BACKGROUND INFORMATION: A zone change application for a 14,000 square foot lot addressed at 210 North Starnes Street was considered at the July 15, 2008 meeting and tabled pending further review at a workshop to consider zoning and land uses along this portion of North Starnes Street. The applicant was requesting to rezone the subject lot from it's current zoning of "R-5.0" Zero Lot Line District to "HC" Highway Commercial District with the intent to replat the property and combine it with the lot immediately adjacent to the south for the development of a 5,800 square foot office building. Discussion during the public hearing centered on the appropriateness of the zoning requested i.e. "HC" Highway Commercial District zoning versus "PO" Professional Office District zoning and the impact to the area if an encroachment of non-residential zoning were to be approved. A review of the actual land uses along North Starnes Street reveals that the street is a combination of residential and non-residential uses with a distinct demarcation approximately 300 feet north of East Northwest Highway separating the two. The subject lot considered for rezoning at 210 North Starnes Street is part of an eleven lot group on both sides of Starnes Street that is primarily developed as single family detached residences. Further to the north on the west side of Starnes Street is a four building complex for the Grapevine Housing Authority. On the east side, opposite the Grapevine Housing Authority property is the Love Chapel, a church which is currently vacant and under review for consideration of a History Landmark Subdistrict Overlay. To the west of this eleven lot study area there is non-residential development, primarily retail in orientation that has frontage along North Main Street. To the east the property is 0:\ZCU\wk081408.StamesStreet.zoning.doc 1 8/8/2008 2:45:14 PM also non-residential, comprised of office, warehouse and auto repair uses that has frontage along Central Avenue. In essence this eleven lot study area, currently zoned "R-5.0" Zero Lot Line District is a pocket of residential uses surrounded on three sides to the south, east, and west by non-residential uses comprised of "HC" Highway Commercial District and "CN" Neighborhood Commercial District zoning. Prior to the 1984 City Rezoning, the subject and surrounding area was a mixture of residential ("R-1" Single Family District and "R-2" Two -Family District) and non-residential uses ("C-1" Neighborhood Business District and "C-2" Community Business District) in the same basic configuration that is today. The eleven lot study area and the property further to north known as the "Hill" was rezoned during the 1984 City Rezoning to "R -MF -1" Multifamily District. In 2001, initiated by the City of Grapevine, this same twelve acre area was rezoned to "R-5.0" Zero Lot Line District. Attached are scaled exhibits showing the current zoning, actual land uses, and future land use designations for the subject study area. Also attached is a letter from a concerned property owner in the study area. File #: Z08-05 To the City of Grapevine Planning and Zoning Commission: From: David Barnhouse 221 North Starnes Grapevine, TX 76051 817-909-9276 Gentlemen and Ladies of the Zoning Commission, I would like to apologize for missing the hearing on the request by George Kuketz for 210 North Starnes to be rezoned. I have been out of town for +- 3 months plus my father has been hospitalized with a terminal illness for the last 3 weeks in Sherman, TX. As such, I had not had time to catch up on my mail. Please allow me to provide a short description of my professional background. I have been involved in residential real estate for the last 20 plus years. I have been a licensed Texas real estate salesperson and a licensed Texas real estate broker. The last 15 years I have been on the lending side of this profession. I have worked for Price Waterhouse Coopers, EMC Mortgage Corporation and Countrywide Financial to name a few companies that your group might be familiar with. My last job title was a traveling Senior Underwriting Manager for Countwide Financial. My job duties required in depth knowledge of all aspects of loan approval on residential real estate. This included knowledge of real estate appraisals from start to finish on loans up to $1,000,000.00 individually. I live within 200 feet of the proposed rezoning. To allow Mr. Kukertz to rezone that individual property will decrease my primary residence property value. Appraisers are required to address unusual situations regarding the property they are appraising. It is not considered positive to have a commercial business located across the street from a house. As such, a negative dollar amount would have to be included in my appraisal due to the new business. In addition pictures of the property and views of the street (up and down) are required. These pictures, along with the street views, will have a negative impact on the value of my house. Please note the following.... I