ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252 -17, V.A.T.C.S., AS AMENDED BY CHAPTER. 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE REGULAR BOARD OF ZONING ADJUSTMENT MEETING AGENDA WAS PREPARED AND-POSTED ON THIS THE 29TH DAY OF MAY,1987 AT 5 PM. a Oki& • 11 MVA EA I The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session June 1, 1987, at 307 West Dallas Road, in the Council Chambers, Grapevine, Texas, with the following members present to wit: Gerald Thompson Vice Chairman Charles Giffin, Jr. Member Don Bigbie Member Robert Hinson lst Alternate Tim Hobbs 2nd Alternate constituting a quorum, with Chairman Bill Waldrip, and Secretary Ron Troy absent. Also present was Council Representatives Ted Ware and Gil Traverse, and the following City Staff present to wit: Joy Carroll Administrative Assistant Adrienne Leonard Attorney, City Attorney's Office Gerrie Taylor Secretary CALL TO ORDER Vice-Chairman, Gerald Thompson, called the meeting to order at approximately 6:00 P.M. Gerrie Taylor introduced and administered the Oath of Office to the new members, Robert Hinson, lst Alternate, and Tim Hobbs, 2nd Alternate. •TWOUNUNRIDWIF1 Vice-Chairman, Gerald Thompson then administered the Oath of Truth to those members of the audience who wished to speak during the meeting. WEIRAW-12AM-W MA U M r-6112 . 16 0 r a F.1 LN I The first item of old business was for the Board of Zoning Adjustment to consider BZA 87-34, submitted by Lou Hillman whose case was tabled at the last May 4, 1987 meeting, for a 1.3 acre tract which is bordered on three sides by Woodlake Apartments. The requested zoning is for "R-YT-2" from "R-3.5", which is the present zoning. Mr. Hillman stated the six variances needed in order to build on such a difficult tract. 1) Approval for a variance to Grapevine Zoning Ordinance 82-73, Section 22.F.2, which requires a "R-MF-2" district to be a minimum of 2 acres. The subject tract is three-tenth, 1.3 acres. 2) Approval of Section 22.M.5 which disallows a vehicular use area to be at least fifteen (15') feet from buildings. 3) Approval of Section 22.M.6 which requires buildings to be no less than twenty (20') feet apart. 4) Approval of Section 53.H.2.b. which requires ten (10') of landscaped setback to be maintained between the edge of parking area and adjacent property lines for the purpose of screening those parking areas from existing or future development. Because of the small size of the site the applicant is asking for a five (5) foot landscaped setback. 5) Approval of Section 53.H.1.c. which requires landscaped parking islands to be 10' X 201. There is a reduction in size in islands, but the landscape percentage requirement is met in other areas, due to the small size of the site. 6) Approval to Section 22.H which requires a forty (40') foot landscaped buffer when a lower density district is adjacent. A twenty-five (25) foot buffer is being requested. Joy Carroll stated that Staff recommends approval for all variances requested. The rezoning to "R-1vT-2", was approved by City Council at the May, 1987, meeting. Board of Zoning Adjustments June 1, 1987 Page 2 With no one else to speak either for or against the request, Charles Gif fin made a motion to close the Public Hearing. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Charles Gif fin made a motion that the following variances be approved for: Grapevine Zoning Ordinance 82-73, Section 22.F.2 requiring the district to be two acres be granted to a tract of 1. 3 acres based on the fact that the tract is surrounded on three sides by apartments; approval of the variance to Section 22.M.5 which disallows vehicular traffic use to be at least fifteen (15') feet from buildings, that some buildings are ten (10') feet from drives from some areas and the special condition warranting this is the limited size of the property; approval of the variance to Section 22.M.6 be granted which requires the building to be no less than twenty (20') feet, which the variance would allow buildings be as close as sixteen (16') feet based on the lot size being reduced from the minimum requirement of two acres; approval of Section 53.H.2.b requiring a ten (10') foot setback to be maintained between the edge of the parking areas and adjacent property lines. The special conditions would be: the existing & additional screening fence, and the limited lot size; approval to Section 53.H.l.c requiring landscape parking islands to be ten (10') feet due to the special condition being the limited lot size and that the landscape percentage requirement is met in other areas as well as the front setback; approval of Section 22.H requiring forty (40') feet landscape buffer on a lower density zoning district that is adjacent, and that parking and vehicular use can be used in that buf fer based on the special condition of the limited size of the property and that a screening fence will be provided to the west. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Thompson, Nays: None Absent: Waldrip, Migbie, Giffin, Hinson, Hobbs IM Danny Thompson, Superintendent for Gemcraft Homes spoke and explained that they have planned a two story home to have a smaller pad, and will do extensive landscaping in the front. Joy Carroll stated that Staff recomne-nds approval in order to save a tree. With no one else to speak either for or against the request, Charles Giffin made a motion to close the Public Hearing. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Board of Zoning Ad' s June 1, 1987 Page 3 Charles Giffin made a motion that a special condition does exist on the property. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Robert Hinson made a motion that the special conditions that exist are that the trees are old and established and the neighborhood and lot would be better if the variance is granted according to Grapevine Zoning Ordinance 82-73, Section 15.G.2. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy The next two items of new business was for the Board of Zoning Adjustment to consider BZA 87-40 and BZA 87-41, submitted by Bill Frazier and Scott Frazier, who are asking for exceptions to Grapevine Zoning Ordinance 82-73, Section 15.G.2, single family, twenty-five (25') foot rear yard requirements and to Section 42.C.3 which requires accessory structures to be ten (10') feet from the main structure. The garage at 2801 Live Oak, Lot 10, Block 5, Western Oaks, is encroaching nineteen (19') feet into the rear yard setback and for 2854 Tin-Lberhill Drive, Lot 15, Block 8, Western Oaks, there is an eighteen (18') foot encroachment. Bill Frazier spoke and explained that the covered breezeways were not shown on the plot plan at the time the permits were issued and was not aware of the requirements for breezeways. Mr. Frazier also stated that Staff also was not aware of the problem at the time of the final inspection. Joy Carroll stated that the houses are completed and occupied and that Staff recommends approval, noting the expense to relocate electrical conduit. After further discussion, Don Bigbie made a motion to close the Public Hearing. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Don Bigbie made a motion that the property in question does have a special condition. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Don Bigbie stated that special conditions do exist due to a mistake that took place and was not picked up by the owner, builder or City Staff and to correct the mistake, would create a hardship and that the variance be granted to Grapevine Zoning Ordinance 82-73, Section 15.6.2, requirements to the twenty-five (25) foot rear yard setback for BZA 87-40. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Tim Hobbs made a motion that there is a special condition that exists for BZA 87-41. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Board of Zoning Adjustments June 1, 1987 Page 4 Don Bigbie stated that the special condition that exist was not intentional by the builder and that the City did not pick up on the problem at the time of the final inspection and that a variance be granted to Grapevine Zoning Ordinance 82-73, Section 15.G.2; and a variance to Section 42.C.3 is not needed, allowing a twenty-five (25') foot rear yard setback for BZA 87-41. Charles Giffin seconded the motion which prevailed • the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Both BZA 87-40 and BZA 87-41 variance requests were granted. The last item of new business was for the Board of Zoning Adjustment to consider BZA 87-41, submitted by La Donna Bennett, who is asking for exceptions to Grapevine Zoning Ordinance 82-73, Section 13.G.3 for an eight (81) foot exception to the required fifteen (15') foot side yard for property located at Lot 1, Block 3, Western Oaks Subdivision. Mr. Bennett spoke and stated that they had purchased the lot and the house they had chosen to build would • over the building line about eight (8') feet on the required fifteen (15') side yard. He also stated that they were unaware of the problems with the house being over the building line and that the lot was irregular shaped and sloped which makes it difficult for a house to fit. Charles Giffin made a motion to close the Public Hearing. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Tha-apson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Charles Giffin made a motion that a special condition does exist. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy Charles Giffin stated that the special conditions that exist are the narrow lot for the size of the house versus depth, and the fact that the surrounding houses will have smaller side yards, and made a motion that the exception to Grapevine Zoning Ordinance 82-73, Section G.3 be granted for the eight (8') foot exception to the fifteen (15') foot side yard requirements. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Hinson, Hobbs Nays: None Abstain: Thompson Absent: Waldrip, Troy David Washington spoke to the Board and explained that he had presented a zoning change request to the Council for the property located east of Highway 121 and north of Hall Johnson Road to be rezoned from "R-TH", Board of Zoning Adjustments June 1, 1.987 Page 5 Townhouse to "R-5.011, Zero Lot Line. Mr. Washington explained that variances from the side yard requirements, from one (11) foot to six (6®) foot were needed. Gerald Thompson stated that the Board was not allowed to legislate for a whole subdivision. There was further discussion among members of the Board and the City Attorney. MINUTES Board of Zoning Adjustment to consider minutes of the May 4, 1987 meting. Charles Giffin made a motion to accept the minutes of the May 4, 1987 meeting as written. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Thompson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy With no further discussion, Don Bigbie made a motion to adjourn the meting. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thanpson, Bigbie, Giffin, Hinson, Hobbs Nays: None Absent: Waldrip, Troy The meeting was adjourned at 7:15 P.M.
