HomeMy WebLinkAbout1976-06-22MINUTES, PLANNING & ZONING COMMISSION JUNE 22, 1976 After public hearing before the City Council and the Planning and Zoning Commission held on June 22, 1976 at 7:30 P.M., for the purpose of giving interested persons an opportunity to be heard in connection with Zone Change Application 27610, Z76-11 and Z76-12, the Planning and Zoning Commission reconvened in open session in the conference room on the same date for the purpose of considering the published agenda items. The following members were present: Ted Ware Chairman Joe Kennedy Member Harlen Joyce Member Bill Crabtree Member Mike Davis Member Cato Jones Member The first order of business was to consider Zoning Change Application Z76-12, Safeway Stores, Inc. requesting 11C-211 Zoning. After little discussion, Member Mike Davis made a motion to approve the zoning as requested. Member Crabtree seconded and the following vote prevailed: Ayes: Ware, Kennedy, Joyce, Crabtree, Davis and Jones. Noes: None The next order of business was to consider the plat submitted by Safeway Stores, Inc. Commissioner Ted Ware explained that it was the responsibility of the Planning & Zoning Commission to determine if the plat met with all requirements and not to determine how access to any land locked lots could be provided for. Jim Conine stated that Safeway understood that a 1917 quit claim deed passed by the Aldermen of the City had already effectively closed Barton Street through their property and that their title company wanted an official closing of the street in some form other than a quit claim deed. He further stated that Safeway could not develop this property without this action. Member Joe Kennedy made a motion to approve the plat as presented and to recommend same to the City Council contingent on the City Council, Mr. Conine, and Mr. Woolweaver getting together and agreeing on providing access to the eight lots owned by Mr. Woolweaver and his sons. The motion was seconded by Member Harlen Joyce and prevailed by the following vote: Ayes: Ware, Kennedy, Joyce, Crabtree, Davis and Jones. Noes: None The next order of business was to consider Z76-10, Hart's Marina requesting "SP" Specific Use Permit District for the storage, possession, retail sale and serving of alcoholic beverages, on premise consumption only, incidental to the operation of a restaurant. Member Harlen Joyce stated that he would like to require an additional door on the opposite corner of the pro- posed door in order to provide sufficient emergency exits in case of fire. Member Harlen Joyce then made a motion to approve the zoning as requested. The motion died from lack of a second. Member Joe Kennedy then inquired why a restaurant wasn't constructed before. Mrs. Hart explained that it was from a
