ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252 -17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE REGULAR BOARD OF ZONING ADJUSTMENT MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 28TH OF AUGUST, 1992, AT 5:00 P.M. t-) � COMMUNITY DEVELOPMENT DIRECTOR STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular session, Monday evening, August 31, 1992, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Patti Bass Randy Howell Ery Meyer Chris Coy Ron Williams Chairman Vice - Chairman Secretary Member Member 1st Alternate constituting a quorum with 2nd Alternate, Al Zimmerman, absent. Also present was City Council Representative, Gil Traverse, and the following City Staff: H. T. (Tommy) Hardy Marcy Ratcliff Ray Collins Gerrie Anderson CALL TO ORDER Community Development Director Planner Planner Administrative Secretary Chairman, Charles Giffin called the meeting to order at 6:00 P.M. NEW BUSINESS BZA92 -18, ALAN BIRMINGHAM The first item of new business for the Board of Zoning Adjustment to consider was BZA92 -18, submitted by Mr. Alan Birmingham who is requesting variances from Grapevine Comprehensive Zoning Ordinance 82 -73 for Lot 1 -R, Block L, Oak Knolls Lakeview Addition, addressed as 2101 West Northwest Highway. The following variances are to: 1. Section 26.G.3., Highway Commercial, which requires a 25 foot building setback and landscaped front yard setback. The applicant is requesting a 5 foot encroachment of the 25 foot building setback for the drive through canopy, which would allow a 20 foot building setback. The applicant is also requesting 22 to 0 foot variance to allow a variable front yard landscape buffer from 3 to 25 feet along Northwest Highway. 2. Section 53.H.2.a., Landscape Regulations, which requires a 15 foot landscape buffer between a vehicular use (parking lot) area and the public right -of -way along State Highway 114. The applicant is requesting a 12 to 0 foot variance to allow a variable landscape buffer from 3 to 15 feet along State Highway 114. 3. Section 53.H.2.b., Landscape Regulations, which requires a 10 foot landscape buffer between a vehicular use (parking lot) area and the adjacent property line along the east property line. The applicant is requesting a 10 to 4 foot variance to allow a variable landscape buffer from 0 to 6 feet along the east property line and 2 foot variance along the southern property line to allow an 8 foot landscape buffer. 4. Section 60.J.5.a., sign Regulations, which requires a 10 foot setback for on-premise ground signs. The applicant is requesting a 4 foot variance to allow the sign located in the northeast corner of the property to be located 6 feet from the property line and a 10 foot variance to allow the sign located in the northwest corner of the property to be located right on the property line. Marcy Ratcliff explained the cases and Staff recommended approval for all the variance requests in accordance with the submitted site plan except for Item 4, Sign Regulations. Alan Birmingham, applicant, P. O. Box 671203, Dallas, Texas, 75367, took the Oath of Truth and explained that on the side of the property fronting Park Boulevard, there is a separately owned strip of land he would like to maintain. His plans are to berm the eastern and part of the northern side of the property with railroad timbers, and the south side would be bermed. He explained that he is providing the required 24 parking spaces. Mr. Birmingham also explained about having two monument signs instead of two pole signs, one at Park Boulevard and Northwest Highway and one at Northwest Highway and Highway 114 frontage road. He feels the monument signs would work in well with the landscaping and would have exposure from both sides. After further discussion, Ery Meyer made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman Marcy Ratcliff noted that Mr. Birmingham could meet the sign requirements, even though the monument signs would be more attractive. Ery Meyer then made a motion that a special condition did exist, because of the lot depth, variances to Section 26.G.3 were needed 2 to work with the existing development and to provide the required parking. Chris Coy seconded the motion that a special condition did exist which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: Bass Absent: Zimmerman Ery Meyer then made a motion to grant the variance to Section 26.G.3 of the Grapevine Comprehensive Zoning Ordinance to a five foot encroachment of the 25 foot building setback for the drive through canopy which would allow a 20 foot building setback and also a 22 to 0 foot variance to allow a variable front yard landscape buffer from 3 to 25 feet along Northwest Highway. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: Bass Absent: Zimmerman Chris Coy made a motion that a special condition did exist along the frontage of State Highway 114 and there is justification for the requested 12 to 0 foot variance to Section 53.H.2.a. in order to meet the off-street parking requirements. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: Bass Absent: Zimmerman Chris Coy then made a motion to grant a 12 to 0 foot variance to Section 53.H.2.a. of the Grapevine Comprehensive Zoning Ordinance, Landscaping Regulations, which requires the 15 foot landscape buffer between the parking lot area and the public right-of-way along State Highway 114 and to allow a variable landscape buffer from 3 to 15 feet along State Highway 114. