AN ORDINANCE WHICH PROVIDES FOR THE REGULATION
OF THE CONSTRUCTION AND MAINTENANCE OF FENCES IN
THE CITY OF GRAPEVINE, TEXA.S; PROVIDING DEFINITIONS;
REQUIRING A PERMIT TO ERECT A FENCE OR PERMANANENT
CONSTRUCTION; REQUIRING AN APPLICATION TO BE FILED
FOR A PERMIT; REQUIRING A PERMIT FEE; PROHIBITING
THE E�ECTION OF FENCES OVER PUBLIC PROPERTY; PRO-
VIDING REQUIRENfENTS FOR THE CONSTRUCTION OF FENCES

VIDING FOR THE BUILDING INSPECTOR TO INSPECT THE
FENCES UPON CONSTSRUCTION; PROVIDING FOR CONFLICTS
BETWEEN THE FENCE ORDINANCE AND THE ZONING ORDINANCE;
PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL � TI�
C ITY OF GRAPEV I1�T�, TEXAS:
SECTION 1 - DEFINITIONS.
The following definitions shall be deemed applicable in
the interpretation of this ordinance.
A. Rear Yard. A space unoccupied by principal structure
�,,, extending for the full width of the lot between a pri�cipal structure
and the rear lot line.
� B. Side Yard. An open unoccupied space on the same lot
with the building, situated between the building and the side line
of the lot, and extending through from the street or the front line
to the rear line of the lot.
Any lot line not a rear line or a front line shall be
deemed a side line.
C. Front Yard. Shall mean an open, unoccupzed space on
a lot facing a street and extending across the front of a lot be-
tween the side yard lines.
D. Corner Lot. Shall mean a lot situated at the
junction of two or more dedicated public streets.
E. Interior Lot. A lot situated in a block with front-
age on only one dedicated public street and specifically not a
corner lot.
F. Interior Lot Line. The side yard lot line of a
corner lot that is adjacent to an interior lot's side yard line.
G. Reverse Frontage, Corner Lot. A corner lot where
the rear lot line is adjacent to a side lot line of an adjoining
lot or across an alley from such side line.
SECTION 2 - FENCE PERMIT
(Construction)Required
It shall be unlawful for any individual, partnership,
company or corporation to erect or have erected a fence or any part
of a fence, or permanent construction in the City limits of the City
of Grapevine, Texas, without first obtaining a construction permit.
SECTION 3 - APPLICATION FOR PERMIT
Any individual, partnership, company or corporation
making application for a fence construction permit must sign an
�,, application for same showing the following information.

A. Applicants name, address and in addition if the
' applicant represents a company or corporation, the name and address
�"" of the supervisor or foreman of said company or corporation and the
name of its president.
B. Name of owner of property.
C. Local address where fence is proposed to be erected.
D. Type of fence construction.
E. Height of fence.
F. Plat showing lot �n which fence is proposed to be
erected, location of adjoining or adjacent lots and with heavy
black lines outline the location of proposed fence.
G. Approximate evaluation.
SEC`_l'ION 4 - PERMIT FEE
�,,,,,, The fees for issuance of construction permits shall be
� computed from and same as the uniform building code.
� SECTION 5. PUBLIC PROPERTY.
No fence, guy wires, braces or any post of such fence
shall be constructed upon or caused to protrude over property that
the City of Grapevine or that the general public had dominion and
control over, owns, or has an easement over, under, around or
through, except upon utility easements which are permitted to be
fenced.
SECTION 6. RE.AR YARll REQUIREMENTS
It shall be unlawful to erect a fence at a height ex-
ceeding eight (8) feet in any rear yard or along any rear yard lot
line.
SECTION 7. SIUE YARD REQUIREMENTS.
It shall be unlawful to erect a fence at a height ex-
ceeding eight (8) feet in any side yard or along any side yard lot
line.
SECTION 8. FRONT YARD REQUIREMENTS.
� A. Corner lots - It shall be unlawful to erect a fence
in the required front yard building set-back area on any corner lot,
�r except along the interior lot line in accordance with Sub-Section "B"

B. Interior Lots.
l. It shall be unlawful to erect a fence,
hedge or vines over thirty-six inches
(36��) in height in the required front
yard area on any interior lot.
2. It shall be unlawful to erect a fence,
hedge or vines in the required front
yard area on any interior lot that does
not have at least 50% through vision.

3. It shall be unlawful to maintain a fence,
hedge or vines in the required front yard
�,,,, area of an interior lot in a manner that
does not permit at least 50/ through vision.
SECTION 9. REVERSE FRONTAGE CORNER LOTS.
On all reverse frontage corner lots it shall be unlawful
to construct a fence within the required side yard area that is ad-
jacent to a front yard area at distance closer than fifteen (15)
feet to the side property line or 'at a height greater than eight
(8) feet.
SECTION 10 . TYPE OF CONSTRUCTION.
A. No fence erected on property within a platted sub-
division shall be electrically charged in any manner or form.
This exclusion includes but is not limited to fences electrically
charged by battery or those tied in with the regular electrical
outlet.
B. No fence erected on property within a platted sub-
� division shall be constructed of barbed wire fencing.
C. It shall be unlawful to construct a chain link
Ir�.r fence in the required front yard area with the barbed wire along
the top in an up position.
D. In order to allow ingress and egress for fire de-
� partment personnel and fire department equipment, there shall be
at least one gate or opening with a minimum width of three (3)
feet in each fence that is adjacent to or running parallel to
any public alley, drainage easement, or utility easement except
this provision shall not apply to utility easements that the City
of Grapevine has allowed to be completely fenced in.
E. In non-platted sub-division areas, fence armed with
barbed wire and such arms are permitted on fences over six (6)
feet in height. Such arms may not extend over public right-of-way
or easements or over private property of another person.
SECTION 11. INSPECTION.
Upon completion of installation, the building inspector
shall be called upon for inspection. A certificate of acceptance
will then be issued or a rejection slip indicating the defects in
same. All fences constructed under the provisions of this ordi-
nance shall be maintained as to comply with the requirements of
this ordinance at all times .

SECTION 12. CONFLICTS BETWEEN FENCE ORDIN.ANCE AND
ZONING ORDINANCE.
In all cases of direct conflict between this ordinance
and the basic zoning ordinance, Ordinance No. 70-10, this ordinance
shall prevail.
SECTION 13. PE�.TALTY.
Any person violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and upon con-
viction in corporation court shall be subject to a fine not to
exceed two hundred ($200.00) dollars for each offen,se and each
� day any such violation shall continue shall be deemed a separate
offense.
SECTION 14. SAVINGS CLAUSE.
If any provisions hereof shall be held to be invalid or
unconstitutional for any cause, it shall not impair nor �ffect the
. remaining portion hereof, and all ordinances in conflict are hereby
repealed.
