POSTED ON t 2ND DAY OF OCTOBER, 1987 A 10 '' i • $ • • • • I ! ii • '" Iii �w I W WIAMIKEO) The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session on Monday evening, at 6:00 P.M., October 5, 1987, in the Conference Room, #204, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Don Bigbie Charles Giffin Gerald Thompson Robert Hinson Tin Hobbs Becky Swann Vice-Chairman Secretary Member Member 1st Alternate 2nd Alternate constituting a quorum, with Chairman, Bill Waldrip, absent. Also present for part of the meeting was Council Representative, Gil Traverse, and Toby Barthalow, Attorney, from the City Attorney's office. The following City Staff was also present to wit: Joy Carroll Administrative Assistant Gerrie Taylor Secretary CALL TO ORDER Vice Chairman, Don Bigbie, called the meeting to order at 6:00 P.M. OATH OF OFFICE Gerrie Taylor, City Staff Secretary to the Board, issued the Oath of Office to 2nd Alternate, Becky Swam. NEW BUSINESS BZA 87-58, MICHAEL PALPAY1 The first item of new business was for the Board of Zoning Adjustment to consider BZA 87-58, submitted by Michael Palpant who is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 15.G.1, which requires a thirty foot (30') front yard setback for an existing residence located at 911 Riverside Drive, legally described as Lot 11-B, Block L of the Woods Addition, Phase III. The site survey submitted indicates a four foot, eight inch (418") encroachment. Michael Palpant of 203 Starnes, Grapevine, Texas, and applicant, took the Oath of Truth and stated that when the forms were set up, they were not measured from the closet point. With no one else to speak either for or against the request, Charles Giffin made a motion to close the public hearing. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thompson, Hinson, Hobbs Nays: None Absent: Waldrip After further discussion, Robert Hinson made a motion that a special condition does exist for BZA 87-58 based on the house is already existing, it would be impracticable to move, it was an honest mistake, and that the string line inspections that have been implemented will catch this kind of mistake in the future. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thompson, Hinson, Hobbs Nays: None Absent: Waldrip Robert Hinson made a motion that the variance for BZA 87-58, allowing a 4'8" variance in the front setback be granted to Grapevine Zoning Ordinance 82-73, Section 85.G.1. Tim Hobbs seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thompson, Hinson, Hobbs Nays: None Absent: Waldrip Board of Zoning Adjustment October 5, 1987 Page 2 The next item of new business was for the Board of Zoning Adjustment to consider BZA 87-59, submitted by Blagg & Powers Goodyear who is requesting a variance to Section 60, Sign Standards, Subsection G.1, which prohibits a pole sign in the Central Business District, but according to Section 43.E.3, Non-Conformaing Uses and Structures, the Board of Zoning Adjustment has the ability to approve the remodeling of a non-conforming use or structure. Joy Carroll stated that the applicant is wanting to add a three foot-nine inch (3'9") X sixteen foot (16') panel below the existing and non - conforming twenty-seven foot (27') by five foot (5') Goodyear sign atop a thirty (30') foot pole located at 604 Main Street. Gary Blagg of 520 Ridge Road, and applicant took the Oath of Truth anol explained that the additional sign will advertise that the business "Certified Auto Center" which was one out • ten chosen for a radio com-nercial. Mr. Blagg explained that he will be upgrading the store ani the existing sign. Shane Wilbanks of 2326 Forest Hills Road, Grapevine, Texas, took the Oath of Truth and stated that he feels if the additional sign is installed, it will help the public know about the store and expressed that the Board of Zoning Adjustment consider the request. Gil Traverse, City Council Representative, took the Oath of Truth and stated that the City Council is in the process of trying to improve the Sign Ordinance and expresses approval of the variance. Joy Carroll read a letter into the record from Edgar Kennedy of 221 W. College Street, Grapevine, Texas, stated approval of the variance. With no one else to speak either for or against the request, Gerald Thompson made a motion to close the Public Hearing. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thompson, Hinson, Hobbs Nays: None Absent: Waldrip There was discussion among the members that the additional sign would improve the looks of the existing sign but there was concern with the maintenance and appearance of the exciting sign. Charles Giffin made a motion that a special condition does exist. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Tharpson, Hinson, Hobbs Nays: None Absent: Waldrip Charles Giffin made a motion that the special condition existing is the fact that the current pole sign already exists, the sign is a non-conforming use and that based on the configuration and architect of the building, a wall mounted sign would detract more than enhance the building and the variance being requested to Grapevine Zoning Ordinance 82-73, Section 60.G.1, Sign Standards allowing the additional of the new sign be granted. Gerald Thompson seconded the motion but suggested the existing poles be improved. After further discussion, Tin Hobbs made a moved to amend the motion to state that the exact size of the sign is the maximum variance that will be allowed. Gerald Thompson seconded the amended motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thonpson, Hinson, Hobbs Nays: None Absent: Waldrip ffi - :M i• The next item of new business was for the Board • Zoning Adjustment to consider BZA 87-60, submitted by Robert Price who is requesting variances from Grapevine Zoning Ordinance 82-73, Section 15.G.2 &3, "R-7.5", Single Family District Regulations for a fourteen (14') foot encroachment into the required twenty-five (25') foot rear yard and a two (2') foot encroachment Board of Zoning Adjustment October 5, 1987 Page 3 into the required six (6) foot side yard for 2947 Canyon, legally described as Lot 13, Block 9, Oak Creek Subdivision. The applicant, Mr. Price was not present. Arnold Townsend, of 2946 Wentwood, Grapevine, Texas, took the Oath of Truth and stated that he lived directly behind Mr. Price and was concerned about the structure being visibly close to his backyard and feels the structure would change the appearance of the neighborhood. Bill Martin, of 2940 Wentwood, Grapevine, Texas, took the Oath of Truth and stated that he also lived catycorner behind Mr. Price and feels the structure will be obstrusive to his well being and backyard and is in opposition of the request. Tommy Hardy explained that the Bylaws state that the Board can deny the case and it would be a year before the applicant could re-apply, and that the Board also has the ability to deny the variance for lack of prosecution which the applicant could re-file the case at any time. Robert Hinson made a motion to close the Public hearing. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thompson, Hinson, Hobbs Nays: None Absent: Waldrip Gerald Thompson made a motion to deny the variance because of lack of prosecution. Tim Hobbs seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thompson, Hinson, Hobbs Nays: None Absent: Waldrip The last item of new business was for the Board of Zoning Adjustment to consider BZA 87-61, submitted by Bob Lindley who is asking for variances for property located at 515 E. Northwest Highway which is developed and non-conforming to the present Zoning Ordinance. The variances needed are contingent upon the rezoning decision by the Planning and Zoning Commission and City Council from "CC", Community Commercial to "W', Highway Commercial. Tommy Hardy stated that Planning and Zoning earlier in the evening denied the zoning and City Council upheld their decision. Mr. Hardy explained that the Planning and Zoning Commission will consider an-ending the "CC", Community Commercial District to allow for body shops. Robert Hinson made a motion to close the Public Hearing. Gerald Thompson seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thompson, Hinson, Hobbs Nays: None Absent: Waldrip Tim Hobbs made a motion to BZA 87-61 to deny consideration because it is outside of the Board's jurisdiction. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thompson, Hinson, Hobbs Nays: None Absent: Waldrip MISCMA'NEOUS REPORTS AND/OR DISCUSSIONS Joy Carroll stated that Mr. Shaw, who had previously been before the Board had not gotten in touch with Mr. Hardy about his case, concerning the enclosure of his garage and off-street parking for R-7.5, Single Family District Regulations.
