SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA96-13
MEETING DATE: MONDAY, MAY 13, 1996
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the variances and special
exception requests to the Grapevine Comprehensive Zoning Ordinance 82-73 for
proposed Lot 1, Block 1, Bear Creek Park Addition and addressed as 3230 South
State Highway 360 as follows:
1. Section 15.F.2., "R-7.5" Single Family District Regulations require a minimum
lot size of 7,500 square feet.
The proposed variance would allow a 5,000 square foot reduction of the
minimum lot size. If approved, it would allow a minimum lot size of 2,500
square feet.
2. Section 15.G.1., "R-7.5" Single Family District Regulations require a minimum
front yard setback of 30 feet.
The proposed variance would allow a 14 foot encroachment into the required
front yard setback. If approved, it would allow a minimum front yard setback
of 16 feet.
3. Section 15.G.2., "R-7.5" Single Family District Regulations require a minimum
rear yard setback of 25 feet.
The proposed variance would allow a 2 foot encroachment into the required
rear yard setback. If approved, it would allow a minimum rear yard setback of
23 feet.
4. Section 15.6.4., "R-7.5" Single Family District Regulations require a minimum
lot width of 65 feet.
The proposed variance would allow a 15 foot reduction of the minimum lot
width. If approved, it would allow a minimum lot width of 50 feet
5. Section 15.G.5., "R-7.5" Single Family District Regulations require a minimum
lot depth of 100 feet.
The proposed variance would allow a 50 foot reduction of the minimum lot
depth. If approved, it would allow a minimum lot depth of 50 feet
6. Section 38.J., Governmental Use requires landscaping in accordance with
Section 53 Landscaping Regulations.
The proposed special exception would exempt the lot from landscaping
requirements of Section 53 Landscaping Regulations If approved it would not
require any landscaping within the lot area.
SPECIAL CONDITION:
Staff finds a special condition exists because the antenna is proposed to be located
on top of an existing TU Electric tower in a TU Electric easement within a City of
Grapevine public park. The applicant is required to plat the property in order to submit
the Special Use Permit Application to City Council and the Planning and Zoning
Commission and to receive a building permit. The applicant is only platting the area
covered by the existing tower. Additionally, a public park is considered recreational
open space/landscaped area.
BACKGROUND INFORMATION:
William Cothrum of Masterplan submitted the request in conjunction with a Special
Use Permit SU96-01 for placement of an antenna on an existing TU Electric tower in
Bear Creek Park.

ATTACHMENT NO. 6 PLANNING
PCS PrimeCo is a newly licensed personal communications services (PCS) provider
in the area that provides a public service - wireless telephone service. In building their
network, PrimeCo's intent is to minimize the impact on community aesthetics by
mounting antennas on existing structures, and to avoid building new monopoles when
possible. When a location is under consideration, both private and public structures
will be considered, including utility towers and water towers.
A typical cell site consists of an antenna array and an equipment cabinet. The
antennas send and receive messages from wireless users, and are subsequently
transported to the cabinet via cables. The cabinet houses the electronic equipment
necessary for the site to interface with the PCS system and the public phone network.
The subject cell site antenna will be mounted on an existing TUE transmission tower
which is on an easement for utilities. Because of the location of the existing tower and
due to the fact that the easement traverses private property, it is not possible to meet
all the standards for the zoning district. In order to create a lot that meets all the
standards it would be necessary to encumber more private property; therefore, it would
not be available for other tax generating development.

SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA96-18
GRAPEVINE RELIEF AND COMMUNITY EXCHANGE
MEETING DATE: MONDAY, MAY 13, 1996
Staff recommends the Board of Zoning Adjustment approve the request to Grapevine
Comprehensive Zoning Ordinance 82-73 for the West portion of Block 3, Grapevine
Service Center Addition and addressed as 604 Shady Brook Drive as follows:
1. Section 54., Masonry Requirements require all structures in the Government
Use District to have at least seventy (70) per cent of the total exterior walls
constructed of masonry.
The special exception request is to allow a one hundred (100) per cent
reduction of the exterior masonry requirement. If approved, it would allow a
structure to be moved onto the site with no exterior masonry.
SPECIAL CONDITION:
Staff finds a special condition exists for the request. This structure has historic value
that Staff feels would be compromised by the addition of a masonry exterior. As this
building was originally designed without masonry veneer, the energy and expense of
adding masonry would preclude its utilization, resulting in its demolition, and the loss
of a resource.
An application was submitted to the Department of Development Services by Tricia
Wood, Executive Director of GRACE. The building will be placed on City Service
Center property behind the existing GRACE facility, and will be used as a retail thrift
shop.

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment consider the request to Grapevine
Ordinance 94-09 for the Western Oaks Phase III Subdivision for Lot 6, Block A,
Western Oaks III and addressed as 3205 Magnolia Court as follows:
1. Ordinance 94-09 - Deed Restrictions, require the vehicular access door or
opening of all garages to face perpendicular (90 degrees) to the platted front
yard setback line as shown on the final plat.
The request is to allow a reduction of twenty (20) degrees to the required
ninety (90) degree orientation to the front building line. If approved, the
variance would allow the vehicular access door of the second garage to be
placed at an angle of seventy (70) degrees to the front building line as shown
on the plot plan.
SPECIAL CONDITION:
Staff finds no special condition for the request. The proposed residence has adequate
off-street parking and garage space without the addition of the second garage.
Additionally, a second garage could be placed on the property in compliance with the
deed restrictions. However, Staff feels that the unusual shape of the cul-de-sac lot
warrants consideration.
BACKGROUND INFORMATION:
An application was submitted to the Department of Development Services by Mr.
Darrell Bruce representing Riviera Residential Properties, Inc. The subject deed
restriction was approved by the Planning and Zoning Commission and City Council at
the February 2, 1994 public hearing. The deed restriction was put in place as the
result of input from citizens at the public hearing.

KNOW ALL MEN BY THESE PRESENTS
Mockingbird Development, Ltd. by Beverly Development Corp., General Partner
("Declarant") is the owner in fee simple of certain real property consisting of
approximately 27.72 acres located in Tarrant County, Texas, being more particularly
described on Exhibit A attached hereto and incorporated herein for all purposes (the
"Property" or the "Addition").
Declarant hereby covenants and agrees that Declarant, and its successors and
assigns, shall develop the Property in accordance with, and does hereby impress the
Property with, the following deed restriction, to wit:
1) The platted subdivision shall have an average lot size of 12,000 square
feet.
2) The vehicular access door or opening of all garages shall face from
perpendicular to the platted front yard setback line to the rear property
line. (See Exhibit B)
3) All other restrictions of the R-7.5 Single Family Zoning District shall
apply to the addition.
These restrictions shall continue in full force and effect for a period of twenty-
five (25) years from the date of execution, and shall automatically be extended for
additional periods of (10) years unless terminated in the manner specified herein.
These restrictions shall not be altered, amended or terminated without a public
hearing before the City Planning and Zoning Commission and the City Council of the
City of Grapevine. Notice of such public hearings shall be given as would be required
by law for a zoning change on the Property. The City Manager, or designee, through
authorization by majority vote of the City Council of the City of Grapevine, Texas, and
Mockingbird Development, Ltd., by Beverly Development Corp., General Partner
successors or assigns, must sign a document to be filed in the Deed of Records of
Tarrant County, Texas, approving the amendment or termination of this Declaration
of Covenant and Deed Restrictions.

evening, May 13, 1996, at 6:00 P.M. in the Council Chambers, Room #205, 307
West Dallas Road, Grapevine, Texas, with the following members present to wit:

The first item for the Board of Zoning Adjustment to consider was BZA96-18
submitted by Trisha Wood, representing GRACE, who requested a variance for the
west portion of Block 3, Grapevine Service Center Addition, addressed as 604 Shady
Brook Drive. The request was to the Grapevine Comprehensive Zoning Ordinance 82-
73, as follows:
Section 54 Masonry Requirements which requires all structures in the Governmental
Use District to have at least seventy (70) percent of the total exterior walls
constructed of masonry.
The special exception request is to allow a one hundred (100) percent reduction of
the exterior masonry requirement. If approved, it would allow a structure to be
moved onto the site with no exterior masonry.
Scott Williams stated that Staff recommends approval and finds that a special
condition does exist for the request. He explained the structure has historic value

that Staff feels would be compromised by the addition of a masonry exterior. As this
building was originally designed without masonry veneer, the energy and expense of
adding masonry would preclude its utilization, resulting in its demolition, and the loss
of a resource.
Three responses were received, one for the request and two against.
Mr. Williams noted that City Council approved the Move -In Building Permit on May
7, 1996, pending the variance.
With no other guests to speak, Carl Hecht moved to close the public hearing. Ery
Meyer seconded the motion which prevailed by the following vote:

Scott Williams noted that this building will be used as a retail thrift shop. A building
permit will be obtained and it will be inspected and issued a Certificate of Occupancy.
Carl Hecht made a motion that a special condition did exist and being the structure
is of historic value and is being moved to the GRACE facility. The existing structure
would be compromised by the addition of a masonry exterior. The location of the
structure will not be visible from the street and barely visible from adjacent properties.

The next item for the Board of Zoning Adjustment to consider was BZA96-13,
submitted by MasterPlan who is requesting the following variances and special
exceptions to the Grapevine Comprehensive Zoning Ordinance 82-73 for proposed Lot
1, Block 1, Bear Creek Park Addition, 3230 South State Highway 360:
Section 15.F.2., "R-7.5", Single Family District Regulations which requires a minimum
lot size of 7,500 square feet. The proposed variance would allow a 5,000 square
foot reduction of the minimum lot size.
Section 15.G.1., "R-7.5", Single Family District Regulations which requires a minimum
front yard setback of 30 feet. The proposed variance would allow a 14 foot
encroachment into the required front yard setback.
Section 15.G.2., "R-7.5", Single Family District Regulations which requires a minimum
rear yard setback of 25 feet. The proposed variance would allow a 2 foot
encroachment into the required rear yard setback.
Section 15.G.4., "R-7.5", Single Family District Regulations which requires a minimum
lot width of 65 feet. The proposed variance would allow a 15 foot reduction of the
minimum lot width
Section 15.G.5., "R-7.5", Single Family District Regulations which requires a minimum
lot depth of 100 feet. The proposed variance would allow a 50 foot reduction of the
minimum lot depth.
Section 38J., Governmental Use requires landscaping in accordance with Section 53,
Landscaping Regulations. The proposed special exception would exempt the lot from
landscaping requirements of Section 53, Landscaping Regulations.
Marcy Ratcliff stated Staff found a special condition for the request because the
proposed location of the antenna is on top of an existing TU Electric tower in a TU
Electric easement within a City of Grapevine Public Park. Park land is considered
open space. Only the tower area is being platted and needs variances because it
does not meet the minimum lot requirements. This is scheduled to go before the
Planning and Zoning Commission and City Council on Tuesday, May 21, 1996 to
consider a Special Use Permit to allow an antenna on top of an existing structure.

William Cothrum (500 South Ervay Building, Dallas, Texas), representing Primeco
Communication Service, explained his case to the Board.
There was no one else to speak for or against the request and there was no written
correspondence.
Randy Howell questioned Mr. Cothrum on the height of the extension.
Mr. Cothrum replied that the height of the extension will be 6 Y2 feet and 10 to 12
feet in a triangular area. Mr. Cothrum further explained that an 8'x 8' prewired
cabinet would be located at the base of the tower and would locked at all times.
With no further discussion, Carl Hecht made a motion to close the public hearing.

an application for a Special Use Permit to the City Council and the Planning and
