ACKNOWLEDGEMENT
All Conditional Use and Special Use Applications are assumed to be complete
when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and
interested citizenry. Public hearings may be continued to the next public hearing.
Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

Please revise the site address from 701 E. Northwest Highway to 525 and
add case number CU14-43 to the signature block of all each sheets.
Dimensional Control Site Plan
• Please label the site plan as the Dimensional Control Site
Plan.
• Please verify that the perimeter dimensions of the subject site
agree with the graphic scale used.
• Please label the site tabulations table as a the site data table
and provide the amount required and provided: height in
stories and feet, total lot area, total building area, total
impervious, total open space (landscaping), total building and
paved areas (impervious) and parking. Also please include
the percentage required and provided of open space,
building coverage and impervious surface. The parking
required is 1 parking space per three persons (based upon
the maximum occupant load). Please provide a floor plan
which illustrates the seating/occupant load.
• Please label and hatch the awnings along the south and east
elevations.
• Please clarify if the 4,110 square feet area of the building
includes the awnings?
• The required setback for an on -premise sign is ten (10) feet
from the property line. Please dimension the distance of the
proposed sign to the adjacent property line. On premise
signs will require an approved sign permit from Building
Inspections.
• In the "Notes" section the lighting requirements are found in
Section 55. Please revise accordingly.
Please add the following notes to the dimensional control
site plan:
o Conditional use request CU14-43 is a request to
allow a restaurant with a drive through.

o Light fixtures including the base shall be mounted
no higher than the highest point on the primary
structure or 25 feet in height.
o Lighting levels at the north property line may not
exceed 0.5 footcandles and adjacent to the south,
east and west property lines, including on -premise
signage may not exceed 3.0 footcandles.
• If any outdoor seating or outside speakers are proposed
please label the location and provide a loudspeaker plan
including the type, quantity, time of day used and the
proposed decibel level.

(817) 410-2304 for any questions regarding the following
comments:
o As a result of the loss of the second driveway a "dead
end T" or "hammerhead" is required.
o Provide a 30 foot radius in lieu of the 20 foot radius at
the driveway entrance and at the point of the hammer
head.
• Please provide a dimensioned floor plan with the quantity of
seats shown and the entrance(s) labeled.
• If outdoor seating is proposed please show the location and
provide the type of table and chairs for the outdoor seating
area.
• If any outside speakers are proposed please provide an
outdoor speaker plan which shows location, type and quantity
of speakers.
Elevations
• Please provide uncolored elevations. The exterior elevation
sheets and the exterior building signs sheets contain much of
the same information and may be consolidated into two
sheets from four.
• Provide label the exterior material of proposed building and
provide the masonry calculation chart of the elevations for
entire structure exclusive of doors and windows.
• Provide the elevation of the refuse storage area screening
device including the gate. Refuse storage areas are to be
screened by a solid wall or fence one (1) foot above the
dumpster not to exceed eight (8) feet.
• Provide a graphic and numeric scale.

Please provide the screening device adjacent to the north
property line. Screening Alternate A or C, a solid masonry
wall or solid wood fence respectively, is required adjacent to
the north property line.
• Please provide an elevation of the light pole fixture and base.
Light fixtures including the base shall be mounted no higher
than the highest point on the primary structure or 25 -feet in
height.
• Mechanical and electrical equipment, including air
conditioning units, are required be designed, installed and
operated to minimize noise impact on surrounding property.
Please illustrate how the mechanical and electrical equipment
will be screened from public view.

from abutting properties. The west property line requires
screening in the form of a wall, fence, hedge or berm. Please
revise accordingly.
• Crepe Myrtle trees are not approved site trees or planter
island trees. Please refer to the Required Tree List for
Landscaping and the Required Tree List for Landscape
Islands. Please revise the landscape plan accordingly.
• The required setback distance is ten feet from the property
line for an on -premise sign. Show the location of the
proposed sign, the sign type and dimension the distance of
the proposed sign to the adjacent property line.
• All open ground within 20 -feet of any building or paving
requires ground cover, shrubs and other landscape material.
Please demonstrate how decomposed granite meets the
requirement.

Robertson — Manager of Engineering or Paul Lee — Senior Civil

• The western most driveway does not meet the separation
with the adjoining property. If the other drive needs to move
for site circulation the City will accept the location even if
does not line up with the road on the south side of Northwest
Highway.
• Mutual access easements across the frontage to connect
with Mad Duck and to the property line for future
development will be required.
• The preliminary drainage plan refers to the City of Plano.
Please revise accordingly.

Thirty (30) reduced sorted (collated sets) copies at 11" x 17" three hole
punched, stapled and z -folded (fold the right edge to the left edge
and then fold the right edge in half to form a z -fold).

