The Board of Zoning Adjustment for the City of Grapevine, Texas met
in regular session, Monday evening, May 4, 1992, at 6:00 p.m., in
the Council Chambers, Room #205, 307 West Dallas Road, Grapevine,
Texas, with the following members present to wit:

constituting a quorum with Secretary, Gerald Thompson, and 2nd
Alternate, Al Zimmerman absent. Also present was City Council
Representative, Gil Traverse, and the following City Staff:

Chairman Charles Giffin called the meeting to order at 6:09 p.m.
NEW BUSINESS
BZA92-13, GERALD AND CYNTHIA HALEY
The first item of new business was for the Board of Zoning
Adjustment to consider BZA92-13, submitted by Gerald and Cynthia
Haley who are requesting variances to Grapevine Comprehensive
Zoning Ordinance 82-73, Section 15.G.3.1 11R-7.511 Single Family
District Regulations, which requires a six foot side yard building
setback. The variance request is for their existing house located
at 2924 Robindale Lane, legally described as Lot 16, Block 5,
Kimberly Estates Addition, Phase II. The first request is to allow
the existing house, a one foot variance to encroach the six foot
side yard on the northern property line as shown on the plot plan.
If approved, it would allow a five foot sideyard setback. The
second request is to allow an existing storage building to be
located between the existing house and the side property line on
the north side to encroach the remaining five foot side yard
setback as shown on the plot plan. If approved, a zero foot
setback from the northern property line would be allowed.
Greg Wheeler explained while reviewing the application for the
storage building, staff found the five foot side yard encroachment
and included it in the request. Mr. Wheeler did state that staff
did not find a special exception for the storage building because
of ample room in the back yard.

Cynthia Haley, applicant, of 2924 Robindale Lane took the Oath of
Truth and explained when they constructed the storage building,
they were not aware of the restrictions. Ms. Haley explained extra
space was needed for their lawn equipment and camping gear. Ms.
Haley showed the Board a survey of their lot, which depicted the
availability of space left in the back yard. On the survey, Ms.
Haley traced where the storage building would be allowed by city
ordinance, but would look unattractive. Ms. Haley also described
the location of the swingset, which is cemented in the ground, the
boat pad, and future additions of a room and area for a hot tub.
Ms. Haley explained the only areas left would be right in the
middle of the back yard or it's location now, where it cannot be
seen from the front.
With no one else to speak either for or against the request, Patti
Bass made a motion to close the public hearing. Randy Howell
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Williams
Nays: None
Absent: Thompson, Zimmerman
During discussion, Randy Howell explained he was concerned about
not having room for emergency access down that side of the house.
There were questions about the boat pad in the rear yard; if that
area could be used. Mr. Haley explained the boat pad was fenced
off by a privacy fence.
The Board was in agreement that they could not find a special
exception.
Ms. Haley explained they will lose $200 to $300 if they have to
tear down the storage building.
With no further discussion, Patti Bass made a motion that a special
condition did exist for the first variance request, and the special
condition being the house is existing and is no fault of the owner.
Ron Williams seconded the motion which prevailed by the following
vote:
Ayes: Giffin, Bass, Howell, Williams
Nays: None
Absent: Thompson, Zimmerman
Patti Bass then made a motion to grant the variance to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 15.G.3., "R-7.511,
Single Family District Regulations, to allow a one foot variance as
shown on the submitted survey. Ron Williams seconded the motion
which prevailed by the following vote:

Patti Bass made a motion that a special condition did not exist for
the second variance request to Grapevine comprehensive Zoning
Ordinance 82-73, Section 15.G.3., "R-7.511, Single Family District
Regulations. Randy Howell seconded the motion which prevailed by
the following vote:
Ayes: Giffin, Bass, Howell, Williams
Nays: None
Absent: Thompson, Zimmerman
The second variance request for the side yard setback of the
storage building was denied.
MINUTES
Next the Board of Zoning Adjustment considered the minutes of the
April 6, 1992, meeting.
With no corrections, Ron Williams made a motion to accept the
minutes as written. Randy Howell seconded the motion which
prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Williams
Nays: None
Absent: Thompson, Zimmerman
MISCELLANEOUS REPORTS AND /OR DISCUSSION
Marcy Ratcliff told the Board that Mrs. Rutledge had called and
wanted to thank them for being understanding about her husband
being late to the meeting last month, concerning their case BZA92-
07.
ADJOURNMENT
With no further questions, Patti Bass made a motion to adjourn.
Ron Williams seconded the motion which prevailed by the following
vote:
Ayes: Giffin, Bass, Howell, Williams
Nays: None
Absent: Thompson, Zimmerman
The meeting was adjourned at 6:47 p.m.