am not against Mr. Kuketz's rezoning if the entire street is rezoned the same way. The overall view of the neighborhood, as it stands now, does not provide a positive example of what I am sure the City is trying to portray. Fifty percent or more or the neighborhood is occupied by substandard housing by visual inspection fron. the street. In addition, both the west and east side of Starnes backs up to commercial property. Indeed, this street has (and has had) commercial businesses being operated out of what are suppose to be houses. I do believe that to allow the entire street to be rezoned would be a large improvement for the 'image I believe the City of Grapevine is trying to portray. TATE AVENUE RECOMMENDATION: Staff recommends the Planning and Zoning Commission consider possible zoning text amendments to Section 60, Sign Standards relative to forty foot pole signs along William D. Tate Avenue, and take any action necessary. BACKGROUND INFORMATION: Currently, pole signs in excess of 20 -feet in height up to a limit of 40 -feet are allowed as a conditional use on property that is zoned "CN" Neighborhood Commercial District, "CC" Community Commercial District and "HC" Highway Commercial District provided that property has frontage on State Highway 360, State Highway 114 (excluding Business 114 i.e. Texan Trail), F.M. 2499 and State Highway 121—excluding that area of S.H. 121/William D. Tate Avenue that is 2,400 feet south of the southern right-of-way of Timberline Drive all the way south to the city limit line. In simpler terms, a request for a pole sign in excess of 20 -feet must have the appropriate zoning and be located along a state highway (excluding S.H. 26) or F.M. 2499 however, no pole sign in excess of 20 -feet can be located on State Highway 121/William D. Tate south of the S.H. 121/360 intersection. The exclusion of this portion of S.H. 121 relative to pole signs in excess of 20 - feet was based primarily on the desire to limit visual clutter along one of the main entryways into the city. Major developments that have occurred in the recent past e.g. the Tom Thumb shopping center and the former Winn-Dixie shopping center were approved with monument signs as their primary on -premise form of advertising. A request was made earlier this year by the present owners of the former Winn- Dixie shopping center located at the northeast corner of Glade Road and S.H. 121 for a 40 -foot pole sign to be located along the northbound service road of State Highway 121. This request could not be processed given the exclusion area outlined above. Changeable Copy: Sign face with changeable copy may be permitted provided they meet the provision of Section 48 and a Conditional Use Permit is issued. d. POLE SIGNS. A sign that is mounted on a freestanding pole, conforming to the following regulations: (1) Engineering Regulations. All pole signs shall be designed in accordance with Chapter 23 of the Grapevine Building Code. All plans and specifications shall be prepared by a professional engineer. Wind pressure design for signs shall be twenty (20) pounds per square foot for signs less than thirty (30) feet in height and twenty-five (25) pounds per square foot for signs thirty (30) feet to forty (40) feet in height. (2) Sign Cabinet. Paint grip sheet metal on angle iron frame with angle retaining rim to secure sign face or other materials approved by the Director of Development Services. (3) Sign Cabinet Minimum Gross Surface Area. Thirty (30) square feet. (4) Maximum Sign Cabinet Dimensions and Maximum Gross Surface Area. The maximum gross surface of the sign cabinet shall be one hundred eight (108) square feet with a maximum cabinet width of twelve (12) feet, a maximum cabinet height of twelve (12) feet and a maximum cabinet depth of fourteen (14) inches. (5) Sign Face. Flat, clear acrylic sheet, or other material approved by the Director of Development Services; all copy and background sprayed on second surface with acrylic colors. Thirty (30) percent of the gross surface area of the sign face may have changeable copy. Neon tubing on solid background. (6) Changeable Copy. Thirty (30) percent of the gross surface area of the sign face may have changeable copy. All explanatory text related to the changeable copy shall be calculated as a part of the thirty (30) percent gross surface area. y Section 60 022007 be no minimum or maximum cabinet width or height regulations for signs approved with a conditional use exceeding twenty (20) feet in height. d. The Director of Development Services may approve the replacement of an existing pole sign, approved in conjunction with a conditional use permit, with a monument sign. e. PROJECTING SIGNS. A sign that is wholly or partly dependent upon a building for support and which projects more than twelve (12) inches from such building, but less than forty-eight (48) inches. f. ROOF SIGNS. A sign fastened to or resting on the roof of a structure. g. WALL SIGNS. A sign fastened to or painted on a wall of a building or structure