HomeMy WebLinkAboutBZA1990-31STATE OF TEXAS CITY OF CRAPEVTNF The Board of 7oninq Adjustment for the City of Grapevine, Texas, met in regular session on Monday evening, January i, 1991, at 6:00 P.M , in the Council Chambers, Room 12.05, 307 West Dallas Road, Grapevine, Texas with the fol.l.owiDq members present to wit: Charles Giffin Paymonci Truitt Matti_ Bass John Dor.ety Randy Howell Chairman Vice-Chairman Member Member 2nd Alternate constituting a quorum with Secretary, Gerald Thompson and lst Alternate, Andrew Quinn absent. Also present was City Council_ Representative, Gil Traverse and the following City Staff: Greg Wheeler Building Official_ Joy Carroll Administrative Aide Marcy Ratcliff Planner Ray Collins Planner Chris Caso Attorney, City Attorney's Office Gerri..e Anderson Administrative Secretary CALL TO ORDER The meeting was called to order at 6:06 p.m. by Chairman, Charles Gi..ffin. The first item of the Agenda for the Board of Zoning Adjustment to consider was alternate holiday meeting dates, which Patti Bass made a. motion to move this item to the end of the meeting. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Giffin, Truitt, Bass, Dorety, Howell_ Nays: None Absent: Thompson, Quinn OLD BUSINESS BZA90 -31, DUNCAN, DICKSON AND TAYLOR The item of old business for the Board of Zoning Adjustment to consider was BZA 90 -31, submitted by Duncan, Dickson and Taylor who is requesting variances for the Westwood Subdivision. This case was tabled from last months meeting due to the applicant needing more time to prepare the case. The request is in conjunction with Zoning Application Z90 -10. The City Council and Planning and Zoning Commission Public Hearing was held November 20, 1990, to consider the request for R -5.0, Zero Lot Line Zoning, for 19.226 acres previously zoned and platted for R -TH, Townhouse District Regulations. As recommended by the Planning and Zoning Commission, the City Council approved R -5.0 zoning as requested on first reading of the ordinance. Greg Wheeler explained that Staff recommends approval to Grapevine Zoning Ordinance €32 ---73, Section 16 ®G. 1 , R-5.0 Zero Lot Line 25 foot front yard requirements to allow 20 feet. instead (a 5 foot variance) for the following Tots: ?lock 1, Hots 1 through 14 Block 2, Tots 8 and 9 Block 3, Lot 10 3, Block 4, Lots I through R, and 11 through 17 Staff recommends denial to the variance .requested to Grapevine Zoning Ordinance 82 -73, Section 16.0.2, which requires a 25 foot rear yard. The request is to allow a l -5 font rear yard (a 1.0 foot variance) for the following lots: Block 1, Lots 1_ through 14 Block 2, Tots 8 and 9 Block 3, Lot 1.0 Block 4, Lots 1. through 8, and 11 through 1.3 A 20 foot rear yard is requested (a 5 foot variance) for Block 5, Lots 1 through 1.4. Staff recommends approval to: Section 16.6.5, R-5.0, Zero Trot. .Line 100 foot lot depth requirement for the following lots: Block 1, Tots 1 through 14 (a 5 foot variance -95 feet) Block 2, Lot 1 (a 2 foot variance -98 feet) Block 2, Lots 8 and 9 (a 19 foot variance --81 feet) Staff also recommends approval. to: Section 1.6.H which requires a 40 foot buffer yard between R -5.0, R -MF -2 and R--TH developments for the following lots: Block 1, Lots 1 through 14 Block 4, Lots 9 through 14 and 22 Block 7, Lots 1 through 7 Mr. Doyle Cameron, applicant, of 16200 Dallas Parkway, Dallas, Texas, 75248, took the Oath of Truth and explained that they re- platted for single family lots as nearly as possible. Mr. Cameron noted that an 8 foot fence will be built around the subdivision with a stone entry and brick columns. with no one else to speak either for or against the request, Raymond Truitt made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: BOARD OF ZONING ADJUSTMENT W p j} g p F PAGE 3 Ayes: Giffin, T °' u _i_ t t, Bass, D o r, e t y, Howell Nays; None Absent: Thompson, Quinn Mr. Cameron explained the reason for the request to the 25 foot rear yard requirements to allow a 15 foot rear yard is to dive more flexibility to build back to 15 feet. More side yar6 would then he possible on the 11 :root: side allowing more open space on the otheu side, to allow a larger product. Raymond Truitt expressed that he had no problems with the variances for Block 4 because the lots backed up to the school property. Afte?r further discussion, Randy Howell made a motion that spec.i.al conditions did exist. He further stated that the speacial conditions are that the subdivision is existing and the streets and utilities are already installed which creates a hardship. Patti. Bass seconded the motion which prevailed by the following voted Ayes: Giffin, Truitt, Bass, Dor_ety, Howell Nays: None Absent: Thompson, Quinn Randy Rowell then made a motion to approve the variances to Grapevine Zoning Ordinance 82 -73, Section 16.0.1, to allow 20 foot front yards, a five foot variance for Lots 1 through 14, Flock 1; Lots 8 and 9, Block 2; Iat 10, Block. 3, and Lots l_ through 8, and 11 through 17, Block 4; to deny the variances to Section 16.G.2, which requires a 25 foot rear yard for Lots 1 through 14, Block l; Lots 8 and 9, Block 2; Lot 10, Block 3; and. Lots 1 through 8, and .11 through 13, Block 4; and denial to the 20 foot rear yard requested for Lots 1 through 14, Block 5; to grant the variances to Section 16.G.5, 100 foot lot depth requirements for Lots 1 through 14, Block 1 (a 5 foot variance-95 feet) ; Lot 1, Block 2 (a 2 foot variance -99 feet) ; and Lots 8 and 9, Block 2 (a 19 foot variance -81 feet) ; and approval to Section 16.H which requires a 40 foot buffer 5xard between R -5.0, R -MF -2 and R--TH developments for Lots 1 through 14, Block 1; Lots 9 through 14 and 22, Block 4; and Lots 1 through 7, Block 7.
