WHERF�AS, the owners af property abutting Terre].1 Street �� in the City of Grapevine, Texas, have requested the zight-o.f- way o� Terrell Street, as hereinafter described, be clased, � A abandaned and vacated; and WHEREAS, the right-af-way of said street as hereinafter described is not now needed far public street and wi11 not be needed in the future far a pub3ic stree�; az�d WHEREAS, the closing, abandoning and vacating the zight- of-way of said street will relieve the Ca.ty of Grap�vine, Texas, fzom the cost and expense af maintaining said praperty; Nt}W, THEREFORE, BE ZT aRDAINED BY 2HE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: SECTION 1 . That the right-c►f-way known as Terrell Street, more particularly described as follaws: A11 �hat certai� portian of fierxell Stree� described more fully in E�chibit �'A" attached hereto and made a part �lEZ�Of fQr a11 purposes, to which reference is here made for mare parti.cular description; be, and the sa.me is hereby closed, abandc�ned and vacated far � pubiic use, and the same i.s hereby closed, abandoned and vacated insofar as all public right, title and interest in and to said described portion of said right-of-way is cancerned, subject ta and cc►nti.ngent upon the owner of abutting property removing and relocating an existinc� City crf Grapevine sanitary sewer line into a city easement to the satisfaction and approval af the City Manager of the City of Grapevine. SECTIQN 2. That the Mayor be, and is hereby authorized to execute a Quit-Claim Deed to co�vey the hereinafter ciescxibed property tg �he awnezs af the property abutting said right-of- way, who k�ave officially declared by affa,davit that they each axe �he rightful fee owners of the right-af-way vacated and abandoned by this ordinance and that they know of no otk�er parties who awn praperty abutting said right-of-way, �ECTI4N 3. 2ha� the terms and provisions of this ordi�taance shall be deemed to be severable and that if the validity of any section, subsection, word, sentence c�r phrase shall be held to �, ^ be invalid, it shall not affect the remaining part of this oxdinance. `� ` SECTI4IV_4. The fact that right-of-way of 2erre1l 5treet is no longer needed by the public �or public usage or traveling and would create a hardship or burden upan the City of Grapevine to keep open and maintain such street creates an urgency and an emergency far the immediate preservation of the public health, safety and general. welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
