BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND
POSTED ON THIS THE 28TH DAY OF FEBRUARY, 1992, AT 5 PM.

CITY OF GRAPEVINE
The Board of Zoning Adjustment for the City of Grapevine, Texas,
met in regular session on Monday evening, March 2, 1992, at 6:00
p.m., in the council Chambers, Room #205, 307 West Dallas Road,
Grapevine, Texas, with the following members present to wit:
Charles Giffin
Patti Bass
Gerald Thompson
Ron Williams
Al Zimmerman
Chairman
Vice-Chairman
Secretary
1st Alternate
2nd Alternate
constituting a quorum with Member Randy Howell absent. Also
present were City Council Representative, Gil Traverse, City
Council-person, Sharron Spencer and the following City Staff:
H. T. (Tommy) Hardy Community Development Director
Greg Wheeler Building Official
John Boyle City Attorney
Gerrie Anderson Administrative Secretary
CALL TO ORDER
Chairman, Charles Giffin, called the meeting to order at
approximately 6:00 p.m.
Chairman Giffin announced that Member John Dorety had submitted a
letter stating his resignation from the Board of Zoning Adjustment,
dated February 22, 1992.
OLD BUSINESS
BZA91-31, CENTEX REAL ESTATE, INC.
The item of old business for the Board of Zoning Adjustment to
consider was BZA91-31, submitted by Centex Real Estate, Inc. This
case was tabled at the December 2, 1991, meeting in order for the
City Council to possibly amend the sign ordinance that would allow
off-premise developer signs. The City Council acted on Staff's
recommendation February 4, 1992, and made no amendment to Section
60, which would allow off-premise developer signs.
Mr. Boyle, City Attorney explained that the item being requested
was out of the Board's jurisdiction. He explained this type of
item has been before the Courts several times. The Courts found
that one does not have the ability to regulate the content of the
sign, but the location, size and quality could be regulated.
Tom Houser, applicant, of 1660 S. Stemmons, Lewisville, TX 75067,
took the Oath of Truth. Mr. Houser stated he would like to
withdraw his case and he is in agreement with the sign ordinance
and understands why the ordinance is in it's place.
Gil Traverse, City Council Representative, explained that the City
Council has worked on the sign ordinance for years and would like
to keep the use of signs under control. The Council has looked at
several different ways to change the requirements for off-premise
development signs, but no changes are justifiable. Instead of off -
premise signs being used just for development, doors would be open
for other businesses also.
After further discussion, Ron Williams made a motion to accept Mr.
Houser's withdrawal of BZA91-31. Gerald Thompson seconded the
motion which prevailed by the following vote:
Ayes: Giffin, Bass, Thompson, Williams, Zimmerman
Nays: None
Absent: Howell
ADJOURNMENT
Patti Bass made a motion to adjourn the meeting. Gerald Thompson
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Thompson, Williams, Zimmerman
Nays: None
Absent: Howell
The meeting was adjourned at 6:15 p.m.
