Conditional Use Request CU21-01 was submitted by TiNany Roth of Rogue Architects
and approved on the first reading of an ordinance by Council at the February 23, 2021
meeting. The request was to allow for a drive through restaurant with outside dining and
2. 20-foot pole sign.
The applicant's intent is to re -image the former Taco Bueno on the subject site for the
purpose of establishing HTEAO, a self-service restaurant featuring flavored ice tea and
flavored water. Also proposed is patio seating for six patrons and a 20-foot, 90 square
foot pole sign with changeable copy. The applicant sought approval of a special
exception from the Board of Zoning Adjustment relative to interior, perimeter and non -
vehicular open space landscaping requirements. The Board approved the special
exception request at their March 1, 2021 meeting.

when filed and will be placed on the agenda for public hearing at the discretion of
the staff. Based on the size of the agenda, your application may be scheduled to a
later date.
All public hearings will be opened and testimony given by applicants and

Public hearings will not be tabled.
Any changes to a site plan (no matter how minor or major) approved with a
conditional use or a special use permit can only be approved by city council
through the public hearing process.
Any application for a change in zoning or for an amendment to the zoning
ordinance shall have, from the date of submittal, a period of four months to
request and be scheduled on an agenda before the Planning and Zoning
Commission and City Council. If after said period of four months an application
has not been scheduled before the Commission and Council said application shall
be considered withdrawn, with forfeiture of all filing fees. The application, along
with the required filing fee may be resubmitted any time thereafter for
reconsideration. Delays in scheduling applications before the Planning and
Zoning Commission and City Council created by city staff shall not be considered
a part of the four month period.

We would like to submit a conditional use permit to allow for a drive thru lane at 1113 W
Northwest Highway in Grapevine, TX. The site parking lot area will undergo much -needed repaving and
will be landscaped. The building elevations will be updated and a patio area with outdoor seating will
be provided to those who wish to enjoy fresh brewed tea outdoors. There will be one outdoor speaker
that with low volume music for those entering the building and one for those enjoying the patio space.
The existing pole sign will be removed, and a new pole sign will be installed.
During peak hours, an employee will stand in the drive thru lane with an iPad or similar device to
take orders for those in the second drive thru lane. During non -peak hours, the second drive thru lane
will be closed off with a cone. Customers are served at the front counter or in the drive thru. There will
be outdoor seating available with no interior seating. The hours of operation are tentatively:
Monday 7AM-8:05PM, Tuesday 7AM^8:05PM, Wednesday 7AM-8:05PM, Thursday 7AM-8:05PM, Friday
7AM,8:05PM, Saturday 8AM-8:05PM, Sunday 11 AM-8:05PM.
HteaO is a Texas -based retail franchise that sells ultra -premium flavored iced tea, water and
related products that give people safe and healthy food choices in a fun and clean environment. The
iced tea is self -serve from brewers on the sales floor where space is optimized for patron experience with
merchandise walls displayed throughout. The back of house consists of tea prep for the sales floor and
drive thru and accessory storage area.
The proposed use will not cause harm to the value, use, or enjoyment of other property in the
neighborhood. HTeaO will increase the value and enjoyment of the vacant property.

Section 7. That any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum
