Next for the Commission to consider and make recommendation to the City Council was an amendment to the Grapevine Code of Ordinances, Chapter 19, Planning, Article 11. Planning and Zoning Commission, Division 2. Bylaws, Section 19-35. Meetings., (b) Regular Meetings., relative to the number of zoning cases scheduled before the Planning and Zoning Commission per meeting, and take any other action necessa The Bylaws for the Planning and Zoning Commission currently limit the number of cases to be heard in public hearing to no more than six cases. The Bylaws allow for an additional public hearing if an unusually large number of zoning cases has been submitted. Staff has received on average over the last year 10.5 cases per submittal date. This large caseload coupled with ordinance amendments, and tabled items creates, even with the additional public hearing on the first Tuesday of each month, a backlog of cases that must be scheduled for public hearing. In an effort to clear the case backlog and move the Commission back towards one public hearing per calendar month, staff recommends increasing the number of cases that can be heard in public hearing from six cases to eight cases. The following change to the Grapevine Code or Ordinances is recommended: (b) Regular meetings. Regular meetings shall be held on the third Tuesday of each month in the council chambers of the city hall, unless otherwise determined by the commission. It is the intent of the commission to consider no more than six (6) eight (8) zoning cases per meeting. If an unusually large number of zoning cases should occur, the commission may schedule an additional meeting concurrently with the city council. Ware delivered the Invocation. PUBLIC HEARING CU99 -14 — SAVEY -1 First for the Commission to consider and make a recommendation to the City Council was Conditional Use Request CU99 -14 submitted by Abel Lopez, Jr. for property located at 2713 Mustang Drive. The applicant was requesting a conditional use permit to amend the 070699 P & Z JOINT PUBLIC HEARING JULY 6, 1999 approved floor plan and site plan of CU90-18 (Ord. 90-78) for the sale, storage and on- premise consumption of alcoholic beverages (beer, wine and mixed beverages) in conjunction with a restaurant and a 20-foot pole sign, specifically for the addition of a deli counter and on-site gasoline sales in conjunction with a convenience store and a 10-ft. monument sign. Mr. Edward Gutierrez, representing the applicant, requested favorable consideration of the application stating that the site did have previous gasoline sales, which was interrupted about one year ago. If approved, the site will meet all city and state requirements. Discussion was held regarding the general appearance of the site and the possibility of the elimination of the northern most drive on Tanglewood Drive. Mr. H. Y. Yee, property owner, answered questions from the City Council regarding the general appearance of the property. The following citizens spoke in opposition of the development stating concerns with traffic, and general appearance of the site: Jerry Carmody, Ron Clakenbeard and JoAnna Hookstratten. In the Commission's deliberation session, Cathy Martin moved, with a second by Stephen Newby, to table conditional use request CU99-14 to September 21, 1999 or earlier, to give the applicant the opportunity to work out traffic flow, the drive entrances, pump locations and appearance of the site, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin, and Busbee Nays: None CU99-26 — GRAPEVINE /TATS JV Next for the Commission to consider and make a recommendation to the City Council was Conditional Use Request CU99-26 submitted by Lawrence A Cates of Lawrence A Cates and Associates for property located at 1449 State Highway 114 West and platted as Lot 10, Block 1, Towne Center Addition No. 2. The applicant was requesting a conditional use permit to revise the approved site plan of CU99-06 (Ordinance 99-34) for a Planned Commercial Center with a 6,581 square foot restaurant (Mimi's Caf6) with the possession, storage, retail sale, and on-premise consumption of alcoholic beverages (beer, wine, and mixed drinks) along with the development of a 3,238 square foot retail building on Lot 10, specifically to make changes to the building elevations for the retail building. In the Commission's deliberation session, Stephen Newby moved, with a second by Cathy Martin, to approve Conditional Use Request CU99 -26, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin, and Busbee Nays: None CU99 -32 - TEXACO Next for the Commission to consider and make a recommendation to the City Council was Conditional Use Request CU99 -32 submitted by Anwar Dossani for property located at 1221 State Highway 114 East and platted as Lot 1, Block 1, Wallcon Addition. The applicant was requesting a conditional use permit to revise the approved site plan of CU98 -68 (Ordinance 99 -03) for a convenience store with gasoline sales, off - premise consumption of alcoholic beverages (beer and wine only), a 39 -foot pole sign, and a fast food restaurant, specifically to modify the site layout to include the relocation of the car wash, elimination of a drive -thru lane, and the addition of a canopy over the diesel pumps. Mr. Gordon Mayer, representing the applicant, requested favorable consideration of the application. In the Commission's deliberation session, Chris Coy moved, with a second by Kevin Busbee, to approve Conditional Use Request CU99 -32, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin, and Busbee Nays: None CU99 -33 — PARK PLACE LEXUS Next for the Commission to consider and make a recommendation to the City Council was Conditional Use Request CU99 -33 submitted by Ken Schnitzer of Park Place LX Land Company No. 1 for property located at 901 State Highway 114 East and platted as Lot 1, Block 1, Lexus Addition. The applicant was requesting a conditional use permit to revise the approved site plan of CU98 -69 (Ordinance 99 -09) for an automotive dealership with sales and service of new and used vehicles and a 23 -foot pole sign, specifically to increase the size of the principal structure from 37,075 square feet to 42,414 square feet and to establish a two -phase development schedule. The site plan showed a 90 -foot wide drainage channel that cuts through the site from Minters Chapel Road to the west property line of the site south to State Highway 114. After 070699 3 P & Z JOINT PUBLIC HEARING JULY 6, 1999 the widening of Minters Chapel Road is complete (late summer/fall of 2000) and the on- ramp/off-ramp realignment along State Highway 114 is complete (Fall 2002) the drainage channel will no longer be needed. The applicant proposes to develop the automotive dealership in a two-phase process whereby the first phase will leave the drainage channel on the site with construction and operation of the dealership occurring around the channel. Phase two of the project will be completed after the improvements are made to Minters; Chapel Road and State Highway 114. Phase two construction will consist of the filling of the channel and the installation of additional parking and landscaping. In the Commission's deliberation session, Kathy Martinez moved, with a second by Stephen Newby, to approve Conditional Use Request CU99-33 with the condition that the mesquite trees be replaced with trees off the required tree list, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin and Busbee Nays: None SU99-1 0 — AT&T WIRELESS Next for the Commission to consider and make a recommendation to the City Council was Special Use Request SU99-10 submitted by Mike Marr of AT&T Wireless for property located at 2923 Grapevine Mills Boulevard North and platted as Lot 1, Block 1, Cross Creek Ranch Addition. The applicant was requesting a special use permit allow the collocation of a telecommunications antenna array on an existing 125-ft. monopole. Mr. Bill Bowman, representing the applicant, was available for questions from the Planning and Zoning Commission and City Council. In the Commission's deliberation session, Chris Coy moved, with a second by Kevin Busbee, to approve Special Use Request SU99-1 0, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin and Busbee Nays: None 070699 4 P & Z JOINT PUBLIC HEARING JULY 6, 1999 SU99 -11 — SPRINT PCS Next for the Commission to consider and make a recommendation to the City Council was Special Use Request SU99 -11 submitted by Latham Jones of Sprint PCS for property located at 2923 Grapevine Mills Boulevard North and platted as Lot 1, Block 1, Cross Creek Ranch Addition. The applicant was requesting a special use permit to allow the collocation of a telecommunication antenna array on an existing 125 -ft. monopole and the associated equipment platform. Mr. Latham Jones, was available to answer questions from Planning and Zoning Commission and City Council. With no further questions, guests to speak, letters or petitions, the public hearing was closed. In the Commission's deliberation session, Chris Coy moved, with a second by Kevin Busbee, to approve Special Use Request SU99 -11, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin and Busbee Nays: None ZONING ORDINANCE AMENDMENT AM99 -03 SECTION 67 AMENDMENTS Next for the Commission to consider and make recommendation to the City Council was a change to Section 67, Amendments, relative to the establishment of a time limit for the scheduling of a zone change request for public hearing and take any other action necessary. Occasionally staff will receive a zoning application that languishes for months before the applicant decides to complete the application in order for the case to proceed to a public hearing. Staff, in many instances, has had to contact an applicant multiple times to finalize an application. To motivate applicants to submit proposals that are genuine and thoughtfully designed, staff has drafted a proposed amendment to Section 67 establishing a time period of four months from the date of submittal to placement on an agenda for all zoning, conditional use, and special use requests. If an application has not been placed on an agenda within the four month time period, it will be considered withdrawn without prejudice with forfeiture of all filing fees. Section 67. A. 4. Any application for a change in zoning or for an amendment to the zoning ordinance shall have, from the date of submittal, a period of four months to request and be scheduled on an agenda before the Planning and Zoning Commission and City Council. If after said period of four months an application has not been scheduled before the Commission and Council said application shall be considered 070699 5 P & Z JOINT PUBLIC HEARING JULY 6, 1999 withdrawn, with forfeiture of all filing fees. The application, along with the required filing fee may be resubmitted any time thereafter for reconsideration. Delays in scheduling applications before the Planning and Zoning Commission and City. ZONING ORDINANCE NO. 82-73, AS AMENDED, SECTION 13 "R-20" SINGLE FAMILY DISTRICT REGULATIONS: SECTION 14, "R-12.5" SINGLE FAMILY DISTRICT REGULATIONS, SECTION 15 "R-7.5" SINGLE FAMILY DISTRICT REGULATIONS: -SECTION ..16 "R-5.0" ZERO-LOT-LINE DISTRICT REGULATIONS: SECTION 58 PARKING, LOADING AND OUTSIDE STORAGE AREA DEVELOPMENT STANDARDS A public hearing was held regarding proposed amendments to the Grapevine Code of Ordinances, Chapter 23 Traffic relative to prohibiting commercial vehicles, oversized vehicles and trailer parking on City rights-of-way and Appendix D, Comprehensive Zoning Ordinance No. 82-73, as amended, Section 13 "R-20" Single Family District Regulations; Section 14 "R- 12.5" Single Family District Regulations; Section 15 "R-7.5" Single Family District Regulations' SecticO., 16 "R-5.0-" Zero Lot Line District Regulations; Section 58 Parking, Loading andouifi(&Stolage Area Devielopment Standards relative to boats and recreational vehicles parking on City rights -of -ways. The City's zoning ordinance, Ordinance No. 82-73, restricts the parking of recreational vehicles, recreational trailers, motor homes and boats in front yards for a period of 72 house, after which time they are prohibited. In March, 1998, the Council approved an ordinance prohibiting the parking of all vehicles/trailers with three or more axles on all public rights-of-way in the City. It was requested to broaden that ordinance to include all large vehicles and boats. With no further questions, guests to speak, seven letters of opposition, the public hearing was closed. No action was taken. END OF PUBLIC HEARING ELECTION OF OFFICERS Chairman Larry Oliver stated nominations were in order for the office of Chairman and Vice - Chairman of the Planning and Zoning Commission. Kathy Martinez nominated Larry Oliver as Chairman of the Planning and Zoning Commission. With no further nominations, Cathy Martin moved and Chris Coy seconded to approve Larry Oliver as Chairman of the Planning and Zoning Commission, which prevailed by the following vote: Ayes: Fry, Coy, Martinez, Newby, Martin and Busbee Nays: None Abstain: Oliver Chris Coy nominated Herb Fry as Vice - Chairman of the Planning and Zoning Commission.
