a Regular Session at approximately 7:30 P.M. on Tuesday, March 18, 1986 in
the Joint Public Hearing Session, with the City Council in the Council
Chambers as 413 Main Street, and at approximately 10:50 P.M. at 311 Main
Street for the Planning and Zoning Commission Meeting, with the following
persons present, to wit:

NEW BUSINESS
CONDITIONAL USE APPLICATION CU86-02 - BEST MART CONVENIENCE STORE
First for consideration by the Planning and Zoning Commission was
Conditional Use Application CU86-02 submitted by Best Mart Convenience
Store. The property location is 2600 Wm. D. Tate Ave. N.W. corner of State
Highway 121 and Timberline Drive. The present zoning is "CC" Community
Commercial. The request is for the sale of alcoholic beverage for
off-premise consumption (beer only).
Discussion of this application concerned the proposed gas pumps and the
location of the pumps. Also discussed were some of the parking spaces
which would be located near the gas pumps and whether or not they should be
designated as parking or the possibility of making this area a green area
on the Site Plan. There was discussion relative to the ingress and egress
of the subject property being only from Timberline Drive.
Following the discussion a motion was made by Don Florence to recommend
approval of the Conditional Use Application and Larry Atchley seconded the
motion, which prevailed by the following vote:
Ayes: Atkins, Joyce, Florence, Atchley and Martin
Nays: None
Absent: Cook and Engholm.
ZONING APPLICATION Z86-03 - JACK PREWITT & ASSOCIATES
Next for consideration was Zoning Application Z86-03 submitted by Jack
Prewitt & Associates, for property located at the West end of Los Robles
and adjoining Heritage on the East. The present zoning is "R-20"
Single-Family Zoning District. The requested zoning is "R-7.5"
Single-Family and the Master Plan recommended use is for Low Density
Residential Flood Plain.
Discussion was relative to the percentage of the property located in the
flood plain and how much of the area is buildable area. It was noted by
City Staff that according to the City maps, about 900 of the property is in
the flood plain. The Commission discussed having the applicant come in
with more information before they would recommend the requested zoning of
R-7.5.

Following a lengthy discussion, a motion was made by Catherine Martin to
reconraend denial of the R-7.5 Zoning District. The motion then failed for
lack • a second.
Then a motion was made by Don Florence to recc mend approval of the Zoning
Application as submitted and Harlen Joyce seconded the motion, which
prevailed by the following vote:
Ayes: Joyce, Florence and AtchlEM
Nays: Atkins and Martin
Absent: Cook and Engholm I
Next for consideration was Zoning Application Z86-04 submitted by David
Fielding and Tim G. Sralla for property located North of Hall-Johnson South
of Woodcrest Estates, East of Pool Road and West of Parr Road. The present
zoning is "R-20" Single-Family and the requested zoning is for
Single-Family.
Discussion was relative to keeping the "R-20" zoning • the property
because of the scarcity of this type zoning within the City. There was
also some discussion concerning the 88 foot wide strip of land proposed to
be between the proposed "R-12.5" and the "R-20" zoned property; and what it
will be used for.

Next for consideration was Zoning Application Z86-05 submitted by Fred
Joyce and Mary Myers, for property located West of Parr Road East of High
Country, Phase II, North of Hall-Johnson Road. The present zoning is
"R-20" Single-Family and requested zoning is "R-12.5" Single-Family.
Following a brief discussion, a motion was made • Don Florence to
recommend approval of the zoning application and Larry Atchley seconded the
motion, which prevailed by the following vote:
Ayes: Atkins, Atchley and Florence
Nays: Martin
Abstain: Joyce
Absent: Cook and EnghoL-n
Next for consideration was Zoning Application Z86-06 submitted by William
D. and Betty Tate, for property located West of Parr Road North of
Hall-Johnson Road and East of High Country, Phase II. The present zoning
Single-Family and the requested zoning is "R-12.5" Singl-

