Re: Application for a Variance and a Special Exception
Dear Board of Zoning Adjustment Members:
I have been working hard to bring an interesting and attractive business to what is
currently an unattractive warehouse. My plan includes the retail, instruction and creation
of art glass. Our works and the works of other artists will be featured in a retail gallery on
site. Workshops will be held for those interested in learning glassblowing or special
aspects of it.
The location is the former Foust Funeral Home warehouse at 334 S. Barton Street
between Texas and Worth streets. This property is zoned Central Business District and is
a very suitable location for my purposes. As its lot depth is nine feet short of the seventy
feet minimum lot depth for the plat approval, I am requesting a variance of this
requirement. On this section of Barton Street, the property lines were undoubtedly drawn
at sixty feet prior to the seventy foot restriction for the Central Business District.
The building is also very suitable with some minor changes. I am requesting a
special exception to "remodel an existing non -conforming metal building". I want to
install two doors and three windows in Phase I.
In Phase H, we will install a store front in the south room and move the retail to
this larger space. Two more windows and a door will be installed. All changes will
enhance this structures appearance and will be approved by the Historical Preservation
Committee.
I am requesting a waiver to Section 47.E.2 requirements because full
compliance would be unreasonably burdensome and the proposed retail/craft store will not
have a substantial impact on adjacent and surrounding areas.
This is a great opportunity to build another attraction to the Main Street area and
convert an unsightly storage building into an interesting, attractive business. Glassblowing
is a life-long passion with me and I look forward to bringing this greatly appreciated art
form to the Grapevine public.

Dear members of the Board,
My wife and I wish to relay our appreciation for allowing us to re submit our request for variance. I feel
that an explanation is due for our absence from the last meeting.
When we filed our application, we neglected to ask when the meeting would be held. We then called the
City to inquire of the date, time and location. Apparently we were misdirected because we were told that
the meeting would be held on Wednesday June 26 at the Wallace Hotel. I was out of town that week and
therefore my wife attended the meeting. She has never applied for a variance before and had no way of
knowing what to expect at this meeting. As we all know now, this was the Historical Preservation
Committee meeting. They assumed that my wife was seeking their support for our request and proceeded
to discuss the matter. When I returned from my trip and inquired as to the result of the meeting, Valerie,
understandably, was unsure of the outcome of the meeting. I therefore called Marcy Ratcliff to inquire as
to the outcome. She informed me that we had missed the meeting and that our variance request had been
denied. Obviously this response confused me as I was sure that my wife had attended "some" meeting.
After we sorted out what had happened, we learned that the City sent out a package to inform us of the
meeting time and place - however, we never received the package.
We have spent a great deal of time and money to build a home that is pleasing to the Historical
Preservation Committee, and welcomed by the people of Grapevine. I hope it is apparent that we take this
very seriously and that we would not intentionally waste the Board's time by not showing up for the
meeting. Once again, thank you for the opportunity to be heard and we look forward to the meeting.

Drusilla Galbreath who requested a special exception and variances for proposed Lot
1, Block 1, Galbreath Addition, addressed as 1618 North Gravel Circle. The request
was to the Grapevine Comprehensive Zoning Ordinance 82-73, as follows:
Section 13.G.1., "R-20" Single Family District Regulations require a forty (40) foot
front yard setback.
The proposed variance would allow a twenty-one (21) foot reduction from the
required forty (40) foot front yard setback. If approved, it would allow a nineteen
(19) foot front yard setback as shown on the plot plan.
Section 13.G.2., "R-20" Single Family District Regulations require a twenty-five (25)
foot rear yard setback.
The proposed variance would allow a three (3) foot reduction from the required
twenty-five (25) foot rear yard setback. If approved, it would allow a twenty-two

(22) rear yard setback as shown on the plot plan.
Section 13.G.5., "R-20" Single Family District Regulations require a lot depth of one -
hundred (100) feet.
The proposed variance would allow a twenty-two (22) foot reduction from the
required one -hundred (100) foot lot depth. If approved, it would allow a lot depth of
seventy -eighty (78) feet as shown on the plot plan.
Section 13.G.7., "R-20" Single Family District require only one single-family detached
dwelling shall be permitted on each lot.
The proposed special exception would allow two (2) existing dwellings to remain on
the lot. If approved, it would allow two (2) structures to remain on the lot on a
temporary basis.
Mrs. Ratcliff explained Staff found a special condition for the request being the house
was built prior to annexation into Grapevine City Limits. No inspections are required
in the county. The depth of the lot cannot be increased due to existing development.
Mrs. Ratcliff added the applicant is proposing to purchase a tract of land adjacent to
the east side of their current property. The tract of land has an existing principal
structure the applicant has promised to remove. The applicant cannot remove the
additional principal structure until they close on the property. The property cannot
be closed upon until it is platted. It cannot be platted until variances are approved.
Druisilla Galbreath (1618 North Gravel Circle, Grapevine, Texas) was present to speak
on behalf of the request. She reassured the Board that the structure to the West
would be demolished.
One letter of approved was received.
Randy Howell moved to close the public hearing. Jill Davis seconded the motion
which prevailed by the following vote:

