HomeMy WebLinkAbout1981-11-17STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas met in a Special Session on this the 17th day of November, 1981 with the following persons present to -wit: Sharron Spencer Ron Cook Harold Anderson Ann Glynn Klee Hawkins Gerald Norman Chairman Vice Chairman Member Member Member Member constituting a quorum with Member Harlen Joyce absent. The following staff personnel were also present: Shirley Armstrong J.R. Baddaker John F. Boyle, Jr. Marc Guy Tommy Hardy Terry Pennington CALL TO ORDER City Secretary City Engineer City Attorney City Planner Building Official Secretary Chairman Sharron Spencer called the meeting to order. DTgrTTgqTnN The first order of business to come before the Planning and Zoning Commission was to discuss the procedures relative to taking action on non - conforming uses and other related matters. Mr. Boyle provided members with a copy of the legal powers the city government might have regarding zoning. Members discussed general non - conforming uses with Mr. Boyle regarding legal recourse to bring these violations into conformance. No formal action was taken on this subject. MISCELLANEOUS REPORTS AND /OR DISCUSSION The next order of business to come before the Planning and Zoning Commission was the consideration of any miscellaneous business. Vice Chairman Ron Cook updated the members as to the status of their new table for the council chambers. Chairman Sharron Spencer asked Mrs. Armstrong what the average cost was for legal notices in the papers. Mrs Armstrong said the average is 332 cents per line or $20.00. Chairman Spencer informed members that the traffic light to be installed at Dove and Northwest Highway has been delayed because the company is behind in installations as well as numerous other company problems. Members discussed the formulation of by -laws and made some changes to Draft No. 1. Mr. Boyle commented on the withdrawal of zoning cases. Mr. Boyle also informed Members that they would have a copy of the proposed zoning ordinance within the week. ADJOURNMENT There being no further business to discuss, Member Ann Glynn made a motion to adjourn. Mr. Guy said 'that if the Connell agreement was not finalized the proposed development woul,! poSsibly _-de into water and sewer facilities with the Hilton project. Member Anderson stater _f he felt the zonirl.g was proper for the land and the best use of the land but his only concern was granting the zoning not knowing whether water and sewer facilities woul(f, be available. Member Anderson addressed Mr. Wyse concerning this and Mr. Wyse said he the possible problem. Member Anderson then made a motion to approve the �e!_.naestla(f, zoning. Nelnl r Klee Hawkins seconded the motion and it prevailed by the following vote: Ayes : Spencer, Cook, Anderson, Glynn, Hawkins, Norman Nays : -None Absent: Joyce nT.qrTTqqTnN The next order of business to come before the Planning and Zoning Commission was to further discuss any necessary action relative to dealing with non- conforming uses- Members had no more comments regarding this subject. Discussion was completed at their special session prior to tais ameetinry. CONSIDERATION OF THE MINUTES, No-\;'emtler 5, 1981 The next order of business to come before the Planning and Zoning Commission was the consideration of the minutes from the meeting of November 5, 1981. Member Gerald Norman made a motiotl U) ,tialive the reading of the minutes and approve them as written. Vice Ron Cook seconded the motion and it prevailed as follows: Ayes : Spencer, Cook, Anderson, Glynn, Hawkins, Norman Nays : None Absent: Joyce MISCELLANEOUS REPORTS AND/OR DISCUSSIONS Members discussed the following items: By-Laws. Members agreed to add the following items regarding the formulation of their by-laws: Special meetings: Special meetings for any purpose may be held: (1) on the call of the Chairman, or (2) on request of two or more members, or (3) as may be scheduled by a majority of the Commission at any previous meeting. The time and place of the special meeting shall be determined by the convening authority. Motions: A motion to approve any matter before the Commission or to recommend approval of any request requiring Council action shall require four favorable votes of the members present. When fewer than seven members are present for the voting and when all motions to recommend on a given application fail to carry by four votes consideration of the application shall be continued automatically to the next regular meeting, provided further that no request or application shall be continued under this rule beyond the next regular meeting; failure to secure four concurring votes to approve or recommend approval at said next meeting shall be recorded in the minutes as a denial of the proposal. • Chairman Spencer addressed Mr. Hardy as to the procedures when someone comes to his department with a code or ordinance violation. Mr. Hardy stated they must first determine if in fact there is a violation and if so personal contact is attempted so the violation can be discussed. • Chairman Spencer also questioned Mr. Hardy as to the progress his department was making regarding the violations of Mr. Sam Gilmore. Mr. Gilmore came before the Commission requesting a zoning change on February 17, 1981. The Commission approved his zoning change with the stipulation that a six foot screening fence be placed on three sides as per the site plan. As of this date, Mr. Gilmore has not complied with the condition and has been fined several times for the violation. Mr. Hardy informed Members that the city of Grapevine is in the process of obtaining an injunction on Mr. Gilmore to resolve the problem. Chairman Spencer questioned Mr. Hardy regarding the violations of American Turf in Grapevine. Mr. Hardy said he had talked with the City Manager Jim Hancock concerning this and he suggested waiting until the proposed zoning ordinance was received and reviewed. 7A T).Tr)T TPNTMP.T\T1P There being no further business to come before the Planning and Zoning Commission, Member Gerald Norman made a motion to adjourn.
