AN ORDINANCE PROHIBITING MOBILE SERVICE UNITS
WITHIN THE CITY OF GRAPEVINE; DEFINING SAME;
PROVIDING A P�NALTY; AND DECLARING AN EMERGENCY
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, THAT:
PART I:
That the Code of the City of Grapevine, Texas is hereby
amended by adding a new Section FOUR to TITLE FOUR CHAPTER THREE
of said Code, which shall hereafter read as follows:
4-3-4: MOBILE SERVICE UNITS PROHIBITED:
(a) It shall be unlawful for any person, firm or corporation
to sell or dispense fuel from a mobile service unit
in the City of Grapevine, or to operate the same as
a service station, including self service.
(b) A Mobile Service Unit, as used in this section shall
mean and include any vehicle, tank, tank truck, or
other movable device from which flammable liquids
used as fuel may, as an act of retail sale, be
dispensed into the fuel tank of a motor vehicle. It
is the intent of this section to prohibit mobile
gasoline filling stations which either park or roam
around on off street parking lots and from which the
driver or attendant makes sales of gasoline to persons
whose vehicles are parked on such lots . This section
shall not apply to the delivery of liquified petroleum
gas to lawful recipients having proper containers
other than motor vehicles, or to the emergency delivery
of motor fuel to a stalled vehicle.
PART II:
Any person who violates any of the provisions of this
Section 4-3-4 shall be guilty of a misdemeanor and, upon conviction
thereof, shall be fined not to exceed t�ao hundred dollars ($200. 00)
for each offense.
PART III:
That if any section, subsection, paragraph, sentence,
clause, phrase or word in this Ordinance, or application thereof
to any person or circumstances is held invalid by any court of
competent jurisdiction, such holding shall not affect the validity
of the remaining portions of this Ordinance, and the City Council
of the City of Grapevine, Texas , hereby declares it would have
enacted such remaining portions despite any such invalidity.
PART IV:
The health and welfare and preservation of the public
health, safety and comfort of the citizens of Grapevine requires
the immediate passage of this Ordinance and the same shall take
effect immediately from and after its passage and it is accordingly
so ordained.
