOUTHWEST THE RIGHT, PRIVILEGE AND PERMIT TO PLACE INTO EFFECT CERTAIN RATES TO BE CHARGED TO THE � RESIDENTS OF GRAPEVINE; AND MAKING OTHER � '; PROVISIONS THERETO; . _ .. . � � • WHEREAS, Genera) Telephone Company.of the Southwest, (the "Company"), holds a franchise in the City of Grapevine, Texas (the "City), which permits the Company the use of the streets, highways and public thoroughfares in the conduct of its business of providing telephone service in the Cifiy; and WHEREAS, the Company provides special communication and F telephone services to its customers within the boundaries of the Dallas-Fort Worth Regional Airport lying within the City limits of the City such arecr hereinafter called "Airport Exchange", all other areas of the City is �� hereinafter called "Grapevine Exchange"; and ��„ WHEREAS, within the Airport Exchange the Company will provide special communication and telephone services to its customers as per its ' agreement with the Dallas-Fort Worth Regional Airport Board, "Airport . . Telephone Service" and wi II also provide in the Airport Exchange as local telephone service "Dallas Metropolitan Telephone Service" and on an optional � . basis will provide "Dallas-Fort Worth Extended Metropolitan Telephone Service"; and � WHEREAS, in the Grapevine Exchange the Company will provide as local service "Fort Worth Metropolitan Telephone Service" and on an optional basis will provide `Uallas-Fort Worth Extended Metropolitan Telephone Service"; and � WHEREAS, the Company has filed with the City rate applications � � . for both the Grapevi ne Exchange and the Ai rport Exchange; and � NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNGL OF THE CITY OF GRAPEVINE, TEXAS: SECTION 1 . That nothing in this ordinance contained shall be construed � . as, in any manner, now or hereafter, limiting or modifying the righfi and power of the City Council under the law, to regulafie the rates charged by General Telephone Company of the Southwest, its successor or assigns, within the City of Grapevine, Texas. SECTION 3. That the City Council of the City of Grapevine maintnins its unalterable right to review and change the rates and charges prescribed herein � at any time, in compliance with the proper administrative and legal procedures, whenever the quality of services rendered reaches the point where the reasan— ableness of the rates herein are in question. �'"""' SECTION 4. It is hereby declared to be the intention of the City Council of the City of Grapevine, that the secfions, paragraphs, sentences, �� clauses and phrases of this Ordinance are severab(e and if any phrase, clause, sentence, paragraph or section hereof should be declared unconstitutionaf, such . ' unconstitutionality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this Ordinance, since the same would have besn enacted by the City Counci) without the incorporation in this Ordinance of any such unconstitutional or invalid phrase, clause, sentence, paragraph or section. � SECTION 5. This Ordinance shall take effect immediately from and after its passage.
