The Board of Zoning Adjustment for the City of Grapevine, Texas,
met in regular session, Monday evening, April 6, 1992, at 6:00
p.m., in the council Chambers, Room #205, 307 West Dallas Road,
Grapevine, Texas, with the following members present to wit:

constituting a quorum with Vice-Chairman, Patti Bass absent. Also
present was City Council Representative, Gil Traverse, and the
following City Staff:

CALL TO ORDER
Chairman, Charles Giffin, called the meeting to order at 6:11 p.m.
NEW BUSINESS
The Board agreed to first hear Agenda Item B since the applicant
for the first case was not present.
BZA92-08 AND BZA92-09, DELLWOOD DEVELOPMENT COMPANY, INC.
The Board of Zoning Adjustment considered BZA92-08 and BZA92-09 '
submitted by Dellwood Development Company, Inc., who is requesting
a variance from Grapevine Comprehensive Zoning ordinance 82-73 for
proposed Lots 7A-R and 7B-R, Block 51 Ridgecrest Addition,
addressed as 1808 and 1810 Evergreen Court. The variance is to
Section 20.G.1, Townhouse District Regulations which requires a 25
foot front yard building setback. The request is to allow the
principal structure to encroach the front yard setback from 0 feet
to 9 feet as shown on the plot plan.
Greg Wheeler explained that Lot 7, Block 5, Ridgecrest Addition was
platted prior to the 1984 City Rezoning, and because of this fact,
the lot has received variances for the front yard setback and the
rear yard setback to meet the current requirements. The applicant
is unable to meet the current front yard setback requirements with
the proposed replat, which will convert one duplex lot into two
townhouse lots. Mr. Wheeler stressed that if the lot is developed
just as a duplex, then everything would conform. By placing a
property line down the center, in order to sell each unit as a
townhouse, new front yard setback lines are required which the
structure will not meet.
Tim Lancaster, applicant, of 2010 Forest Hills, Grapevine, took the
Oath of Truth. Mr. Lancaster stated he would answer any questions
the Board may have.
With no one else to speak either for or against the request, Gerald
Thompson made a motion to close the public hearing. Randy Howell
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Thompson, Howell, Williams, Zimmerman
Nays: None
Absent: Bass
Greg Wheeler explained that in October the Planning and Zoning
Commission and the City Council amended the duplex zoning district
requirements so duplex units can be converted into townhouse lots
without rezoning the property.
Marcy Ratcliff also explained the Planning and Zoning Commission
amended the sideyard setback which was reduced from 15 feet to 6
feet, for only two-unit townhomes.
Gerald Thompson then made a motion that a special condition did
exist and the special condition being that the applicant replatted
the duplex lot subject to the 1970 Ordinance and received variances
to meet the 1984 Ordinance, and under the conditions of the new
October 1991 ordinance amendments, it meets the intent of the
setbacks for duplex, therefore; causing a hardship when changing
over to townhouse. Ron Williams seconded the motion which
prevailed by the following vote:
Ayes: Giffin, Thompson, Howell, Williams, Zimmerman
Nays: None
Absent: Bass
Gerald Thompson made a motion to grant the variance to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 20.G.1, Townhouse
District Regulations to allow the principal structure to encroach
the front yard setback from 0 feet to 9 feet as shown on the plot
plan. Randy Howell seconded the motion which prevailed by the
following vote:

BZA92-07, ROBERT AND CHERI RUTLEDGE
The next item for the Board of Zoning Adjustment to consider was
BZA92-07, submitted by Robert and Cheri Rutledge who is requesting
a variance to Grapevine Comprehensive Zoning Ordinance 82-73 for
the existing house located at 3541 Marsh Lane, legally described as
Lot 30, Block 1, Woodcrest Estates. The variance is to Section
42.D. Supplementary District Regulations which requires a 15 foot
side yard setback for side yards adjacent to the public right-of-
way, to allow a 12 foot side yard setback for the existing house,
a three foot variance as shown on the plot plan.

Williams made a motion to close the public hearing. Randy Howell
seconded the motion which prevailed by the following vote:

After further discussion, Randy Howell made a motion that a special
condition did exist and the special condition being that the
encroachment was existing when the house was purchased in 1984, and
the encroachment is no fault of the applicant. Gerald Thompson
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Thompson, Howell, Williams, Zimmerman
Nays: None
Absent: Bass
Randy Howell made a motion to grant the variance to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 42.D Supplementary
District Regulations allowing a 12 foot side yard setback for the
existing house at 3541 Marsh Lane, a three foot variance as shown
on the plot plan. Gerald Thompson seconded the motion which
prevailed by the following vote:
Ayes: Giffin, Thompson, Howell, Williams, Zimmerman
