Chairman Holt called the Public Hearing Session of the Board of Zoning Adjustment to
order at approximately 6:15 P.M.
PUBLIC HEARING
BOARD OF ZONING ADJUSTMENT CASE BZA16-26. CHRIS MINTEER. 216 WEST

The first item for the Board of Zoning Adjustment to consider was BZA16-26 submitted
by Chris Minteer for property located at 216 West Wall Street, proposed to be platted as
Lot 3, Block 12, Starr Addition.
Section 43.E.3., "Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested the existing commercial structure to remain as developed
along with an expansion as shown on the plot plan.
Mr. Stombaugh explained that Staff found a special condition existed for the requested
special exception. Specifically, the subject property and the surrounding property that
comprised the Starr Addition was originally subdivided in 1897 making it one of the
oldest subdivided properties in the City, predating the City's first zoning ordinance
established in 1955.
With no questions for Mr. Stombaugh, Chris Minteer, of 3201 Eaton Circle, Colleyville,
Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested
favorable consideration of his request and offered to answer any questions of the
Board.
With no questions for Mr. Minteer, and no additional speakers, Mike Morris made a
motion to close the public hearing. John Sheppard seconded the motion which prevailed
by the following vote:
Ayes: Holt, Morris, Dierolf, White, Sheppard
Nays: None
Absent: Dalton
Ken White made a motion that a special condition existed for the requested special

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following special
exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
216 West Wall Street, proposed to be platted as Lot 3, Block 12, Starr Addition on as
follows:
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and /or enlargement of a nonconforming use
The applicant is requesting a special exception to allow the existing commercial structure to
remain as developed along with an expansion as shown on the site plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the special exception request. Specifically,
this property and the surrounded property that comprise the Starr Addition was originally
subdivided in 1897 making this one of the oldest subdivided properties in the City,
predating the City's first zoning ordinance established in 1955.
BACKGROUND INFORMATION:
The subject site received specific variances from the Board in May, 2001 for front yard
setback, rear yard setback, landscaping setback, and to the masonry requirement. Several
years later a historic overlay was placed on the subject property against the property
owner's wishes at that time. With this request, the proposed new owner of the property
intends to make a slight expansion of the structure as shown on the site plan. This
expansion and associated elevations were approved by the Historic Preservation
Commission at their November, 2016 meeting. During the review for this request it was
discovered that the subject property was in fact, not platted and the survey that was done
for the variance requests in 2001 was in error. A new survey has been provided and
verified as well as a replat that will be considered by the Council and Planning and Zoning
Commission at their January 17, 2017 meeting. This property is non -conforming relative to

front yard setback and landscaping setback —given that the property is now being platted
and meets the requirements of the zoning ordinance relative to width, depth, and area, a
special exception is the appropriate course of action rather than a variance for each
specific non -conformity. The applicant's proposed building expansion and additional
parking do not exacerbate the non -conforming conditions of the property.

terminated by the Board of Adjustment in accordance with provisions
of Section 67A of this Ordinance.
E. CHANGING NONCONFORMING USES:
Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not

No nonconforming use may be expanded or increased beyond the lot or tract upon

except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
