MEETING DATE: AUGUST 14, 2012 SUBJECT: 2012 GENERAL OBLIGATION BOND ELECTION RECOMMENDATION: City Council to consider an ordinance calling a General Obligation Bond Election to be held on November 6, 2012 to include two propositions totaling $68,700,000 and take any necessary action. FUNDING SOURCE: Funding for the capital projects and bond issuance costs will be provided by General Obligation bonds in the amount specified. Retirement of debt on the bonds will be provided by revenues from property taxes, sales and use tax and other General Fund resources. If approved, bonds are scheduled to be sold over a six year period to be timed with project funding needs and scheduled debt retirement. No tax rate increase has been planned to retire the debt related to these projects. BACKGROUND: Over the past several months Staff has been working with consultants on feasibility studies for a new public safety building as well as an expansion and renovation to the Community Activities Center. Staff and consultants met with City Council workshops on numerous occasions to discuss the proposed projects. PROPOSITION 1 Public Safety Building- $38,600,00 Construction of an approximately 100,000 square foot building and land acquisition, as necessary, that would accommodate all Police services, Fire Administration, Municipal Court, Detention, the Emergency Operations Center and Information Technology. PROPOSITION 2 Community Activities Center Expansion and Renovation-$30,100,000 Renovation of the existing 48,000 square foot center and the addition of approximately 60,000 square feet to provide for a wing to replace the current Senior Activities Center, additional fitness room space, indoor aquatics, multi-purpose rooms, child care/ playground, game room, walking jogging track, locker rooms, family style changing rooms, restrooms, and office space. August 10,2012(9:55AM) City Staff plans to conduct comprehensive citywide information campaign to educate residents on both ballot propositions. Staff recommends approval. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, CALLING A BOND ELECTION TO BE HELD WITHIN SAID CITY; MAKING PROVISION FOR THE CONDUCT OF THE ELECTION AND OTHER PROVISIONS INCIDENTAL THERETO; AND DECLARING AN EMERGENCY WHEREAS, the City Council (the "City Council") of the City of Grapevine, Texas (the "City"), finds and determines that an Election should forthwith be called and held in the City for the purpose of submitting certain propositions for the issuance of bonds for the purposes herein set forth; and WHEREAS, the City Council finds and declares that the meeting at which this Ordinance is considered is open to the public as required by law, and that public notice of the time, place and purpose of said meeting was given as required by Chapter 551, Texas Government Code; therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. Findings. The statements contained in the preamble to this Ordinance are hereby adopted as findings of fact and as a part of the operative provisions hereof. Section 2. Election Ordered; Date; Proposition. An Election (the "Election") shall be held for and within the City of Grapevine, Texas, on Tuesday, November 6, 2012 (the "Election Day"), at which Election the following proposition(s) shall be submitted in accordance with law: PROPOSITION NO. 1 "Shall the City Council of the City of Grapevine, Texas, be authorized to issue and sell general obligation bonds of the City, in one or more series or issues, in the aggregate principal amount of$38,600,000, with the bonds of each series or issue, respectively, to mature serially in such installments as may be fixed by the City Council, the maximum maturity being not more than forty (40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance, for the purpose of providing funds for permanent public improvements, to wit: constructing and equipping a new public safety building and the acquisition of land therefor; and to provide for the payment of the principal of and interest on the bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to pay said bonds as they mature?" #4143576.3 r1i '` � aw ad I 0 PROPOSITION NO.2 "Shall the City Council of the City of Grapevine, Texas, be authorized to issue and sell general obligation bonds of the City, in one or more series or issues, in the aggregate principal amount of$30,100,000, with the bonds of each series or issue, respectively, to mature serially in such installments as may be fixed by the City Council, the maximum maturity being not more than forty (40) years from their date, to be issued and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the City Council at the time of issuance, for the purpose of providing funds for permanent public improvements, to wit: constructing, improving, equipping, and renovation to and expansion of the existing Community Activities Center, including construction of a new central plant to service the Community Activities Center and the adjacent Grapevine Public Library; and to provide for the payment of the principal of and interest on the bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to pay said bonds as they mature?" Section 3. Official Ballot. Early voting will be conducted on Direct Recording Electronic (DRE) System and election day voting will be on the Digital Scan System accompanied by DRE for disabled and provisional voters. The Elections Administrator shall cause the ballots to be prepared in the form prescribed below, being in both English and Spanish, in accordance with State and Federal law. (b) The official ballots for the Election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid proposition(s)which shall be set forth on the ballots substantially in the following form: PROPOSITION NO. I "THE ISSUANCE OF $38,600,000 GENERAL OBLIGATION PUBLIC SAFETY BUILDING BONDS AND THE LEVYING A TAX IN PAYMENT THEREOF." PROPOSITION NO. 2 "THE ISSUANCE OF $30,100,000 GENERAL OBLIGATION COMMUNITY ACTIVITIES CENTER BONDS AND THE LEVYING OF A TAX IN PAYMENT THEREOF." Section 4. Persons OuaHfied to Vote. All resident qualified electors of the City shall be eligible to vote at the Election. Section 5. Compliance with Code. The Election shall be held in compliance with the Texas Election Code, V.T.C.A. Election Code (the "Code") except as modified by other applicable provisions of law. Section 6. Election Precincts: Polling Place. The voting precincts and polling places -2- #41435a76.3 DRAFT for the Election are hereby designated to be those municipal voting precincts identified by their respective county precinct numbers as determined by the Elections Administrator. Such precincts and locations are listed on Annex I attached hereto, which is incorporated herein by reference and made a part hereof for all purposes; provided, however, such precincts and locations may be changed if so directed by the Elections Administrator without further action of the City Council. The Elections Administrator is hereby authorized and directed to make such changes in polling locations as may be necessary for the proper conduct of the Election. Section 7. Appointment of Election Officers. The Election shall be conducted under the jurisdiction of the Tarrant County Elections Department (the "Elections Administrator") pursuant to an Election Services Contract (the "Contract") by and among the Tarrant County Elections Department, the City and other participating entities, if any, described in the Contract. The Mayor or the Mayor's designee is authorized to amend or supplement the Contract to the extent required for the Election to be conducted in an efficient and legal manner as determined by the Elections Administrator. Section 8. Early Voting. The Elections Administrator is hereby appointed as Early Voting Clerk for the Election. The early voting place and the address for early voting by mail for the Election are hereby designated as set forth in Annex I; provided, however, such locations may be changed if so directed by the Elections Administrator without further action of the City Council. The Elections Administrator is hereby authorized and directed to make such changes in locations as may be necessary for the proper conduct of the Election. The Elections Administrator and/or Early Voting Clerk are hereby authorized to appoint the members of the Early Voting Ballot board and the presiding judge and alternate judge in accordance with the requirements of the Code. Section 9. Voting Hours and Dates. (a) On Election Day, the polls shall be open from 7:00 A.M. to 7:00 P.M. (b) Early voting by personal appearance shall be conducted on the days and during the hours set forth in Annex I. (c) Applications for early voting by mail shall be submitted to the Early Voting Clerk during the time period and at the address set forth in Annex I. (d) Voting times may be changed if so directed by the Elections Administrator without further action of the City Council. The Elections Administrator is hereby authorized and directed to make such changes in voting hours as may be necessary for the proper conduct of the Election. Section 10. Election Materials. The Election materials enumerated in Secs. 272.001, et. seq., of the Code, shall be printed and furnished in both English and Spanish for use at the polling place and for early voting, and provisions shall be made for oral assistance to Spanish- speaking voters. -3- #4143576.3 R A.- " Section 11. Notice of Election. A substantial copy of this Ordinance shall serve as proper notice of the Election, which notice shall be given by posting substantial copies of this Ordinance in both English and Spanish at the City Hall and at three (3) other places within the City not later than the twenty-first (21st) day prior to the date upon which the Election is to be held; and substantial copies of this Ordinance in both English and Spanish shall be published on the same day in each of two (2) successive weeks in a newspaper of general circulation in the City, the date of the first publication to be not less than fourteen (14) days nor more than thirty (30) days prior to Election Day. Section 12.Necessary Action. The Mayor and the City Secretary of the City, in consultation with the City Attorney and bond counsel are hereby authorized and directed to take any and all actions necessary to comply with the provisions of the Code and the Federal Voting Rights Act in carrying out and conducting the Election, whether or not expressly authorized herein. Section 13. Effective Immediately. Notwithstanding the provisions of Article 111, Section 3.11(a) of the City Charter, this Ordinance shall become effective immediately upon its adoption at this meeting pursuant to Section 1201.028, Texas Government Code.
