The Board of Zoning Adjustment for the City of Grapevine net in a special
workshop session on Monday, February 18, 1985 at 7:00 P.M. in room 204, the
conference room of the Police-Library Building, 307 West Dallas Road,
Grapevine, Texas with the following persons present to wit:

The following guests and spectators were present at this special workshop
session of the Board of Zoning Adjustment Meeting:

Chairman Lamb called the meeting to order and stated that after all
business was completed, that anyone present who wished to speak with regard
to vested rights could do so at that time.
The area of discussion was regarding Vested Rights. Mr. Marlin Smith
referred to Section 69 of the City of Grapevine's Zoning Ordinance, and
explained that it was essentially designed to deal with problems originally
anticipated, and that never happened. The idea was prompted by litigation
that had taken place in the Spalding Lawsuit. It was felt that extensive
down zoning might produce a rash of lawsuits such as Spalding. Section 69
was designed to deal with this, and as designed to provide an outlet at
local level. It gives the City the right to know regarding vested rights.
Refer to Section C for standards that are to be applied. These standards are
very explicit on the subject. Section E with regard to Moratorium
Ordinance provides for a factual determination on a case by case basis.
Relating to any current and future vested rights cases, Mr. Smith asked if
the board has a set of formal rules. To this Chairman Laub answered that
as far as written procedural circumstances - NO. Chairman Lamb further
stated that he would like to do a set of rules at the March 7, 1985
meeting. Rules or by-laws should specifically address officers, how and
when they became officers and for how long. These rules should also
address when, why and where meetings are held, and should most probably
include an order of business heard by the Board of Zoning Adjustment. At
this point in the meting, Chairman Lamb, in answer to a question, stated
that all regular Board of Zoning Adjustment meetings are held on Thursday.
Chairman Lamb further stated that he believed that there was an old set of
procedural rules, and that he hoped to find resolution adopting them. The
procedural rules, whether adopted in the past or newly revised or rewritten
at the March 7, 1985 will be made available to applicants prior to their
hearings.
Mr. Marlin Smith went on to further state that with regard to Vested Rights
cases, that prior to any hearings, he would suggest that a list of
witnesses be provided, with a short two (2) or three (3) line statement
from these witnesses on what they would be adding to the hearing. He