After a brief discussion, Carl Hecht moved a special condition does exists for the

Brodsky representing Gateway Center Associates who requested a special exception
and variances for 3300 Grapevine Mills Parkway, legally described by metes and
bounds. The request was to the Grapevine Comprehensive Zoning Ordinance 82-73,
as follows:
Section 53.H.2.A., Landscaping Requirements require that whenever an off-street
parking or vehicular use area abuts a public right-of-way, except a public alley, a
perimeter landscape area of at least fifteen (15) feet in depth shall be maintained
between the abutting right-of-way and the off-street parking or vehicular use area.
The proposed variance is to allow a five (5) foot reduction in the required fifteen (15)
foot perimeter landscape area. If the Board of Zoning Adjustment approves the
request, it would allow a ten (10) foot perimeter landscape area as shown on the site
plan.
Section 53.H.2.C., Landscaping Requirements require the perimeter landscape areas
to contain at least one (1) tree for each fifty (50) lineal feet or fraction thereof of
perimeter area.

The proposed variance is to allow the elimination of required trees in the required
landscape areas of the fuel line easement. If approved, it would allow only grass to
be placed in the fuel line easement as shown on the site plan.
Section 60., Sign Standards require any functional type sign a minimum ten (10) foot
setback.
The proposed special exception is to allow any functional type sign a five (5) foot
encroachment into the required ten (10) foot setback. If approved, it would allow any
functional type signs to have a minimum five (5) foot setback as shown on the site
plan.
Mrs. Ratcliff explained Staff found a special condition for the request because of the
relocation of the fuel line easement. The fifty (50) foot width of the fuel line
easement creates physical hardship for the signage and for the planting landscaping
other than grass because no structures, trees or shrubs are allowed in the easement.
Signs setback from fifty (50) to sixty (60) feet of the property line would not be
visible. The relocation of the fuel line along the major thoroughfare creates visibility
problems for signage and a reduced amount of landscaping materials but creates a
lot that is developable. The fuel line easement was formerly down the middle of the
lot. The fuel line is being realigned with the Grapevine Mills Mall Development. She
also noted a proposed amendment will be going before City Council regarding sign
height. The applicant was present to answer question relative to the request.
Fred Brodsky (5223 Royal Lane, Dallas, Texas) explained due the Mill's restrictions,
they will not compete with the Mall for two years after the grand -opening. They
currently have agreements with the Mills to put signs on their land.
Randy Howell noted that the signs would have to be placed sixty (60) feet off the
property line if the variance was not granted.
Jill Davis moved to close the public hearing. Carl Hecht seconded the motion which
prevailed by the following vote:

regular member of the Planning and Zoning Commission.

Ordinance #94-09 mflects deed restrictions that were proferred by the developer
and accepted by the City which deed restrictions established minimum lot sizes and a
requirement that all garages shall be faced perpendicular to Lhe front lot line. The deed
restrictions cannot be altered, ame-nded or terminated without a public hearing and a
recommendation from the Planning and Zoning Commission and a decision by the. City
Council- This is the. procedure for a change in zoaing.
The deed restrictions are treated identicaUy to all- other requirements in the
applicable zoning district land use category.
Due Lu an odd configuration of one of the lots, lot 6, block A, the owner applied for
a variance to the garage door opening requirement. The zoning board of adjustments
approved the application. In approving the application, the Board requested a legal
opinion verifying that the Board had the authority and j arisdiction to approve the request.
It is my opinion, that the deed restrictions aye incorporated into the body of the
zoning ordinance and are treated identically to all other restrictions in the zoning cat&gory
and therefore any request for a variance to the deed restrictions may be accepted and
considered by the zoning board of adjustments Just like a request for a variance frorn a
requirement in the basic zoning ordinance.
The applicant contilles to have the bt�rdea to prove wrinecess,-UT hardship caused
by the zoning ordinance and the City may object to the, case before the Board and may, if
deemed necessary, appeal any adverse decision W the District Court.

evening, September 9, 1996, at 6:00 P.M. in the Council Chambers, Room #205,
307 West Dallas Road, Grapevine, Texas, with the following members present to wit:

Teresa Wallace administered the Oath of Office to Russell Anderson to serve as 1st
Alternate of the Board of Zoning Adjustment.
Former Chairman of the Board of Zoning Adjustment, Chris Coy, was presented a
plaque from Chairman Randy Howell for his years of service to the Board of Zoning
Adjustment. Mr. Coy is now a member of the Planning and Zoning Commission.
The first item for the Board of Zoning Adjustment to consider was BZA96-29
submitted by Eric Hansen who requested a variance and special exception for
proposed Lot 9R, Block 2, Original Town of Grapevine Addition and addressed as 334
South Barton Street. The variance and special exception from the Grapevine

Comprehensive Zoning Ordinance 82-73 are as follows:
Section 28.G.2., Central Business District requires a minimum lot depth of seventy-
five (75) feet.
The proposed variance would allow a reduction of fourteen (14) feet from the
required seventy-five (75) foot lot depth requirement. If approved, it would allow a
minimum sixty-one (61) foot lot depth as shown on the site plan and proposed plat.
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling or enlargement of an existing nonconforming
use.
The proposed special exception would allow the applicant to remodel the exterior of
the existing nonconforming 100% metal building. If approved, it would allow the
existing metal building and any proposed remodeling to remain as developed.
Marcy Ratcliff, City Planner, explained that Staff found a special condition existed for
the proposed variance to the lot depth. The special condition was that the lot cannot
be expanded to meet the depth requirement because of the development of the DFW
Church of Christ at the rear of the property and the rear property line is the zoning
line separating the Townhouse and Central Business District. Mrs. Ratcliff explained
that Staff also found that a special condition existed for the proposed special
exception to allow the existing building to remain as developed. The existing metal
building was built around 1930 or earlier by Foust Funeral Home to be used for
storage purposes and therefore, because of its age, had historical significance. Also,
the property is located across the street from the Main Street Historic Landmark
District. Mrs. Ratcliff indicated that Staff and the Historic Preservation Commission
were interested in helping the owner/applicant maintain the building's historical
appearance as much as possible. Mrs. Ratcliff noted that the first reading of Mr.
Hansen's Conditional Use Request CU96-18 was approved August 20, 1996 by the
City Council pending the outcome of the Board of Zoning Adjustment's decision. The
second reading of the Ordinance will be heard on September 17, 1996.
Mr. Hansen was present to answer any questions.
There being no one else to speak either for or against the request, Carl Hecht made

Section 58.8., Parking and Loading Area Standards require all off-street parking areas
and driveways to be paved to a minimum standard equivalent to four (4) inches
concrete slab with six (6) inches by six (6) inches by six (6) gauge mesh or two (2)

The proposed variance would allow the deletion of paving for a driveway
approximately 169 feet long. If approved, it would allow a gravel drive to be installed
to serve as vehicular access from College Street as shown on the plot plan.
Scott Williams, Building Official, explained to the Board that Staff found a special
condition for the request in that the applicant was attempting to replicate a
historically correct architectural environment. The use of gravel for the driveway,
therefore, would be appropriate in this situation. Mr. Williams added the plans for the
house were reviewed and approved by the Grapevine Historic Preservation
Commission. Also a letter from P.W. McCallum, Acting Historic Preservation Officer,
was included in their packet concerning the Preservation Commission's
recommendation of approval for the request.
Mr. Williams, stated that Staff had received one letter for and one letter against the
request.
Julian Head, applicant, 3845 Misty Glen Court, Bedford, Texas, took the Oath of
Truth and explained that a gravel driveway look was much more representative of the
time period that they were trying to capture. Mr. Head explained that there were
several old trees along the driveway that would probably die if they had to put in
forms for the driveway. Also there were two driveway runners that went with the
house that was there years ago. If a concrete drive was put in, the concrete pads
would have to be removed which would be a detriment to the historic value. He
explained that the runners would contain the gravel, as well as the driveway approach

which is concrete. The gravel drive would be at least 10 feet from the neighbors
property line and would not be encroaching upon their property.
Councilman Roy Stewart of 309 Drexel Drive, Grapevine, Texas, took the Oath of
Truth and explained that he owned the building across the street from the property
and said he was in favor of the request.
Member Ery Meyer asked if the Historic Preservation Commission would have to
approve on the type of gravel that could be used.
Mr. Williams explained that the Board could grant the request with the stipulation that
the Acting Historic Preservation Officer approve the gravel to be used.
Mrs. Ratcliff noted that she had spoken with Mr. Ron Tilllery, a property owner within
200 feet, that had sent in a response of opposition to the request. Mrs. Ratcliff
indicated that Mr. Tillery was no longer in opposition after learning about what type
and size of gravel the Historic Preservation Commission recommended.
With no one else to speak either for or against the request, Ery Meyer made a motion
to close the public hearing. Jill Davis seconded the motion which prevailed by the
following vote:
