The Board of Zoning Adjustment for the City of Grapevine, Texas, met in
regular session on Monday evening, September 14, 1987, in the Council
Chambers, #205, 307 West Dallas Road, Grapevine, Texas, with the following
members present, to wit:
Bill Waldrip Chairman
Charles Giffin Secretary
Robert Hinson First Alternate
Tim Hobbs Second Alternate
constituting a quorum, with Vice-Chairman, Don Bigbie, and Member Gerald
Thompson absent. Also present was City Council Representative, Gil
Traverse, and Adrienne Leonard, Attorney from the City Attorney's Office.
The following City Staff was also present to wit:

CALL TO ORDER
Chairman Bill Waldrip called the meeting to order at 6:00 P.M.
The first item of new business was for the Board of Zoning Adjustment to
consider BZA 87-51, submitted by Larry Ingram who is requesting a variance
from Grapevine Zoning Ordinance 82-73, Section 15.G.1, which requires a
thirty (30') foot front yard setback for a house located at 2923 Chris
Lane, legally described as Lot 12, Block 2, Harwell Addition, Phase II.
The house has a six (6") inch encroachment.
Larry Ingram, of 505 Atkerson lane, Euless, Texas, and applicant, took the
Oath of Truth and explained that when the building line was measured, the
foundation contractors placed the brick ledge board on the wrong side of
the string which off-set the foundation six (6") inches. Mr. Ingram stated
that he was not aware of the encroachment until the house had sold and the
encroachment showed up on the survey.
With no one else to speak either for or against the request, Charles Giffin
made a motion to close the Public Hearing. Robert Hinson seconded the
motion which prevailed by the following vote:
Ayes: Waldrip, Giffin, Hinson, Hobbs
Nays: None
Absent: Bigbie, Thompson
Robert Hinson then made a motion that a special condition does exist, that
being the structure already exists, there was an oversite, and removal of
this condition would be damaging to the structure. Tim Hobbs seconded the
notion which prevailed by the following vote:
Ayes: Waldrip, Giffin, Hinson, Hobbs
Nays: None
Absent: Bigbie, Thompson
Robert Hinson made a motion to approve BZA 87-51 to allow for a six (6")
inch encroachment of the building line. Tim Hobbs seconded the motion
which prevailed by the following vote:
Ayes: Waldrip, Giffin, Hinson, Hobbs
Nays: None
Absent: Bigbie, Thompson
The next item of new business was for the Board of Zoning Adjustment to
consider BZA 87-52, submitted by Walter P. Moore & Associates who is
requesting variances to Section 56 - Parking Requirements, and Section 58 -
Loading Standards, which would allow 15 fewer parking spaces then the
requirements stipulated by Section 56.0 which requires one (1) space for

City Council Representative, Gil Traverse, stated that there should not Wx
any problem with the City Council concerning the parking procedures.

made a motion to close the Public Hearing. Robert Hinson seconded the
motion which prevailed by the, following vote:
Ayes: Wald-rip, Giffin, Hinson, Hobbs
Nays: None
Absent: Bigbie, Thompson

Votto, applicant,
took the Oath • Truth and
stated that he had
bought
the house three and
one-half years ago which he was the third or
fourth
owner of the house.
Mr. Votto stated that he
started re inancing
during
the summer and the
refinancing could not be
completed until a
variance was granted for the
encroachment at one corner
of the house which
he feels the house was measured to be parallel with
the contour of the
street.

With no one to speak either for or against the request, Robert Hinson made
a motion to close the Public Hearing. Charles Giffin seconded the motion
which prevailed by the following vote:
Ayes: Waldrip, Giffin, Hinson, Hobbs
Nays: None
Absent: Bigbie, Thompson
Tim Hobbs made a motion that a special condition does exist due to the age
of the residence and the undue expense it would cost the owner to comply
with the ordinance. Robert Hinson seconded the motion which prevailed by
the following vote:
Ayes: Waldrip, Giffin, Hinson, Hobbs
Nays: None
Absent: Bigbie, Thompson
Tim Hobbs made a motion to approve the variance to Grapevine Zoning
Ordinance 82-73, Section 15.G.1, to allow a front yard setback of
twenty-five (25) feet for BZA 87-53. Robert Hinson seconded the motion
which prevailed by the following vote:
Ayes: Waldrip, Giffin, Hinson, Hobbs
Nays: None
Absent: Bigbie, Thompson

The last item of new business was for the Board of Zoning Adjustment to
consider BZA 87-55, submitted by Robin Rhodes, who is requesting a
temporary exception to Grapevine Zoning Ordinance 82-73, Section 56.C.,
which requires two off-street parking spaces for single family residential
homes. Mr. Rhodes has submitted an application to temporarily convert half
of his garage for an office with the stipulation to return that space to
meet off-street parking requirements following a date set by the Board if
the temporary variance is allowed. Staff recommends denial being that this
variance might set a precedent by allowing temporary variances.
Mr. Rhodes, applicant, took the Oath of Truth and explained that he will be
taking his CPA test in May of 1988 and needs a quite place to study since
he has small children. He explained that he closed in half of his garage
with an interior wall with electrical and mechanical work installed.
Jim Lucas, of 1915 Everglade, Grapevine, Texas, took the Oath of Truth and
stated that the work Mr. Rhodes has done is not visible from the street and
recommends approval.
Joy Carroll read into the record a letter from Dale and Judith Usternul of
1928 Everglade, stating their approval of the variance.
With no one else to speak either for or against the request, Tim Hobbs made
a motion to close the Public Hearing. Robert Hinson seconded the motion
which prevailed by the following vote:
Ayes: Waldrip, Giffin, Hinson, Hobbs
Nays: None
Absent: Bigbie, Thompson
During discussion Bill Waldrip stated how much of a strain it would be for
the City to keep up with temporary variances.
After further discussion, Tim Hobbs made a motion stating that a special
condition does not exist based upon the difficulty in applying for a
conditional temporary type of variance and that it would be a burden on the
City in trying to enforce it. Charles Giffin seconded the motion which
prevailed by the following vote:
Ayes: Waldrip, Giffin, Hobbs
Nays: None
Abstain: Hinson

Tim Hobbs then made a motion to deny case BZA 87-55, Grapevine Zoning
ordinance 82-73, Section .. requires two off-street parking spaces
for single family. Charles Giffin seconded the motion which prevailed •
the following vote:
Ayes: Waldrip, Giffin, Hobbs
Nays: None
Abstain: Hinson
Absent: Bigbie, Thompson
There was discussion • what Mr. Thakor Shah had done • his Board •
Zoning Adjustment case which was heard • August 3, 1987. Joy Carroll
stated that Mr. Shah would be coming in the office soon to discuss tht-
situation with Mr. Hardy.
Council Representative, Gil Traverse, asked Staff to obtain deed
restrictions to see what is allowed or disallowed.

MEETING.
Charles Giffin made a motion to accept the minutes of the August 3, 1987
meeting as written. Tim Hobbs seconded the motion which prevailed by the
following vote:
Ayes: Waldrip, Giffin, Hinson, Hobbs
Nays: None
Absent: Bigbie, Thompson

With no further discussion, Charles Giffin made a motion to adjourn the
meeting. The meeting was adjourned at 6:55 P.M.
