The next item for the Board of Zoning Adjustment to consider was BZA16-24 submitted
by Fabien Goury for property located at 326 East Texas Street, legally described as
Tract 63B, of the William Dooley Survey, Abstract 422.
Section 43.E.3., "Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested the existing residential structure to remain as developed
along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
special exception. Specifically, the subject site was an existing developed lot, and the
existing structure was built in 1947 predating the City's first zoning ordinance adopted in
1955.
With no questions for Mr. Triplett, Fabien Goury, of 326 East Texas Street, Grapevine,
Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested
favorable consideration of his request and offered to answer any questions of the
Board.

took the Oath of Truth; he expressed his concerns and requested clarification as to what
was being constructed on the property. Mr. Goury addressed Mr. Brady's concerns.

The next item for the Board of Zoning Adjustment to consider was BZA16-25 submitted
by Bruce Ogletree for property located at 1733 Anglers Plaz5, platted as Lot 1, Block A,
Bradley Powers Addition.
Section 15.G.5., "R-7.5" Single Family District, Area Regulations, requires a
minimum lot depth of 100-feet. The applicant is requested a variance of 15-feet
allowing a lot depth of 85-feet for an existing lot.
Section 43.E.3., "Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested the existing residential structure to remain as developed
as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the variance and
special exception requested. Specifically, the existing platted lot was originally platted
in 1951 predating the city's first zoning ordinance adopted in 1955. Developed property
and right-of-way existed to the west and east respectively, eliminating the possibility to

expand the site to meet the depth requirement. The site was an existing developed lot,
and the dwelling was built in 1981 prior the rezoning of the subject site in the 1984 City
Rezoning to "R-7.5" Single Family District. The site was noncompliant with the current
Zoning Ordinance (82-73) relative to the required 25-foot rear yard setback and the
required 100-foot lot depth for the existing dwelling.
With no questions for Mr. Triplett, Bruce Ogletree, of 712 North Lucas Drive, Grapevine,
Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested
favorable consideration of his request and offered to answer any questions of the
Board.
With no questions for Mr. Ogletree and no additional speakers, Tracey Dierolf made a
motion to close the public hearing. John Sheppard seconded the motion which prevailed

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following special
exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
326 East Texas Street, legally described as Tract 63B, of the William Dooley Survey,
Abstract 422 as follows:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing residential structure to
remain as developed along with an expansion as shown on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the special exception request. Specifically, the
subject site is an existing developed lot, and the existing structure was built in 1947
predating the City's first zoning ordinance adopted in 1955.
BACKGROUND INFORMATION:
The Board of Zoning Adjustment at the August 5, 2002 meeting approved BZA02-12 on the
subject site to allow for a variance and special exception. The variance allowed three
existing single family residential structures to remain as developed. The special exception
approved an expansion to the rear of the existing primary single family residence (primary
residence). On May 24, 2006 the Historic Preservation Committee adopted the
preservation criteria for the Jackson House on the subject site. The City Council at their
September 19, 2006 meeting approved Historic Landmark HL06-02 on the site. On
December 16, 2009 the Historic Preservation Commission approved Certificate of
Appropriateness CA09-65 within the rear yard of the site for a garage and new covered
area for the primary residence.
The existing building footprint of the primary residence and garage is 3,010 square feet.

With this request the applicant proposes the following improvements to the primary
residence.
1. Along the east elevation construct a 408-square foot screened in porch atop an
existing patio.
2. Extend the existing patio 168-square feet along the east side of the primary
residence to accommodate a hot tub and pergola.
3. Construct an exterior wall along the west elevation of an existing open-air
breezeway between the garage and primary residence.
4. Screen in the east side of the breezeway.

E. CHANGING NONCONFORMING USES:
Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
