HomeMy WebLinkAbout1992-11-30STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, November 30, 1992, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Patti Bass Vice- Chairman Randy Howell Secretary Ery Meyer Member Chris Coy Member Ron Williams 1 st Alternate constituting a quorum with 2nd Alternate Al Zimmerman absent. Also present was City Council Representative, Gil Traverse and the following City Staff: H. T. (Tommy) Hardy Marcy Ratcliff Greg Wheeler Gerrie Anderson CALL TO ORDER Community Development Director Planner Building Official Administrative Secretary Chairman Charles Giffin called the meeting to order at 6:05 P.M. NEW BUSINESS BZA92 -25 WOOD CONCEPTS The first item of new business for the Board of Zoning Adjustment to consider was BZA92 -25 submitted by Wood Concepts who is requesting a variance from Grapevine Comprehensive Zoning Ordinance 82 -73, Section 60.F.5.a., Sign Standards which requires a 15 foot setback for 1713 Dove Loop Road, Marina Del Rey Apartments. The request is to allow a proposed sign a 13 foot variance to encroach the 15 foot setback from the property line as shown on the plot plan. If approved, it would allow a two foot setback from the property line. Greg Wheeler explained that Ken VanTreese with Wood Concepts, Inc., submitted an application proposing to eliminate two non - conforming signs (one non - conforming sign has already been removed) and replace them with one sign as proposed. With the l proposed sign pushed against the building, there still would be an encroachment because of the reduced front yard. The encroachment is due to a lack of space for the ground sign to meet the setback requirements of Section 60.F.5.a. Mr. Ken VanTreese, applicant and President of Wood Concepts took the Oath of Truth and explained why the variance is needed. Mr. VanTreese explained the proposed location of the new sign would enhance visibility of traffic approaching from the right as you are exiting from the property. He also stated there is no room at all to put a sign of adequate dimension in the remaining space in front and comply with the code. With no one else to speak either for or against the request, Patti Bass made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman With no further discussion, Randy Howell made a motion that a special condition did exist. Mr. Howell explained that the special conditions are that with the visibility problem with existing trees, fencing and the widening of Dove Loop Road reduces the amount of area in the front yard which makes it impossible to have the ground sign meet the setback requirements of Section 60.F.5.a. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman Randy Howell then made a motion to approve the variance to Grapevine Comprehensive Zoning Ordinance 82 -73, Section 60.F.5.a. to allow a proposed sign a 13 foot variance to encroach the 15 foot setback from the property line as shown on the plot plan. Patti Bass seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman The next item of new business for the Board of Zoning Adjustment to consider was BZA92 -26 submitted by Eric and Allison Eckhardt. The applicants are requesting variances from Grapevine Comprehensive Zoning Ordinance 82 -73 to the following 2 sections for their property located at 2152 Idlewood Drive, Lot 20, Block 4, Winding Creek Estates: Section 15.G.1., Single Family District Regulations - requires a 30 foot front yard building setback. The request is to allow the proposed house a two foot variance to encroach the 30 foot front yard as shown on the plot plan. If approved, it would allow a 28 foot front yard setback. Section 15.G.2., Single Family District Regulations - requires a 25 foot rear yard building setback. The request is to allow the proposed house a three foot variance to encroach the 25 foot rear yard as shown on the plot plan. If approved, it would allow a 22 foot rear yard setback. Greg Wheeler stated that denial was recommended for both requests because staff feels the applicants can find a better fitting house plan to fit the lot and still preserve the existing trees. Gary Dyke with Weekley Homes took the Oath of Truth and explained that the house does fit the lot with the garage on the south side, but will lose an 18" oak tree in the front and an 18" oak tree in the back. Mr. Dyke explained that by flipping the house, both trees can be saved and the back yard would be more usable. Mr. Dyke also explained they have other plans that could possibly fit the lot but the owner wants the plan that is submitted. Joe Wright of 601 West Wall Street, Grapevine, took the Oath of Truth and explained that he was in favor of the request and stated the neighbors in that area had no problem with the request. Two letters of approval had been received. After further discussion, Patti Bass made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman Greg Wheeler explained that staff feels even though there are several large trees that can be saved, there are several smaller trees that would work out better in the future, if saved, and feels there are variables on this lot that could be worked out. Patti Bass commented there was no guarantee in saving the trees. 3 Charles Giffin commented that the variance is not out of place because there have been several other similar variances on that street and feels the trees are more important then the two foot variance. Patti Bass then made a motion that a special condition did exist and the special condition being the topo of the lot in conjunction with the placement of the existing trees, imposes a unique set of circumstances to building on the lot. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman Patti Bass made a motion to approve both variances requested from Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1., R-7.5, Single Family District Regulations to allow the proposed house a two foot variance to encroach the 30 foot front yard as shown on the plot plan, allowing a 28 foot front yard setback; and to Section 15.G.2., R-7.5, Single Family District Regulations to allow the proposed house a three foot variance to encroach the 25 foot rear yard as shown on the plot plan, allowing a 22 foot rear yard setback. Charles Giffin noted that the motion should provide for flexibility in order to move the house back and forth. Patti Bass added to her motion that these variances be granted as set forth on the plot plan as submitted. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman MINUTES Next the Board of Zoning Adjustment considered the minutes of the September 21, 1992, meeting. Ery Meyer made a motion to accept the minutes as written of the September 21, 1992, meeting. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy Nays: None Absent: Zimmerman W MISCELLANEOUS DISCUSSION AND /OR REPORTS Greg Wheeler went over the meeting dates of July 5 and September 6, 1993 that would need to be changed due to a conflict with the holidays. Ery Meyer made a motion to change the July 5, 1993, meeting to June 28, 1993, and September 6, 1993, meeting to August 30, 1993. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Giffin, Bass, Howell, Meyer, Coy, Williams Nays: None Absent: Zimmerman With no further discussion, Chris Coy made a motion to adjourn the meeting.
