BRIEFING SESSION Chairman Oliver announced the Planning and Zoning Commission would conduct a briefing session relative to the following cases: Z99 -03 CU99 -34 CU99 -36 CU99 -41 SU98 -12 SU99 -12 to discuss development issues. (Tommy) Hardy Ron Stombaugh Susan Howard Director of Development Services Planner Planning Secretary Mayor Tate called the joint meeting to order at 7:43 p.m., and Chairman Larry Oliver called the Planning and Zoning Commission deliberation session to order at 8:19 p.m. INVOCATION Commissioner Kevin Busbee delivered the Invocation. First for the Commission to consider and make a recommendation to the City Council was Zone Change Request Z99 -03 submitted by Edward Kellie of Goodwin and Marshall, Inc. for property located at 2401 State Highway 121 North. The applicant was requesting to rezone 11 ,.. P & Z JOINT PUBLIC HEARING J U LY 20, 1999 approximately 20.413 acres and 36.710 acres respectively from "BP" Business Park District to "CC" Community Commercial District for retail and commercial development. Mr. Ron Glover requested favorable consideration of the application. With no further questions, guests to speak, letter or petitions, the public hearing was closed. In the Commission's deliberation session, Chris Coy moved, with a second by Stephen Newby, to approve zone change request Z99-03, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin, and Busbee Nays: None CU99-34 VINEYARD MARKETPLACE L.P. Next for the Commission to consider and make a recommendation to the City Council was Conditional Use Request CU99-34 submitted by Lawrence A Cates of Lawrence A Cates and Associates for property located at 5311 William D. Tate Avenue and platted as Lot 7R, Block 1, Mulberry Square Addition. The applicant was requesting a conditional use permit to amend the approved site plan of CU98-45 (Ordinance 99-25) for a Planned Commercial Center with the possession storage, retail sale, and off-premise consumption of alcoholic beverages (beer and wine only) in conjunction with a grocery store, specifically to allow the development of a 10,000 square foot retail building on lot 7R. Mr. Raymond Poche, requested favorable consideration of the application. With no further questions, guests to speak, letters or petitions, the public hearing was closed. In the Commission's deliberation session, Kathy Martinez moved, with a second by Cathy Martin, to approve Conditional Use Request CU99-34, which prevailed by the following vote.. Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin, and Busbee Nays: None CU99-36 — KENTUCKY FRIED CHICKEN Next for the Commission to consider and make a recommendation to the City Council was Conditional Use Request CU99-36 submitted by Jeffrey T. Wooten of Glenn Engineering for property located at 3510 Grapevine Mills Parkway and platted as Lot 1, Block 6, Cimarron Crossing Addition. The applicant was requesting a conditional use permit to allow a 3,030 square foot Kentucky Fried Chicken fast food restaurant with a drive-through and a 26-foot pole sign. 072099 2 P & Z JOINT PUBLIC HEARING JULY 20, 1999 FINAL PLAT APPLICATION - LOTS 2 3 AND 4 BLOCK 5 GRAPEVINE MILLS ADDITION Next for the Commission to consider and make a recommendation to the City Council was the Statement of Findings and Final Plat application of Lots 2, 3, and 4, Block 5, Grapevine Mills Addition. The applicant was final platting 3.585 acres for the development of a restaurant. The property is located on the north corner of State Highway 26 and Grapevine Mills Boulevard South and is currently zoned "CC" Community Commercial. In the Commissioner's deliberation session, Stephen Newby moved to approve the Statement of Findings and Final Plat Application of Lots 2, 3 and 4, Block 5, Grapevine Mills Addition. Cathy Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin and Busbee Nays: None FINAL PLAT APPLICATION - LOT 1 BLOCK 1 AFE ADDITION Next for the Commission to consider and make a recommendation to the City Council was the Statement of Findings and Final Plat application of Lot 1, Block 1, AFE Addition. The - applicant was final platting 2.968 acres for the development of a gas well. The property is L. located on the east side of Grapevine Mills Parkway approximately 1,445 feet north of Grapevine Mills Boulevard North and is currently zoned "CC" Community Commercial. In the Commissioner's deliberation session, Stephen Newby moved to approve the Statement of Findings and Final Plat Application of Lot 1, Block 1, AFE Addition. Cathy Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin and Busbee Nays: None PRELIMINARY PLAT APPLICATION - LOTS 1 -3 BLOCK 6 CIMARRON CROSSING Next for the Commission to consider and make a recommendation the Statement of Findings and Preliminary Plat application of Lots Crossing. The applicant was preliminary platting 3.8 acres for commercial pad sites. Herb Fry seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin and Busbee Nays: None FINAL PLAT APPLICATION - LOT 3, BLOCK 6, CIMARRON CROSSING Next for the Commission to consider and make a recommendation to the City Council was the Statement of Findings and Final Plat application of Lot 3, Block 6, Cimarron Crossing. The applicant was final platting 1.01 acres for the development of a Kentucky Fried Chicken. The property is located on the east side of Grapevine Mills Parkway approximately 200 feet north of Grapevine Mills Boulevard North and is currently zoned "CC" Community Commercial. In the Commissioner's deliberation session, Herb Fry moved to approve the Statement of Findings and Final Plat Application of Lot 3, Block 6, Cimarron Crossing. Chris Coy seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin and Busbee Nays: None PRELIMINARY PLAT APPLICATION - BLOCKS 1-5, CIMARRON CROSSING Next for the Commission to consider and make a recommendation to the City Council was the Statement of Findings and Preliminary Plat application of Blocks 1-5, Cimarron Crossing. The applicant was preliminary platting 138.847 acres for the development of commercial pad sites. The property is located on the north side of Grapevine Mills Boulevard North between State Highway 121 and Grapevine Mills Parkway and is currently zoned "CC" Community Commercial. In the Commissioner's deliberation session, Cathy Martin moved to approve the Statement of Findings and Preliminary Plat Application of Blocks 1-5, Cimarron Crossing.