in such a manner than the wall becomes merely the supporting structure or forms the background surface, and which does not project more than twelve (12) inches from such building. h. PORTABLE COMMERCIAL BILLBOARDS. Any sign which is supported by the ground but not attached to the ground, or other object which is used primarily to advertise to the general public for commercial purposes; is of a temporary nature; is not directly connected to or in relation to or in close proximity to a business, church, development or other establishment that is being advertised. L PORTABLE ON-SITE BUSINESS SIGNS. Any sign supported by the ground but not attached to the ground or other object, which is of a temporary nature, and is used for advertising purposes connected to, adjacent to or in close proximity of the business, church, development or other establishment that is being advertised. j. PORTABLE SANDWICH BOARD. A portable sign, consisting of two panels of equal size, made of painted, decay resistant wood, which are hinged at the top and placed on the ground or pavement so as to be self supporting. Portable Sandwich Boards must conform to the following regulations: (1) Maximum sign height shall be three (3) feet. NEW BUSINESS CONSIDERATION OF POSSIBLE ZONING CHANGES(S) TO THE PROPERTY ALONG NORTH STARNES STREET First for the Commission to discuss was possible zoning changes(s) to an eleven lot study area along North Starnes Street, on both the east and west sides of the street. A zone change application for a 14,000 square foot lot addressed at 210 North Starnes Street was considered at the July 15, 2008 meeting and tabled pending further review at a workshop to consider zoning and land uses along this portion of North Starnes Street. The applicant was requesting to rezone the subject lot from 081408WK P & Z WORKSHOP MINUTES AUGUST 14, 2008 it's current zoning of "R-5.0" Zero Lot Line District to "HC" Highway Commercial District with the intent to replat the property and combine it with the lot immediately adjacent to the south for the development of a 5,800 square foot office building. Discussion during the public hearing centered on the appropriateness of the zoning requested i.e. "HC" Highway Commercial District zoning versus "PO" Professional Office District zoning and the impact to the area if an encroachment of non- residential zoning were to be approved. The Commission discussed wanting to maintain the residential atmosphere of the area. There currently is no buffer between the commercial district and the residential district. Further discussion was held regarding changing the master plan and reviewing zone changes on a lot by lot basis as requested by the property owners. Monica Hotelling moved to set a public hearing to change the master land use on Lots B, C, L, M and N, J J Hall Addition and the north portion of Lot 1 R, Starnes Addition from "RM" Residential Medium Density to "LC" Commercial Light Intensity. B J Wilson seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Hotelling, Fechter and Martin Nays: None AMENDMENTS TO SECTION 60, SIGN REGULATIONS Next for the Commission to discuss was amendments to Section 60, Sign Regulations relative to forty foot pole signs along William D Tate Avenue (State Highway 121). Currently, pole signs in excess of 20 -feet in height up to a limit of 40 -feet are allowed as a conditional use on property that is zoned "CN" Neighborhood Commercial District, "CC" Community Commercial District and "HC" Highway Commercial District provided that property has frontage on State Highway 360, State Highway 114 (excluding Business 114 i.e. Texan Trail), Farm to Market Road 2499 and State Highway 121—excluding that area of State Highway 121/William D. An appeal to the Board of Zoning Adjustment would be inappropriate since there is no pure physical hardship that disallows placement of a sign—a 20 -foot pole sign could be requested but is not large enough to suit the needs of the shopping center. Given the competitive pressure from adjacent cities e.g. the City of Euless to the south and the City of Colleyville to the west, staff is recommending the Commission consider the appropriateness of this exclusion area. The new Vineyard Village shopping center in Euless at the southeast corner of Glade Road and State Highway 121 has three pylon signs approximately 60 -feet in height along State Highway 121. Across State Highway 121 to the west, still in the City of Euless, the Heritage Towne Crossing shopping center has two pylon signs approximately 50 -feet and 20 -feet in height. At the northwest corner of Glade Road and State Highway 121 in Colleyville, the Glade Points shopping center has a pylon sign approximately 20 -feet in height. After a brief discussion, staff was directed to bring a draft ordinance back to the Planning and Zoning Commission for review to include that pole signs over 20 -feet can be requested along with a planned commercial center and must conform to the architectural features of the shopping center.