There being no discussion relative to the zoning change, a motion was made
by Larry Atchley to recommend approval of the zoning application and Harlen
Joyce seconded the motion, which prevailed • the following vote:

FINAL PLAT, LOT 1, BLOCK 2, A. F. LEONARD ADDITION
Then for consideration was the final plat of Lot 1, Block 2, A.F. Leonard
Addition. It was noted that the lot conforms to existing zoning of "HC",
Highway Commercial. Water and sewer are available to the lot. Discussion
of the plat was relative to the type of fence and landscaping proposed for
the property.
Following the discussion, a motion was made by Larry Atchley to recommend
approval of the final plat and Catherine Martin seconded the motion, which
prevailed by the following vote:
Ayes: Atkins, Joyce, Florence, Atchley and Martin
Nays: None
Absent: Cook and Engholm
Then for consideration was the preliminary plat of Block 5, Lots 23 and 24
of Ridgecrest Addition. It was noted that the plat conforms to the
existing zoning of "PO", Professional Office. Also noted was that no
right-of-way will be required for College Street because it will be taken
from the South side of College in this vicinity.
Following a brief discussion, a notion was made by Harlen Joyce to
reccnviend approval of the preliminary plat and Don Florence seconded the
motion, which prevailed by the following vote:
Ayes: Atkins, Joyce, Florence, Atchley and Martin
Nays: None
Absent: Cook and Engholm
Next for consideration was the preliminary plat of High Country, Phase III.
Following a brief discussion of the plat, a motion was made by Larry
Atchley to recommend approval of the preliminary plat for the North portion
of High Country, Phase III, contingent on the zoning being approved, and
Don Florence seconded the motion, which prevailed as follows:
Ayes: Atkins, Florence and Atchley
Nays: Martin
Abstain: Joyce
Absent: Cook and Engholm
Then there was a notion rendered by Harlen Joyce to reconniend approval of
the preliminary plat for the South half of High Country, Phase III and Don
Florence seconded the motion, which prevailed as follows:
Ayes: Atkins, Florence, Atchley and Joyce
Nays: Martin
Absent: Cook and Engholm
OLD BUSINESS
Then for consideration was Zoning Application Z85-27 submitted by William Y.
Harvey. It was noted that this application was tabled at the December 17,
1985 meting, to enable the applicant the opportunity to address the
Commission's request relative to the proposed locations of the Professional
Office and Neighborhood Commercial uses.

wiscussion of the zoning application was relative to the buffer to the
residential property behind the proposed "CN" zoned property and the
elimination of vehicular traffic in back of the proposed one story
building, with the exception of ezergency vehicles.
Following the discussion, a motion was made by Harlen Joyce to recommend
the plan for the zoning application be approved, with stipulations that
scm type of barricades be put in to limit access to the drive behind the
proposed one story building in the I'CNI' zoned area, and Don Florence
seconded the motion, which prevailed as follows:

Next for consideration was the Master Land Use Map amendments relevant to
floating land uses. There was some discussion, then a motion was rendered
by Catherine Martin to recommend removal of all dots (which represent
floating land uses) from. the Master Land Use Map and Don Florence seconded
the motion, which prevailed by the following vote:
Ayes: Atkins, Joyce, Florence, Atchley and Martin
Nays: None
Absent: Cook and Engholm

There being no questions or corrections to the amended sections of the �
Minutes, a motion was made by Don Florence to accept the amendments to the
Minutes as approved, and Catherine Martin seconded the motion, which
prevailed as follows:

Nays: None
Absent: Cook and Engholm
Then for consideration, was the Minutes of the meting of February 25,
1986. There being no questions or corrections, a motion was made by Harlen
Joyce to approve the Minutes as written and Larry Atchley seconded the
motion, which prevailed as follows:

At this point in the meting, there was a brief discussion relative to
having a quorum of the Commission for the regular Planning and Zoning
ConTaission meting of April, 1986.

Then at approximately 1:15 A.M., a motion was rendered by Don Florence to
adjourn the meeting and Larry Atchley seconded the motion, which prevailed
by the following vote:
