City Council Representative, Gil Traverse, and Adrienne Leonard, Attorney with the City Attorney's Office was also present. Also the following City Staff was present to wit: H. T. (Tommy) Hardy Director of Community Development Joy Carroll Administrative Assistant Gerrie Taylor Administrative Secretary CALL TO ORDER Chairman, Don Bigbie, called the meeting to order at 6:05 P.M. NEW BUSINESS OATH OF OFFICE Gerrie Taylor administered the Oath of Office to new Member, Don Frieden, and to the reappointed members, Don Bigbie, Charles Giffin, Gerald Thompson, Becky Swann, and Raymond Truitt. WD-16)a Chairman, Don Bigbie, asked not to be reappointed as Chairman for a second term, because of his commitments to other Boards and the time involved. Becky Swarm made a motion to nominate Gerald Thompson as Chairman. Charles Giffin seconded the motion. Charles Giffin made a motion to cease nominations. Raymond Truitt seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Swann, Truitt Nays: None Abstain: Thompson Absent: Hobbs For the office of Vice-Chairman, Charles Giffin made a motion to nominate Tim Hobbs. Don Bigbie seconded the motion. Becky Swann made a motion to cease nominations for Vice-Chairman. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Bigbie, Giffin, Thompson, Swann, Truitt Nays: None Absent: Hobbs For the office of Secretary, Raymond Truitt made a motion to nominate Becky Swann. Don Bigbie seconded the motion. Charles Giffin made a motion to cease nominations. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: B Bigbie, G BOARD OF ZONING ADJUSTMNT JULY 11, 1988 PAGE 2 NOW 0MM Joy Carroll explained how the second survey showed the encroachmnt after the setbacks had already been approved by the City. Mr. Dieter was not present but the Board went ahead and reviewed the case. Jeanette Leong, of 3806 Hillside Trail, Grapevine, Texas, took the Oath of Truth, and expressed concern about the encroachment and how it might effect the resale of her house. She explained how her back yard could have been larger if the setbacks had been measured properly. After further discussion, Don Bigbie, made a motion to close the Public Hearing. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thcmpson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Charles Giffin made a motion that a special condition does exist. Raymond Truitt seconded the motion which prevailed • the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Chairman Thompson requested that the Board skip to BZA 88-16, if there were no objections. Bunny Eklund, representing Mr. Corbelli, took the Oath of Truth and explained how the house had been in existence since 1973. When Mr. Corbelli bought the house in 1981, he did not receive a survey. When it sold a month ago, an encroachment was discovered on the survey the mortgage ccopany requested. With no one else to speak either for or against the request, Charles Giffin made a motion to close the Public Hearing. Don Bigbie seconded the motion which prevailed by the following vote: Ayes: Thmpson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs V 'ffin made a motion that a special condition does exist. Becky iarles Gi Swann seconded the motion which prevailed by the following vote: BOARD OF ZONING ADJUSTMENT JULY 11, 1988 PAGE 3 Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs Charles Giffin made a motion to grant the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1 to provide for a twenty eight foot-four inch (284") front yard setback necessitating a one foot-eight inch (1'8") variance and that the special condition is that the house is existing, the encroachment was missed on previous surveys and the problem was not created by the applicant. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs The last item of new business was for the Board of Zoning Adjustment to consider BZA 88-15, submitted by Mr. Billy McPherson who is requesting a variance to Grapevine Zoning Ordinance 82-73, Section 15.J, which requires a vehicle to be an accessory to the principle structure if parking of the vehicle is allowed in the residential districts. The request to park the truck may also be referred to in Section 15.A, B, & D. Joy Carroll explained that Mr. McPherson is requesting to park a drilling truck on his property. Mrs. Carroll also noted that Mr. McPherson had previously requested and received a variance for parking a truck in a residential district in 1983. Billy McPherson, applicant, took the Oath of Truth and explained that his lot was very large and the truck was parked in the rear of the house on an adjoining lot which he also owns. Mr. McPherson stated that he has not found any place in town to park his truck. Paul Strauss, of 3032 Thomas Ct, Grapevine, Texas, took the Oath of Truth and stated that he did not anticipate the truck's permanence and that the truck was an eyesore to his property. Mr. Strauss also stated that he had talked with several neighbors who object to the request. Brent McPherson, of 601 Park Blvd. #1302, Grapevine, Texas, took the Oath of Truth and explained that there was plenty of room in the back of the property to park the truck. With no one else to speak either for or against the request, Becky Swarm made a motion to close the Public Hearing. Charles Giffin seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs There was a question on what type of work vehicles can be parked at a residence. Tommy Hardy explained that trucks or cars that might have business names on the side and are customarily at the residence is allowed. Adrienne Leonard, Attorney, explained to the Board that the uses in different zoning districts are determined by the City Council. She also explained that the Board does not have the ability to change the use in any district and if the variance was granted then that would be amending the ordinance which would be going beyond the Board's jurisdiction. Ms. Leonard explained that Mr. McPherson could go before the City Council with the problems he is faced with and request that they address the problem. Raymond Truitt made a motion that no special condition exists. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Swann, Bigbie, Truitt Nays: Thompson, Giffin Absent: Hobbs BOARD OF ZONING ADJUSTYffM JULY 11, 1988 PAGE 4 After more discussion concerning the Board's jurisdiction, Charles Giffin made a motion to dismiss the case because the Board does not have jurisdiction to hear it. Becky Swann seconded the motion which prevailed • the following vote: Ayes: Thompson, Swann, Bigbie, Giffin Nays: Truitt Absent: Hobbs 1016gammang 11 RUN== since the f irst Monday • Septent)er falls on the 5th which is Labor Day, Tommy Hardy suggested holding the Board of Zoning Adjustment meeting the 6th which will be right before the City Council meeting. The Board Mo�bers had no problem with meeting September 6, 1988, at 6:00 P.M. FAUKLUM Charles Giffin made a motion to accept the minutes of the June 6, 1988, meeting as written. Becky Swam seconded the motion which prevailed by the following vote: Ayes: Thompson, Swann, Bigbie, Giffin, Truitt Nays: None Absent: Hobbs The meeting was adjourned at approximately 8:00 P.M.
