The Board of Zoning Adjustment for the City of Grapevine, Texas met in
regular session May 4, 1987 at 307 West Dallas Road, in the Council
Chambers, Grapevine, Texas with the following members present to wit:
Bill Waldrip Chairman
Gerald Thompson Vice-Chairman
Ron Troy Secretary
Charles Giffin Member
constituting a quorum, with Member Don Bigbie absent. Also present was
Council Representative Ted Ware, and the following City Staff present to
wit:

Chairman Bill Waldrip called the meting to order at 6:00 P.M.

The first item of new business was for the Board of Zoning Adjustment to
consider BZA 87-36 and BZA 87-37, submitted by Ryland Homes, who is
requesting a variance to Grapevine Zoning Ordinance 82-73, Section 56.C,
relative to single-family, off-street parking requirements for model homes
at 1213 and 1211 Berkley, legally described as Lots 10 and 11, Block B of
College Creek Addition. Tommy Hardy stated that Staff recommends approval.
Andy Phy, representing Ryland Homes spoke for the case. And with no one
else to speak either for or against the request, Charles Giffin made a
motion to close the Public Hearing. Gerald Thompson seconded the motion
which prevailed by the following vote:
Ayes: Waldrip, Thompson, Troy, Giffin
Nays: None
Absent: Bigbie
Gerald Thompson made a motion that a special condition does exist. Ron
Troy seconded the motion which prevailed by the following vote:
Ayes: Waldrip, Thompson, Troy, Giffin
Nays: None
Absent: Bigbie
Gerald Thompson made a motion to grant the variance because it is customary
for the City of Grapevine to allow model homes. Charles Giffin seconded
the motion which prevailed by the following vote:
Ayes: Waldrip;
Nays: None
Absent: Bigbie
BZA 87-33, GENERAL HOMES

The next item of new business was for the Board of Zoning Adjustment to
consider BZA 87-33, submitted by General Homes who is asking for a variance
to Grapevine Zoning Ordinance 82-73, Section 15.G.2, rear yard setback
requirements for 1826 Forestdale, Shadow Glen 2.A. Tommy Hardy stated that
there was a thirty-one (31') foot front yard and a twenty-two foot-two inch
(221 2") rear yard and stated that the plot plan submitted with the
building permit showed that the house did fit the lot but after the house
was started, it was discovered that the house was too big.
Dave Herr of 1414 Gardenia, Allen, Texas, representing General Homes, took
the Oath of Truth and explained that the house is one foot-ten inches
(1110") too big for the lot and that the original plot plan was mistaken
and their employee did not catch the mistake when setting up the forms.

With no one else to speak either for or against the request, Ron Troy made
a motion to close the Public Hearing. Charles Giffin seconded the motion
which prevailed by the following vote:
Ayes: Waldrip, Thompson, Troy, Giffin
Nays: None
Absent: Bigbie

Mr. Hillman spoke and explained the variances needed for the property which
is planned for a 16-unit per acre apartment complex located at the end of
McPherson Drive, legally described as Tract 2AlA of the Thomas Easter
Survey-
Ron Troy made a motion to table the case to the next regular scheduled
meting of June 1, 1987. Gerald Thompson seconded the motion which
prevailed by the following vote:
Ayes: Waldrip, Thompson, Troy, Giffin
Nays: None
Absent: Bigbie

Mark Petty, owner of the property, took the Oath of Truth and explained the
situation.
With no one else to speak either for or against the request, Ron Troy made
a motion to close the Public Hearing. Charles Giffin seconded the motion
which prevailed • the following vote:

Ron Troy made a motion that a special condition does exist on the
property. Gerald Thompson seconded the motion which prevailed by the
following vote:
Ayes: Waldrip, Thompson, Troy, Giffin
Nays: None

Ron Troy made a motion to grant the variance as requested and that the
special condition is that the house already exists and it was an oversight
in accordance with Grapevine Zoning Ordinance 82-73, Section 42.D,
requiring a fifteen (15') foot side yard. Charles Giffin seconded the
motion which prevailed by the following vote:
Ayes: Waldrip,
Nays: None
Absent: Bigbie

The last item of new business was for the Board of Zoning Adjustment to
consider BZA 87-38, submitted by Billy J. Edmondson, Jr., who is asking for
exceptions to Grapevine Zoning Ordinance 82-73, Section 15.G.3, which
requires a six (6') foot side yard and to Section 42.D which requires a
fifteen (15') foot side yard when abutting a street for 2905 Old Mill Run,
legally described as Lot 6, Block 3, Creekwood West. The existing setbacks
are a five-foot, nine-inch (5'9") side yard on the north side and a
thirteen and one-half foot (13.5') side yard on the south side.
Billy J. Edmondson, owner of the property, took the Oath of Truth and
explained that when he bought the house he was aware of the encroachments,
but now variances are needed because he is selling the house.
With no one else to speak either for or against the request, Charles Giffin
made a motion to close the Public Hearing. Gerald Thompson seconded the
motion which prevailed by the following vote:
Ayes: Waldrip, Thompson, Troy, Giffin
Nays: None

Ron Troy made a motion that a special condition does exist. Gerald

Ron Troy made a motion that the special conditions existing are the
irregular shaped lot, the fact that the house is existing and the variance
be granted relative to Grapevine Zoning Ordinance 82-73, Section 15.G.3,
and Section 42.D. Charles Giffin seconded the motion which prevailed by
the following vote:
Ayes: Waldrip, Thompson, Troy, Giffin
Nays: None
Absent: Bigbie
Tommy Hardy stated that quite a few of the problems with setbacks have been
eliminated since the Inspectors have been pulling strings between property
line pins to check the setbacks.

Charles Giffin made a motion to accept the minutes as written for the April
6, 1987 meting. Gerald Thompson seconded the motion which prevailed by
the following vote:
