The Planning and Zoning Commission of the City of Grapevine, Texas met in
Special Briefing Session on this the 17th day of August, 1999 at 7:00 p.m. in the
Planning and Zoning Conference Room, 200 South Main Street, 2nd Floor,

ITEM 1. BRIEFING SESSION
Chairman Oliver announced the Planning and Zoning Commission would
conduct a briefing session relative to the following cases:
CU99 -20 Pool Road /SH 26
to discuss development issues.
ADJOURNMENT
After a brief discussion, Chairman Oliver adjourned the meeting at 7:25 p.m.

Hearing with the City Council, on this the 17th day of August, 1999, in the City Council

Mayor Tate called the joint meeting to order at 7:40 p.m., and Chairman Larry Oliver called
the Planning and Zoning Commission deliberation session to order at 11:10 p.m.

CU99-20 — SH 26/POOL ROAD
First for the Commission to consider and make a recommendation to the City Council was
Conditional Use Request CU99-20 submitted by Jeff Williams of Graham Associates for
property located at 3701 and 3725 Ira E Woods Avenue and is platted as Lots 1, 2 and 3,
SH26/Pool Road. The applicant was requesting a Conditional Use Permit to establish a
Planned Commercial Center for a 24-hour grocery store with display, service and sales area
in excess of 9,500 square feet and the possession, storage, retail sale, and off-premise
consumption of alcoholic beverages (beer and wine only) in conjunction with the grocery
store and a gasoline sales/convenience store.
This case was most recently considered during Council's regular session at the July 20,
1999 meeting. Council elected to reopen the public hearing for this request. The applicant
reduced the size of the original planned commercial center by removing the proposed City
park from the original boundary area. The applicant also included the floor plan for the
gasoline sales/convenience store at the southwest corner of State Highway 26/Pool Road
with the request.
This request was also tabled during Council's regular session at the June 15, 1999 hearing
in order for the applicant to address traffic issues along Old Mill Run. The Planning and
Zoning Commission recommended denial.
The applicant proposed to establish a Planned Commercial Center on Lot 1, a portion of Lot
2, and Lot 3, of the SH 26 /Pool Road Addition. Lot 1 in its entirety, is zoned "HC" Highway
Commercial District. Lot 2 falls within two zoning districts: "CN" Neighborhood Commercial
District and "PO" Professional Office District. On Lot 2, the portion that will contain the
grocery store is zoned "CN" Neighborhood Commercial District and the portion that contains
the parking area for the grocery store is zoned "PO" Professional Office District. Lot 3 is
also subdivided by two different zoning districts. The majority of Lot 3 is zoned "CN"
Neighborhood Commercial District however, a small portion of Lot 3 is also zoned "HC"
Highway Commercial District. The applicant proposes to establish the Planned Commercial
Center only in those areas that are zoned "HC" Highway Commercial District and "CN"
Neighborhood Commercial District.
A 5,000 square foot restaurant/retail pad site is shown on Lot 3 that spans both the "CN"
Neighborhood Commercial District and the "HC" Highway Commercial District. Although
this is highly unusual, the site is in compliance since it meets all development criteria of both
districts. All uses proposed on this site must be uses allowed in both districts.
The proposed layout for Lot 2 is also highly unusual since it falls within two zoning
categories, "CN" Neighborhood Commercial District and "PO" Professional Office District.
Planned Commercial Centers are not allowed within the "PO" Professional Office District,

therefore the parking area for the grocery store on Lot 2, which is zoned "PO" Professional
Office District is not included in the Planned Commercial Center boundary.
Mr. Jay Grogan, representing the developer, informed the City Council and Planning and
Zoning Commission that he intends to develop a quality shopping center, will donate land
for a park, together with $65,000 to apply toward hike & bike trails within the park, donate
Innovative Transportation System's time to help resolve cut - through traffic on Old Mill Run,
plant 4 inch caliper trees, upscale exterior elevations, limit truck and tanker truck traffic,
reduce late -night lighting levels of the professional office parcel to a level adequate for
security only and limit the hours of delivery.
Mr. Mike Stryek of Innovative Transportation Systems discussed the proposed solutions to
the traffic problems.
Mr. Jeff Williams of Graham and Associates discussed the environment impacts of the
proposed development.
Grapevine citizens Tony McCalla, Barbara Duvall, Sam Solomon, Kathleen Galaise, Dean
Mannen, Chris Lowe, Steve Early, Rosa Lee Weiler, Larry Watkins, and Peter Ots spoke in
opposition of the proposed development stating problems with traffic, flooding of Bear
Creek, and quality of life.
Grapevine citizens John Zikos, Tom Salanty, Cheryl Salanty, and Tina Moore spoke in
support of the proposed development stating the proposed improvements to the traffic
problems and convenience of the proposed shopping center.
With no further questions, guests to speak, the public hearing was closed.
In the Commission's deliberation session, Kathy Martinez moved, with a second by Cathy
Martin, to deny conditional use request CU99 -20, which prevailed by the following vote:
Ayes: Martinez, Newby, Martin and Busbee
Nays: Oliver, Fry and Coy

Next for the Commission to consider were the minutes of the July 20, 1999, Planning and
Zoning joint public hearing.
Stephen Newby moved, with a second by Cathy Martin, to approve the minutes of July 20,
1999. The motion prevailed by the following vote:

Next for the Commission to consider were the minutes of the August 4, 1999, Planning and
Zoning joint public hearing.
Chris Coy moved, with a second by Stephen Newby, to approve the minutes of August 4,
1999. The motion prevailed by the following vote:
Ayes: Oliver, Fry, Coy, Newby and Busbee
Nays: None
Abstain: Martinez and Martin
ADJOURNMENT
With nothing further to discuss, Chris Coy moved to adjourn the meeting at 11-48 p.m.
Kevin Busbee seconded the motion, which prevailed by the following vote:
Ayes: Oliver, Fry, Coy, Martinez, Newby, Martin and Busbee
Nays: None
