THE BOARD OF ZONING ADJUSTMENT SPECIAL WORKSHOP AGENDA WAS PREPARED AND POSTED ON THIS THE FIRST DAY OF APRIL, 1988, AT 5 PM. C7' �I Director of Conmunit Development The Board of Zoning Adjustment for regular session on Monday, April 4, Chambers, #205, 307 West Dallas Road, members present to wit: Don Bigbie Robert Hinson Charles Giffin Gerald Thompson Tim Hobbs Becky Swann Raymond Truitt the City of Grapevine, Texas met in 1988, at 6:00 P.M., in the Council Grapevine, Texas, with the following Chairman Vice-Chairman Secretary Member Meinber 1st Alternate 2nd Alternate constituting a quorum, with Council Representative, Gil Traverse, and City Attorney, Chris Caso present. The following City Staff was also present to wit: H. T. (Tommy) Hardy Director of Community Development Joy Carroll Administrative Aide Gerrie Taylor Administrative Secretary The meting was called to order at approximately 6:00 P.M. BOARD OF ZONING ADJUSTNNT SECRETARY TO SIGN MINUTES APPROVED AT PAST =INGS. Joy Carroll announced that this item of old business would be addressed at the next regular meeting. MENMEORM Since there was no one present to represent the case, Chairman, Bigbie, stated they would postpone it until later in the meeting in case the applicant should arrive. • :: -t, . . # • W U1 The next item of new business was for the Board of Zoning Adjustment to consider BZA 86-06, submitted by Bear Run Joint Venture, who is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 25.F.2 which requires a rezoning request for "CC", Community Commercial, to be a minimum of five (5) acres for the property located at Bear Run and W. D. Tate Avenue. The applicant is requesting the variance to allow a 4.257 acre tract to become "CC", Community Commercial. Joy Carroll stated that Staff recommended approval because the applicant requested to increase the commercial acreage in redesigning Bear Run Drive, to bring it into conformance with City Standards for it to be accepted for dedication. Joy Carroll also stated that the applicant prefers not to further expand the community commercial acreage (to met the 5 acre minimum district requirement) because it would expand into the flood plain area. Troy Fuller, of 3607 Softwind Ct., Grapevine, Texas, took the Oath of Truth and explained how this property had been rezoned in 1984 to "CC", Community Commercial from Site Plan zoning. When the rezoning took place, this tract did not meet the 5 acre minimum, so the City Council and Planning and Zoning Commission approved the zone change, following BZA variance approval to the 5-acre requirement, to meet the Ordinance. Mr. Fuller stated that the zone change is for everything south of Bear Run Drive to be "R-TH", Townhouse, and property along the freeway be zoned "CC", Community Commercial. Joy Carroll stated that City Council did approve the zoning on the 1st reading of the Ordinance on March 15, 1988 and that BZA approval is needed tonight before the City Council can act on the final reading. Board of Zoning Adjustment April 4, 1988 Page 2 With no one else to speak for or against the case, Charles Giffin made a motion to close the Public Hearing. Tim Hobbs seconded the motion which prevailed by the following vote: Ayes: Bigbie, Hinson, Giffin, Thompson, Hobbs Nays: None Absent: None Tim Hobbs moved that a special condition does exist. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Bigbie, Hinson, Giffin, Thompson, Hobbs Nays: None Absent: None Tim Hobbs made a motion that due to the special condition, which is a better use for the land the way it is laid out and due to the problems with the road in restructuring it, that a variance be granted to Grapevine Zoning Ordinance 82-73, Section 25.F.2 to reduce the 5 acre minimum to 4.257 acres. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Bigbie, Hinson, Giffin, Thompson, Hobbs Nays: None Absent: None Although the applicant had still not shown up, Charles Giffin made a motion to consider the case without the applicant. Becky Swann seconded the motion. This item of new business was for the Board of Zoning Adjustment to consider BZA 88-05, submitted by Mr. Robert Miron, who is requesting a variance from Grapevine Zoning Ordinance 82-73, Section 15.G.1 and 3 which requires a thirty (30') foot front yard and a six (6) foot side yard in the "R-7.5", Single Family Residential Zoning District, allowing a seven foot-eight inch (8'8") front yard encroachment and a six foot (6') side yard encroachment for the property located at 409 East Worth Street, legally described as Lot 4, Block 34, Original Town of Grapevine. Joy Carroll stated that this was a request for a typical encroachment in the older part of Grapevine in order to receive financing on the property. She also explained that the garage apartment sits six feet (6') into the required six foot (6') side yard requirement. The garage also extends into the City of Grapevine easement. Tcmy Hardy stated that if the Board grants the variance, they are not authorizing the encroachment into the adjoining lot in which that would be a matter between the property owners to resolve. With no one to speak either for or against the case, Charles Giffin made a motion to close the Public Hearing. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Bigbie, Hinson, Giffin, Thompson, Hobbs Nays: None Absent: None Gerald Thompson made a motion that a special condition does exist. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Bigbie, Hinson, Giffin, Thompson, Hobbs Nays: None Absent: None Gerald Thompson made a motion that the special condition is that the building was built in the old section of -town before the ordinances were in affect and to grant the variance to Section 82-73, Section 15.G.1 and 3, allowing a six foot (6') variance for the side and an eight foot-eight inch (8'8") variance for the front setback. Charles Giffin seconded the motion which prevailed by the following vote: Board of Zoning Adjustment April 4, 1988 Page 3 Ayes: Bigbie, Hinson, Giffin, Thompson, Hobbs Nays: None Absent: None There was discussion concerning a conflict of interest mem sent to the nezdbers fran the City Attorney's office. Tommy Hardy explained that if there is a conflict of interest with any of the nembers, an affidavit needs to be filled out ahead of time. Charles Giffin inquired about Mr. Shariff's restaurant on Main Street, whether it met the masonry requirements with the new addition on the back side. Tommy Hardy explained that 700 of the building has to be bricked excluding doors and windows. Charles Giffin made a motion to approve the minutes of the February 1, 1988, meting as written. Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Bigbie, Hinson, Giffin, Thompson, Hobbs Nays: None Absent: None FATAT67FRON, A -15-N U With no further discussion, Charles Giffin made a motion to adjourn the meting.
