The Board of Zoning Adjustment for the City of Grapevine, Texas, met in
regular session November 13, 1986, at 413 Main Street, in the Council
Chambers, Grapevine, Texas, with the following members present to wit:

constituting a quorum with City Council Representative, Ted Ware, present
and the following City Staff was present to wit:

Chairman Bill Waldrip called the meeting to order at 6:10 P.M.
Ron Troy made a motion to allow Mr. Tom Michaels with Chasewood
Construction Company, and Mr. Jams Lewis to withdraw their variance
requests (BZA 86-34, & 35, and BZA 86-73). Garry Tischler seconded the
motion which prevailed by the following vote:
Ayes: Waldrip, Thompson, Troy, Tischler, Bigbie
Nays: None
Absent: None
The first item of old business was for the Board of Zoning Adjustment to
consider BZA 86-66, submitted by Whataburger. This case was tabled at the
last meting because of notification problems. Staff recommended denial at
the last meeting because the variances were excessive. The applicant since
then has resubmitted a site plan which Staff feels the applicant has made a
good effort to meet all requirements. Staff recommends approval.
Bob Drury, of 2019 Stampede, #1610, Arlington, Texas, took the oath of
Truth and stated that they were able to meet all requirements except the
landscaping for the east and north sides of the property and for landscape
islands.
Wilbur Goltz, of 821 Twilight Trail, Grapevine, and owner of Southwest
Marine, took the Oath of Truth and spoke for approval of the request.
Joy Carroll read a letter of approval of the request from Dennis Roberts,
of Dennis Electric.
With no one else to speak either for or against the request, Gerald
Thompson made a motion to close the Public Hearing. Ron Troy seconded the
motion which prevailed by the following vote:
Ayes: Waldrip, Thompson, Troy, Tischler, Bigbie
Nays: None
Absent: None
There was discussion on leaving one landscape island on the east side,
which would reduce one parking space.

After further discussion, Gerald Thompson made a motion to grant the
variance as requested. Garry Tischler seconded the motion, which prevailed
by the following vote:

The first item
of new
business was for the Board of
Zoning Adjustment to
consider BZA 86-74, James L. Johnson, who is proposing to redevelop a piece
of property on
Ira E.
Woods, William D. Tate, and
Bellaire Drive. The
variances Mr. Johnson
is asking for are to the rear
yard, Section 25.G.5,
and exception
to the
landscaping in the required
front yard, Section
25.G.3. Ton-my
Hardy stated
that Staff feels what is
being gained from the
property as far
as the
redevelor-ment would be better off with the variances.
Bill Deacon, of 3700 Rose Briar, Colleyville, Texas, and Real Estate Broker
for the applicant, took the oath of Truth, and stated that the site had
formally been a Chevrolet dealership. Mr. Deacon also stated that the area
was a prime location which would enhance the area.
Tommy Hardy stated that for the record, this case will be before the City
Council and the Planning and Zoning Commission next Tuesday night for
consideration of the Conditional Use application which is required for a
car dealership in a "CC", Community Ccmmercial district.
James L. Johnson, Sr., of 378 Highland Lane, Highland Village, Texas, took
the Oath of Truth and explained that in order to comply, and because of the
locations of existing buildings, some adjustment to the property had to be
made which still provides for adequate parking and traffic flow through
the property and that is why there is a shortness of landscaping on William
D. Tate Ave. and Dallas Road.
Ted Ware, City council Representative, took the oath of Truth and stated
that Council was aware of this case and there was no opposition.
With no one else to speak either for or against this request, Garry
Tischler made a motion to close the Public Hearing. Gerald Thompson
seconded the motion which prevailed by the following vote:
Ayes: Waldrip, Thcmpson, Troy, Tischler, Bigbie
Nays: None
Absent: None
There was further discussion from Mr. Johnson about the existing buildings
being remodeled and about fencing and landscaping along the back side of
the property.
A motion was made by Garry Tischler to grant the variances as requested.
Don Bigbie seconded the motion which prevailed by the following vote:
Ayes: Waldrip, Thcmpson, Troy, Tischler, Bigbie

BZA 86-75, C. A. INTERNATI21EL, INC.
The last item of new business was for the Board Of Zoning Adjustment to
consider BZA 86-73, submitted by C. A. International, Inc.
Jim Baddaker, City Engineer, stated that this case was before the Board
because of action by the City. The variances that are being requested for
the southeast corner of Minters Chapel and Dallas Road are to allow for
additional right-of-way for Dallas Road. In 1983, the City asked for an
additional ten (10') foot of right-of-way on Dallas which gives seventy
(70') feet of right-of-way which the City anticipates a four-lane
facility. Mr. Baddaker also stated that nine months ago, a concept plan
was prepared to go to Council and the State Highway Department to reroute

Highway 26 traffic from downtown to Dallas Road. During that time period,
the applicant prepared plans for an office/warehouse which met all City
requirements under the old ordinance. Since then, the zoning ordinance was
updated and Mr. Martinez needs the following variances to comply: 1) .
Variance 31.G.4 relative to the fifteen (15') foot sideyard requirement of
Light Industrial Zoning District; 2). Variance to Section 31.F., Light
Industrial Zoning District requirement for 85% maximum impervious area;
3). Variance to Section 53.H.2.a relative to the fifteen (15') foot
sideyard requirement; 4). Variance to Section 53.H.2.b relative to
perimeter landscape requirement when parking area abuts property line;
5). Variance to Section 53.H.2.a. relative to the required perimeter
landscape when parking area abuts a public right-of-way; 6). Variance to
Section 53 relative to landscape percentage requirements; 7). Variance to
Section 56.0 relative to off-street parking requirements for
office-warehouse.
Tommy Hardy stated that Staff recommends approval due to the difficulty in
redevelopment of the tract and since the tract was developed under the old
ordinance requirements which were less restrictive.
Charles Martinez, of 2904 Cresthaven Drive, Grape
of Truth and stated that the property was

John Sanford, of 5645 Brynmar, Dallas, Texas, representing Trinity
Industries, who is adjacent property owners, took the Oath of Truth. Mr.
Sanford stated that he was not there in opposition, but wanted to know what
is proposed for the property.
Ted Ware, City Council Representative, stated that there was no opposition
from the City Council on the case.
With no one else to speak either for or against the request, Ron Troy made
a motion to close the Public Hearing. Gerald Thompson seconded the motion
which prevailed by the following vote:

Tommy Hardy stated to the Board that when Mr. Martinez submitted his site
plan, it met all requirements and that is when it was found out there was a
need for additional right-of-way. There was discussion on the other
buildings along Dallas Road that will be affected by the additional
right-of-way.
After further discussion, Ron Troy made a motion to grant the variances as
requested, numbers one thru seven, and supported by the attached site
plan. Garry Tischler seconded the motion which prevailed by the following
vote:
Ayes: Waldrip, Thompson, Troy, Tischler, Bigbie
Nays: None
Absent: None
Tommy Hardy stated to the Board Members that Board of Zoning Adjustment
meetings will start being held at 307 West Dallas Road, Rom #205, on
Monday nights. There was also discussion on the new Board of Zoning
Adjustment application.

meeting. Don Bigbie made a motion to accept the minutes as written. Garry
Tischler seconded the motion, which prevailed by the following vote:
