HomeMy WebLinkAbout1981-11-054 STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine; Texas met in a Special Workshop Session on this the 5th day o_ November, 1981 with the following persons present to-wit: Sharron Spencer Ron Cook Harold Anderson Ann Glynn KII-ee Hawkins Harlen Joyce Gerald Norman Chairman Vice Chairman Member Member Member Member Member constituting a quorum with City Planner Marc Guy and Secretary Terry Pennington also present. CALL TO ORDER Chairman Sharron Spencer called the meeting to order. CONSIDERATION OF THE MINUTES, October 20, 1981 The first order of business to come before the Planning and Zoning Commission was the consideration of the minutes of October. 20, 1981. Member Farlen Joyce made a motion to waive the -reading of the 'minutes and approve them as written. Member Ann Glynn seconded the motion and it prevailed by the following vote: Ayes: Spencer, Cook, Aj-iBerson, Glynn, Hawk-ins, Joyce, Norman ��,Tay,, - T -\.' T ­ . n e DISCUSSION-Planning and Zoning Commission By-Laws The next order of business to come before the Planning and Zoning Commission was to discuss and formulate by-laws. In a lengthly discussion, Members formulated the following suggestions for their by-laws: All members must inform the Chairman, Vice Chairman or another member of the Planning and Zoning Commission if they intend to be absent at a particular meel-ing, giving the reason for thr--_ir absence. Conflict of Interest .7-,ny member of the Commission havi.ng a. direct interest in a case either as a contiguous property owner, having financial interest ii.i. outcome of the particular case or for the reason of .nepotism, as defi-r-ed by State Law, shall abse-'It himself from the meeting room during the briefing by the staff on said case prior to the hearing on said case, after notification of same to the Chairman. Voting Approval of all natters before the Cnmriission shall reqfuire the affirmative vote of four (4) members. Officers and Their Duties a. The officers of the Planning and Zoning Commission shall be Chairman, Vice Chairman, Secretary and other Vice Chairmen. and Assistant Secretaries as deemed necessa-�-y by the Commissions from time to time.. b. The Chairman will preside over all meetings of the Commission and have the duties normally conferred by parliamentary usage to such office. He shall have the privilege of discussing all matters before the Commission and voting thereon. He shall sign subdivision plats approved by the Commission and such other papers and documents as may be deemed necessary. He shall appoint all Committees and may call special meetings of the Commission. He shall be responsible for the effecient and orderly transaction of the Commission business. Opening Statement to the Audience: An'outright denial by the Commission, that is upheld by the City Council means that the case cannot be brought up again for a period of one (1) year; a denial without prejudice does not fix a time limit. The Commission is a recommending body only -- the final decision is made by your City Council. Members of the Commission are appointed by your City Council. They serve without pay - giving freely of their time for the benefit of our city. C. The Vice Chairman shall perform the duties of the Chairman during his absence, or inability to act. They shall sign subdivision plats during the absence or inability of the Chairman. d. The Secretary shall keep the minutes and records of the Commission, prepare the agenda of regular and special meetings, provide notice of meetings and copies of minutes to Commission members, arrange proper and legal notices of all hearings, attend to the correspondence of the Commission and such other duties as are normally carried out by a Secretary. It shall be the duty of the Secretary to submit to the Commission the minutes of the previous meeting so that the same may be corrected, if necessary, to reflect fairly accurately the proceedings heard at the last meeting, and said minutes shall not be official until they are adopted by a majority vote of the Commission. Withdrawals a. A written request for withdrawal of the entire application made after the mailing of notices for a public hearing, but not less than five (5) full days (excluding Saturday and Sunday) before the date of the hearing shall be honored and will not be suject to the one (1) year waiting period provision. However, the applicant shall forfeit the filing fee to cover administrative costs. b. A request to alter, change, amend, enlarge or withdraw a portion of an application after notices have been mailed for a public hearing shall not be honored. C. A written request for withdrawal of the entire application made less than five (5) full days (excluding Saturday and Sunday) before the date of the hearing shall not be honored. In the event of such a request, the Commission will have to hold a public hearing and make a formal recommendation on the application. In the interest of time at the public hearing, however, it may be announced to all parties concerned that the applicant has submitted a letter stating his intention of withdrawal. The filing fee shall be forfeited. d. If the applicant states his intention of withdrawal, either within the five (5) day period (excluding Saturday and Sunday) prior to the hearing or at the time of the hearing, 100% of the filing fee shall be retained by the City of Grapevine for administrative costs. e. In the event the applicant withdraws the application prior to the mailing of notices, the same shall be returned to him and the filing fee shall be retained by the City of Grapeivne for administrative costs. Postponements a. The applicant shall be allowed to postpone the hearing date once, provided that all such request shall be made in writing and such request shall be received by the City Planning Department at least five (5) days (excluding Saturday and Sunday) prior to the scheduled hearing date for such case and upon payment of the postponement fee of $50.00 b. Any application postponed by the applicant or his representative before or after the mailing of the required notices shall be held for a period no longer than sixty (60) days from the date of the scheduled hearing. In the event the application is not pursued at the end of said period, then the application shall be returned to the applicant and the filing fee shall be retained by the City of Grapevine for administrative costs. Right to Floor Any member desiring to speak will get permission from the Chairman before addressing the audience for questions. MISCELLANEOUS REPORTS AND/OR DISCUSSIONS The next order of business to come before the Planning and Zoning Commission was the consideration of any miscellaneous business. Chairman Sharron Spencer requested Vice Chairman Ron Cook to obtain information from the Grapevine school concerning the cost, time and other information regarding a new table for the Commission in the Council Chambers. Members also discussed the terms Low Density and High Density regarding units. Chairman Sharron Spencer also informed Members of the City's new Building official Tommy Hardy. Members discussed several areas in town where City ordinances were being violated. Member Klee Hawkins seconded the motion and it prevailed by the following vote: Ayes: Spencer, Cook, Anderson, Glynn, Hawkins, Joyce, Norman Nays: None PASSED AND APPROVED THIS THE DAY OF 1981.
