However, any member of the Board of Zoning Adjustment or member of the audience may request that an item be placed before the Board for full discussion. A. OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 25TH DAY OF APRIL, 1986, AT 5:00 P.M. STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular session May 1, 1986, at 413 Main Street, in the Council Chambers, Grapevine, Texas with the following members present to wit: Doug Lamb Chairman Bill Waldrip Vice-Chairman Ron Troy Secretary Gerald Thompson Member Garry Tischler Member constituting a quorum, with 2nd alternate, John Ferguson absent, and Council Representative Ted Ware and the following City Staff present to wit: H. T. (Tommy) Hardy Jim VanTreese Joy Carroll Marcy Ratcliff Adrienne Leonard Gerrie Taylor CALL TO ORDER Director of Community Development Assistant Building Official Administrative Assistant Planning Technician Attorney, City Attorney ®s Office Secretary Chairman Lamb called the meeting to order at 6:05 P.M. SPECIAL PRESENTATION Councilman Ted Ware presented Chairman Doug outstanding service of six years serving Adjustment. Chairman Lamb turned in his meeting. NEW BUSINESS BZA 86-32 and BZA 86-33, Braewood Homes Lamb with a plaque for his on the Board of Zoning resignation at the March The first item of new business was for the Board of Zoning Adjustment to consider BZA 86-32 and BZA 86-33, Braewood Homes who is requesting an exception to Section 16.J, "R-5.0", zero lot line district regulations for the purpose of using the structure as a model home temporarily. With no one for or against the request, Gerald Thompson made a motion to close the Public Hearing. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson There being no discussion among Board Members, Garry Tischler made a motion to approve both BZA 86-32 and BZA 86-33. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson BZA 86-26, Foster/Wood The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-26, submitted by John Foster and Keith Wood who is requesting variances to the buffer requirements, off-street parking and perimeter and front landscaping requirements for a two story residence located at 223 E. College Street. Tommy Hardy explained that this case needs to be tabled to the next regular scheduled meeting, June 5, 1986, because a zoning case is also filed and variances cannot be considered until a decision is made on the zoning by the Planning and Zoning Commission. Ron Troy made a motion to table the case until the June 5, 1986 meeting. Bill Waldrip seconded the motion which prevailed by the following vote: Board of Zoning Adjustment May 1, 1986 Page Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson BZA 86-27, Nash /Phillips /Copes The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-27, Nash /Phillips /Copes who is requesting an exception to ordinance 83-80, relative to Dove Crossing Subdivision Site Plan requirements for a twenty (20') foot front setback for an existing structure at 1416 Thistlewood Lane, legally described as Lot 9, Block 5, of Dove Crossing Subdivision. Dan DaCosta with Nash/Phillips/Copus took The Oath of Truth and explained the two (2") inch encroachment. With no one either for or against the request, Garry Tischler made a motion to close the Public Hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson After further discussion from the members, Garry Tischler made a motion to grant the variance as requested. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson BZA 86-28, Pace The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-28, submitted by Charles and Debra Pace, who'are requesting a one (1') foot rear yard variance to Grapevine Zoning Ordinance 82-73, Section 15.G.2. relative to "R-7.51, Single Family District Regulations, rear yard setbacks for an existing structure at 2846 Southridge Drive, legally described as Lot 8, Block 13, Oak Creek Estates for an addition to build a second story onto an existing nine year old house. Charles Pace, took The Oath of Truth, and stated that after seven and one half years discovered the house was encroaching into the rear yard one (1') foot. With no one else either for or against the request, Ron Troy made a motion to close the Public Hearing. Bill Waldrip seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson After further discussion, Gerald Thompson made a motion to grant the variance according to the submitted plat. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson BZA 86-29, Bassichis The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-29, Bassichis, who was asking for exceptions to Grapevine Zoning ordinance 82-73, Section 15.6.1, 2, 3, & 5 related to front, side and rear yard lot depth requirements at 2432 Lakeshore Drive, legally described as Lot 4, Section 3, of the Grapevine Lake Estates. Elliott Bassichis took The Oath of Truth and stated there was not adequate buildable area to erect an A-Frame. With no further discussion from the public, Gerald Thompson made a motion to close the Public Hearing. Garry Tischler seconded the motion which prevailed by the following vote: Board of Zoning Adjustment May 1, 1986 Page Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson Tommy Hardy stated that the depth of the lot is the problem due to a City required right-of-way dedication. The lot does not meet the City's present lot depth requirements. Without further discussion, Bill Waldrip made a motion to grant the variance as requested. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson BZA 86-30, Ronnie Gragg BZA 86-36, Huffman The next two items of new business was for the Board of Zoning Adjustment to consider BZA 86-30, Gragg, and BZA 86-36, Huffman, who are asking for variances to Grapevine Comprehensive Zoning Ordinance 82-73, Section 26.D.2.(a) which requires that all property zoned "HC", Highway Commercial, shall have driveway access and frontage only from a State Highway. Tommy Hardy stated that Ronnie Gragg has no highway frontage, so he must have access from Central Avenue. Dave Huffman is wanting to acquire a twenty-five (25') foot approach off of Dooley to be used as a secondary entrance or exit at the northwest corner of Dooley Street and Wall Street. Ted Ware took The Oath of Truth and spoke in regards to Huffman's case about the secondary driveway on Dooley Street being approved by City Council, because they saw value for circulation of traffic for boats and trailers. With no one else either for or against the request, Gerald Thompson made a motion to close the Public Hearing. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson After further discussion, Gerald Thompson made a motion to grant BZA 86-30 as requested. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson Ron Troy made a motion to grant BZA 86-36 as requested as the revised site plan indicates. Bill Waldrip seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson BZA 86-31, Stanford Homes The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-31, Stanford Homes who is requesting a one (11) foot variance to the thirty (30') foot front yard setback requirements of Section 15.G.1 of Grapevine Zoning Ordinance 82-73 at 4506 Amesbury, legally described as Lot 11, Block 9, Glade Crossing 1-B Subdivision. Rusty Wells, with Stanford Homes, took The Oath of Truth and stated that the mistake was discovered after the residence was occupied and a final survey was received from the title company. With no one else either for or against the request, Bill Waldrip made a motion to close the Public Hearing. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson Board of Zoning Adjustment May 1, 1986 Page After further discussion among members, Garry Tischler made a motion to grant the variance as requested. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson BZA 86-34, Chasewood BZA 86-35, Chasewood The last item of new business was for the Board of Zoning Adjustment to consider BZA 86-34, 2100 Grayson Drive; and BZA 86-35, 2300 Grayson Drive, submitted by Chasewood Construction Company who is requesting an exception to Grapevine Zoning Ordinance 82-73, Section 22.H, screening requirements for a tract of land with 200 apartment units complete and another 200 units which are under construction. Chasewood is required to erect a screening fence to separate the multi-family development and the single family development that is under construction on the west side of the creek. Tom Michaels, of 2017 Sante Fe Trail, Grapevine, and Vice-President of the Chasewood Construction Company stated that at the time of platting, screening was not required and does not feel they should have to provide screening because the creek and trees provides enough buffer area. With no one else either for or against the request, Gerald Thompson made a motion to close the Public Hearing. Garry Tischler seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson After further discussion from Mr. Michaels and the members Gerald Thompson made a motion to table the meeting until the June 5, 1986 meeting to get transcripts from the previous meetings concerning this case. Ron Troy seconded the motion which prevailed by the following vote: Ayes: Lamb, Waldrip, Troy, Thompson, Tischler Nays: None Absent: Ferguson MISCELLANEOUS REPORTS AND/OR DISCUSSIONS Tommy Hardy announced that Kay Gilliam turned in her resignation from the Board. Because of arising questions concerning the handling of model home variances, Mr. Hardy will be working with the City Attorney on better ways of handling these cases. Also a special meeting was set up for Mr. Moran for May 22, 1986 concerning a masonry request for property in the Industrial Park Addition. With no further discussion, Garry Tischler made a motion to adjourn the meeting.