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy Nays: Bass Absent: Zimmerman Randy Howell made a motion that a special condition did exist along the east property line to Section 53.H.2.b. of the Grapevine Comprehensive Zoning Ordinance, Landscaping Regulations because the subject property lays adjacent to a separately owned strip of land that cannot be developed and to provide adequate circulation to the parking lot area. Ery Meyer seconded the motion which prevailed by the following vote: 3 Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman Randy Howell then made a -motion to grant the variance to Section 53.H.2.b., Landscape Regulations as stated in the memo which requires 10 foot landscape buffer between a vehicular use (parking area) and the adjacent property line along the east property line and in doing this, granting a variance of 10 to 4 foot variance to allow a variable landscape buffer from 0 to 6 feet along the east property line and 2 foot variance along the southern property line to allow an 8 foot landscape buffer. Chris Coy seconded the motion. Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman There was discussion concerning the sign. Marcy Ratcliff said that he could put the signs in another location and meet the requirements. Chairman, Giffin asked if this item could be tabled. Alan Birmingham said he would work with City staff on the location of the signs. Patti Bass made a motion to table the request for a variance to Section 60.J.5.a., Sign Regulations until the next scheduled meeting. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman BZA 92-19, BEVAND REG POWELL The next item of new business for the Board of Zoning Adjustment to consider was BZA92-19, submitted by Bev and Reg Powell who is requesting a variance to Grapevine Comprehensive Zoning ordinance 82-73, Section 45.G.3., Projections into Required Yards. The request is to allow a 12 foot variance for a second story patio, which was constructed within the 25 foot rear yard setback as shown on the submitted site plan for Lot 18, Block 1, Dove Crossing Addition, addressed as 1448 Ryan Court. Ms. Powell of 3503 Ladimer, Austin, Texas, took the Oath of Truth and explained that the contractor had not applied for a building permit. It was not until they received notice during contract negotiations to sell their home two years later, that the second FAI story patio was found not to be in compliance with the 25 foot rear yard setback requirement. Marcy Ratcliff stated that staff had received one letter of approval from Vicki Sheahen of 1451 Mockingbird, Grapevine. With no one else to speak either for or against the request, Randy Howell made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman Randy Howell made a motion that special conditions did exist and the special conditions being the structure is two years old and is pre-existing, the house is located on a cul-de-sac and the structure does not effect the adjacent properties around it. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman Randy Howell then made a motion to approve the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 42.G.3, Projections Into Required Yards, to allow a 12 foot variance for a second story patio, which has been constructed within the 25 foot rear yard setback as shown on the submitted site plan. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman BZA92-20, 3927 FOUNDATION, INC., DBA BROOKHOLLOW MANOR The next item for the Board of Zoning Adjustment to consider was BZA92-20, submitted by 3927 Foundation, Inc., DBA Brookhollow Manor, who is requesting a variance from Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3., Changing Nonconforming Uses for Lot 1, Block 1, HFCC Addition, addressed as 925 Minters Chapel Road. The request is for a special exception to allow an addition to the existing nonconforming building per the submitted site plan. Marcy Ratcliff explained the special condition for this request is to allow Brookhollow Manor to add laundry and employee lounge facilities onto their existing building. Such a minor addition to the building will not prolong the life of the use, but it will provide the user and their residents a better quality of life. E, Charles Birkhead of Birkhead & Associates Architects, 6307 Lafayette Way, Dallas, Texas, 75230, took the Oath of Truth and explained the existing laundry room is not to current standards and in order to bring the nursing home into compliance with State standards a new laundry room and employee lounge area is needed. Michael Brinkley, President of 3927 Foundation, Inc., 7001 Grapevine Highway, 76180, took the Oath of Truth. Mr. Brinkley explained that he acquired the 28 year old facility in 1989 and feels the addition is needed for employees and residents. With no one else to speak either for or against the request, Ery Meyer made a motion to close the public hearing. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman Patti Bass made a motion that a special condition did exist and the special condition being that the addition of the laundry room and employee lounge will not prolong the life of the existing use and meets the 15 foot side yard setback requirement of Section 31, Light Industrial. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman A motion was then made by Patti Bass to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.3., Changing Nonconforming Uses, for a special exception to allow an addition to the existing nonconforming building per the submitted site plan. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman MINUTES Next the Board of Zoning Adjustment considered the minutes of the August 3, 1992 meeting. Ery Meyer made a motion to approve the minutes as written. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman 6 MISCELLANEOUS REPORTS AND DISCUSSION Marcy Ratcliff noted that the Board of Zoning Adjustment workshop was set for September 21, 1992, at 6:00. Ms. Ratcliff also told the Board of the American Planning Association Section meeting that she attended in Southlake and how they commented on how nice Grapevine's landscape ordinance was written. ADJOURNMENT With no further discussion, Patti Bass made a motion to close the public hearing.
