The Board of Zoning Adjustment for the City of Grapevine, Texas met
in regular session, Monday evening, August 3, 1992, at 6:00 P.M.,
in the Council Chambers, Room #205, 307 West Dallas Road,
Grapevine, Texas, with the following members present to wit:

CALL TO ORDER
Chairman Charles Giffin called the meeting to order at 6:05 p.m.
OATH OF OFFICE
Gerrie Anderson administered the Oath of Office to Vice-Chairman,
Patti Bass.
NEW BUSINESS
BZA92-12, MARVIN DEARING
The first item of new business for the Board of Zoning Adjustment
to consider was BZA92-12, submitted by Marvin Dearing. Mr. Dearing
is requesting a variance from Grapevine Comprehensive Zoning
Ordinance 82-73, in accordance with Section 68.H.3. for property to
be platted as Lot 1, Block 1, Dearing Addition and addressed as 513
East Northwest Highway. Mr. Dearing submitted a Conditional Use
Application 92-04 for the possession, storage and retail sale of
off - premise alcoholic beverages (beer only) in conjunction with the
operation of a convenience store with gasoline sales and automotive
repair. Staff, during the review period, found the plat did not
meet all the necessary requirements nor did the site plan meet all
the landscaping requirements. The first reading of an ordinance
approving the proposed conditional use was approved by City Council
July 21, 1992. If the Board of Zoning Adjustment approves the

special exception, City Council will decide on the second and final
reading of an ordinance on August 4, 1992.
Greg Wheeler explained that the Board will be granting a special
exception instead of granting a variance. He also noted that Mr.
Dearing's property is landlocked and there is no place for him to
obtain additional property to conform with the current ordinance.
Mr. Marvin Dearing, applicant, took the Oath of Truth, and
explained in order for the business to work, the special exception
is needed.
With no one else to speak either for or against the request, Patti
Bass made a motion to close the public hearing. Randy Howell
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
Absent: Williams
Member Ery Meyer asked Mr. Dearing if he intended to add on to the
building. Mr. Dearing stated no, he would only be expanding within
the building.
Ery Meyer then made a motion that a special condition did exist and
the special condition is that the building was built in 1980 and
the lot does not meet the current lot size requirements because the
property is landlocked. Patti Bass seconded the motion which
prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
Absent: Williams
Ery Meyer made a motion to grant the special exception as requested
to Grapevine Comprehensive zoning Ordinance 82-73, Section 68.H.3
to allow the existing lot and development to remain as built.
Patti Bass seconded the motion which prevailed by the following
vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None

BZA92-16, EMOGENE ALLRED
The next item of new business for the Board of Zoning Adjustment to
consider was BZA92-16, submitted by Ms. Emogene Allred. Ms. Allred
is requesting a variance from Grapevine Comprehensive Zoning
Ordinance 82-73, Section 15.G.4., "R-7.511, Single Family District
Regulations which requires a 65 foot minimum lot width for property
to be platted as Lot 1, Block 1, Allred Addition, addressed as 230
N
Ball Street. The request is to allow a 5 foot variance to the
minimum 65 foot lot width requirement. If approved, the property
would be platted with a 60 foot minimum lot width as shown on the
proposed final plat.
Greg Wheeler explained upon review, Staff found the property did
not meet the minimum lot width requirement. The City Council and
Planning and Zoning Commission cannot approve the plat unless the
plat meets all the minimum requirements.
Mrs. Emogene Allred, applicant, took the Oath of Truth and
explained that after the house was started, it was discovered the
property was not platted.
Greg Wheeler stated that he issued the permit contingent on Mrs.
Allred making application for platting.
Two letters of approval were received from Mary (Ward) Latta, P. O.
Box 92781, Southlake, Texas 76092, and from Betty Lou Sharpe, 314
Ball Street, Grapevine, Texas 76051.
Marvin Dearing spoke and explained that he owned property in the
area and the Allred's new home will upgrade the area.
With no one else to speak either for or against the request, Randy
Howell made a motion to close the public hearing. Ery Meyer
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
Absent: Williams
Randy Howell made a motion that special conditions did exist and
the special conditions are, the lot cannot be expanded due to
apartments being located to the north and Texas Street to the
south, which does not allow the lot to meet the minimum 65 foot
required lot width. Chris Coy seconded the motion which prevailed
by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
Absent: Williams
Randy Howell then made a motion to approve the variance to
Grapevine Comprehensive Zoning Ordinance 82 -73, Section 15.G.4.,
11R -7.511, Single Family District Regulations, to allow a five foot
variance to the minimum 65 foot lot width requirement for 230 Ball
Street. Chris Coy seconded the motion which prevailed by the
following vote:

Absent: Williams
The last case for the Board of Zoning Adjustment to consider was
BZA92-17, submitted by Katrin Bedwell, who is requesting a variance
to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1.,
'OR-7.511,1 Single Family District Regulations which requires a 30
foot front yard setback. The request is to allow the existing
house, located at 2023 Casa Loma Court, Lot 4, Block 5, Laguna
Vista Addition, a two foot variance to encroach the 30 foot front
yard as shown on the plot plan submitted.
Two letters of approval were received from Rebecca & Bob Shanks,
2034 Casa Loma Court, Grapevine; and Wayne A. and Sandra L. Grant,
111, 1019 Mockingbird, Grapevine.
With no one else to speak either for or against the request, Patti
Bass made a motion to close the public hearing. Chris Coy seconded
the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
Absent: Williams
Randy Howell then made a motion that special conditions did exist,
being that the encroachment is no fault of the applicant, and the
house was already existing. Ery Meyer seconded the motion which
prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
Absent: Williams
Randy Howell made a motion to grant the variance to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 15.G.1., "R-7.511,
Single Family District Regulations which requires a 30 foot front
yard building setback, allowing a two foot variance as shown on the
plot plan for 2023 Casa Loma Court. Patti Bass seconded the motion
which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
Absent: Williams
MINUTES
Next the Board considered the minutes of the July 6, 1992, meeting.
Patti Bass made a motion to accept the minutes as written. Randy
Howell seconded the motion which prevailed by the following vote:

MISCELLANEOUS REPORTS AND DISCUSSION
Ray Collins informed the Board of the updated Economic Profile 1992
which includes data on population, thoroughfares, traffic counts,
labor, employment and education level. Ms. Collins explained she
receives numerous calls from people moving into the community
wanting data on Grapevine which the information from the profile
comes in very useful. Each of the Board members received a copy of
the booklet.
Greg Wheeler informed the Board that the next Board of Zoning
Adjustment meeting would be held August 31 due to the Labor Day
Holiday.
The BZA Workshop will be held September 21, 1992, at 6:00 p.m. with
a dinner being provided.

Patti Bass made a motion to adjourn the meeting. Ery Meyer
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