On Tuesday evening, November 18, 2014 at 7:30 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following items:
Z14-03 — DCT Fellowship West - submitted by Pacheco Koch, LLC for property located at
3175 and 3193 Bass Pro Drive and proposed to be platted as Lot 1, Block 1, DCT Freeport.
The applicant is requesting to rezone approximately 12.9 acres from "CC" Community
Commercial District to "LI" Light Industrial District. The property is currently zoned "CC"
Community Commercial District and is owned by Fellowship Church.
CU14-41 — Enterprise Car and Truck Rental —submitted by Baldwin Associates for property
located at 849 East Dallas Road and proposed to be platted as Lot 1 R, Block 1, Sunshine
Harbor Industrial Addition. The applicant is requesting a conditional use permit to allow a car
and truck rental facility. The property is zoned "LI" Light Industrial District and is owned by
Mary Hannah Watson.
CU14-42 - Starbucks - submitted by 114 Grapevine Towers LLC for property located at 1325
William D Tate Avenue and platted as Lot 2A1, Block 1, Hayley Addition. The applicant is
requesting a conditional use permit to amend the previously approved site plan for a planned
commercial center to allow outside dining, and a drive-thru in conjunction with a restaurant.
The property is currently zoned "HU Highway Commercial District and is owned by 114
Grapevine Towers LLC.
CU14-43 — Taco Casa - submitted by JDJR Engineers for property located at 525 East
Northwest Highway and proposed to be platted as Lot 3R1 A, Block 1, W R Boyd Center. The
applicant is requesting conditional use permit to allow a restaurant with a drive-thru. The
property is zoned "CC" Community Commercial District and is ownedby The Miles
Foundation.
After all parties have been given an opportunity to speak, the public hearing will be closed
and the Commission and the City Council will deliberate the pending matters. Please contact

REQUESTED CONDITIONAL USE REQUEST AND COMMENTS:
The applicant is requesting a conditional use permit to allow for a restaurant with drive-
through service.
The applicant intends to develop a 4,110 square foot Taco Casa restaurant on the subject
site with drive-through service on the west side of the structure (single window with dual
drive through lanes) and two order lanes at the north of the structure. One monument sign
is proposed on the south side of the site adjacent to East Northwest Highway. The
restaurant will provide seating for 82 patrons. No outdoor dining or outdoor speakers are
proposed. The applicant has provided 47 parking spaces -33 parking spaces are
required.
PRESENT ZONING AND USE:
The subject site is zoned "CC" Community Commercial District and is vacant.

HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and surrounding properties were zoned "C-2" Community Business
District prior to the 1984 City Rezoning. The subject property and the property to the north,
east and west were rezoned from "C-2" Community Business District to "CC" Community
Commercial District during the 1984 City Rezoning. The property to the south was rezoned
to "HC" Highway Commercial District during the 1984 City Rezoning. At Council's February
15, 2011 meeting the site to the north was rezoned from "CC" Community Commercial
District to "R -MF -2" Multifamily District Z11-01 (Ord. 2011-11) for the development of a 319
unit apartment complex.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "R -MF -2" Multifamily District—Grapevine Texan Apartments
SOUTH: "HC" Highway Commercial District—Dekra State Inspections and

EAST: "CC" Community Commercial District—vacant and Mad Duck Cyclery

AIRPORT IMPACT:
The subject tract is located within "Zone A" Zone of Minimal Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few
activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial land use. The
applicant's request is in compliance with the Master Plan.
The Thoroughfare Plan designates East Northwest Highway as a Type "C" Minor Arterial
with a minimum 80 foot right-of-way developed as four lanes with a center left turn lane.

This letter is to verify that your request for a conditional use permit located at 525 East Northwest
Highway and platted as Lot 3R1A, Block 1, W R Boyd Center to allowfor a drive-through service
in conjunction with a restaurant was approved by the City Council on November 18, 2014.
On November 18, 2014, the Planning and Zoning Commission recommended the City Council
approve the request as stated above.
Any changes to a site plan approved with a conditional use ora special use (no matter how
minor or major) can only be approved by city council through the public hearing process.
No Conditional Use Permit shall be valid for a period longer than one (1) year from the date on
which the City Council grants the Conditional Use, unless within such one (1) year period: (1) a
Building Permit is obtained and the erection or alteration of a structure is started, or (2) an
Occupancy Permit is obtained and a use commenced.
The City Council may grant one additional extension not exceeding one (1) year, upon written
application, without notice or hearing. No additional extension shall be granted without complying
with the notice and hearing requirements for an initial application for a Conditional Use Permit.

Ms. Batte:
Gene Upshaw desires to construct a Taco Casa Restaurant at the above referenced
location. The proposed restaurant is a casual dining establishment with a total of 89 seats
for indoor dining. There will also be drive-thru service for the convenience of those
customers that want to eat their food off-site. Normal operating hours are 10 am to 11 pm
daily.
The property is zoned CC -Community Commercial which allows restaurants as a use, but
drive-thru service is only allowed by an approved Conditional Use Permit (CUP). We
believe the request to have drive-thru service at this location does not harm the value,
use, or enjoyment of other properties in the area. There are other restaurants with drive-
thru service in the near proximity to this site, and the addition of this restaurant will only
benefit the citizens that live or work in this area.
The property on both sides of this property are also zoned CC. The properties to the west
are developed with commercial uses (glass/mirror contractor and a multi -tenant office
warehouse development). The property to the east is currently vacant. The property to
the rear is zoned R -MF -2 and developed as an apartment complex. The site design of the
proposed restaurant eliminates/minimizes any noise, light, or other effects from the
proposed use.
