ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252 -17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 2ND DAY OF JULY, 1992, AT 5:00 P.M. qj '0,g � COMMUNITY DEVELOPMENT DIRECTOR STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular session, Monday evening, July 6, 1992, at 6:00 p.m., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Patti Bass Vice - Chairman Randy Howell Member Ery Meyer Member Chris Coy Member Ron Williams 1st Alternate Al Zimmerman 2nd Alternate constituting a quorum. Also present was City Council Representative, Gil Traverse, and the following City Staff: Tommy Hardy Community Development Director Greg Wheeler Building Official Marcy Ratcliff Planner Ray Collins Planner Gerrie Anderson Administrative Secretary CALL TO ORDER Chairman, Charles Giffin called the meeting to order at 6:07 p.m. OATH OF OFFICE Gerrie Anderson administered the Oath of Office to Chairman, Charles Giffin, and new members Ery Meyer and Chris Coy. NEW BUSINESS Chairman Giffin announced that the Board will hold a joint public hearing for both BZA92 -14 and BZA92 -15. BZA92 -14, AND BZA92 -15 JOE L WRIGHT The two items for the Board of Zoning Adjustment to consider were BZA92 -14 and BZA92 -15 submitted by Joe L. Wright. Marcy Ratcliff explained that Mr. Wright is requesting variances for BZA92 -14 from Grapevine Comprehensive Zoning Ordinance 82 -73, Section 15.G.1, R -7.5, Single Family District Regulations which requires a 30 foot front yard building setback, and to Section 15.G.2, R -7.5, Single Family District Regulations which requires a 1 25 foot rear yard building setback. The variances are being requested for Lots 8 through 13, 25 through 29, and 34 through 43, Block 5, Winding Creek Estates, Section II, Phase I. These lots are addressed as 2117, 2113, 2109, 2105, 2101, 2097 Idlewood Drive and 2152, 2148, 2144, 2140, 2136, 2116, 2112, 2108, 2104, 2100, 2090, 2092, 2088, 2084 and 2080 Brookgate Drive. The applicant is requesting on lots 8, 13, 25, 29, and 34 a five foot variance to the 25 foot rear yard building setback, which would allow a 20 foot rear yard building setback. And the applicant is requesting on lots 9 through 12, 26 through 28 and 35 through 43, a two foot variance to the 30 foot front yard setback and a three foot variance to the 25 foot rear yard setback, which would allow a 28 foot front yard setback and a 22 foot rear yard setback. Ms. Ratcliff explained for BZA92 -15, Mr. Wright was requesting variances from Grapevine Comprehensive Zoning Ordinance 82 -73 for Lots 1 through 4, and 6 through 9, Block 6, Winding Creek Estates, Section II, Phase I. These lots are addressed as 2077, 2081, 2085, 2089, 2097, 2101, 2105, and 2109 Brookgate Drive. The front and rear yard requirements are to Section 15.G.1, R -7.5, Single Family District Regulations, which requires a 30 foot front yard building setback, and to Section 15.G.2, R -7.5, Single Family District Regulations, which requires a 25 foot rear yard building setback. The applicant is requesting on lots 4, 6, and 9 a five foot variance to the 25 foot rear yard building setback, which would allow a 20 foot rear yard building setback. And the applicant is requesting on lots 1 through 3, 7, and 8, a two foot variance to the 30 foot front yard setback and a three foot variance to the 25 foot rear yard setback, which would allow a 28 foot front yard setback and a 22 foot rear yard setback. Ms. Ratcliff explained that the applicant wishes to maintain the existing, larger, quality home product like those developed on other larger lots in the subdivision. The applicant could replat the lots, but he would not be able to make the lots any deeper because the majority of lots are back to back, and the existing streets and utilities are already in place. Martin Schelling, representing Mr. Joe Wright, took the Oath of Truth and explained to the Board how the location of the storm sewer and sewer lines, streets and the topo of the land created the design of the subdivision. Mr. Schelling explained the lot depth variances are needed for Weekley Homes and Drees Homes to build on these lots. Weekley and Drees will build the same style of house that is already in the subdivision. Mr. Schelling noted to the Board he had talked with several neighbors; Ms. Sue Spiral, who was pleased to hear that Weekley and Drees would be the builders; Ms. Linda Archer, who had the same 2 concerns about the builders; and Mr. John Simmons, who said he had no objection with the lots that back up to his property. Mr. David Tharp, of 2089 Idlewood Drive, Grapevine, took the Oath of Truth and explained that he was concerned about his privacy. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: None Council Representative, Gil Traverse, mentioned the lots have set dormant because the lots have not met what is being built at this time. Mr. Tharp noted the area had not sold well because of the builder who was building in the subdivision. Mr. Tharp then asked if he was the only property owner who had a problem with the variance, and if the house behind him could be moved forward and not have the variance in the rear yard. Chairman Giffin stated that could be put in the motion. Council Representative Gil Traverse explained he was concerned about the financial gain, if the subdivision is half built out and is not working, it is not good for people trying to sell their property. Charles Giffin then made a motion that special conditions did exist and the special conditions are that the lots were platted in 1984, the products being built in 1992 do not fit on the existing lots and the fact the lots cannot be made deeper, because they run back to back. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: None Charles Giffin then made a motion to grant the variances to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1, R- 7.5, Single Family District Regulations and to Section 15.G.2, R- 7.5, Single Family District Regulations as requested except for Lots 41 and 42, Block 5, only the two foot variance for the front building line was granted. Chairman Giffin amended his motion and added that the houses will be justified to the front building line on all lots requested here. 3
