The Board of Zoning Adjustment for the City of Grapevine, Texas, met in
regular session, August 1, 1988, at 6:00 P.M., at 307 West Dallas Road, in
the Council Chambers, #205, Grapevine, Texas, with the following members
present to wit:
Gerald Thompson
Tim Hobbs
Becky Swann
Don Bigbie
Charles Giffin

constituting a quorum with City Council Representative, Gil Traverse also
attending. The following City Staff was also present to wit:

Chairman, Gerald Thompson, called the meeting to order at approximately
6:05 P.M.

The first item of new business was for the Board of Zoning Adjustment to
consider BZA 88-17, submitted by Mr. Marvin C. Dearing who is requesting a
variance to Grapevine Zoning Ordinance 82-73, Section 60.K.5.a, which
requires a ten foot (10') front yard setback for pole signs. The existing
sign, located at 520 East Northwest Highway, is set five feet (5') from the
property line which is the amount of variance required.
Mr. Dearing, applicant, took the Oath of Truth, and explained that the sign
has been there for 35 years, and that it does not block the view of any
traffic. Mr. Dearing stated that if the sign was moved back the required
10 feet, it would create a problem with customers pulling in and out of the
station.
Joy Carroll noted that Mr. C.C. Hall, Jr., a property owner within 200 feet
of Mr. Dearing's property, had sent a letter of approval.
With no one else to speak either for or against the request, Becky Swann
wade a motion to close the Public Hearing. Tim Hobbs seconded the motion
which prevailed by the following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None
After further discussion, Becky Swann made a motion that a special
condition does exist. Don Bigbie seconded the motion which prevailed by
the following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None
Becky Swann made a motion that the special condition is that the tract is
developed and the sign is existing. Don Bigbie seconded the motion which
prevailed by the following vote:
Ayes: Thompson, Hobbs, Swam, Bigbie, Giffin
Nays: None

Becky Swann made a motion to grant the variance to Grapevine Zoning
Ordinance 82-73, Section 60.K.5.a, allowing a five foot (5) variance for
the sign setback. Don Bigbie seconded the motion which prevailed by the
following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None

Janet Morbeck, took the Oath of Truth, and stated that she and her husband
purchased the hom in June, 1988, at the time a survey was taken, showing
the side of the garage being 5.7 feet instead of the required six feet
W). Mrs. Morbeck stated that they wanted to go ahead and get a variance
for possible future owners.
With no one to speak either for or against the request, Tim Hobbs made a
motion to close the Public Hearing. Don Bigbie seconded the motion which
prevailed by the following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None
Tim Hobbs made a motion that a special condition does exist® Charles
Giffin seconded the motion which prevailed by the following vote:

Tim Hobbs then made a motion that since the house is already existing, to
grant the variance to Grapevine Zoning Ordinance 82-73, Section 15.G.3, to
allow for a 5.7 foot side yard instead of the required six foot. Charles
Giffin seconded the motion which prevailed • the following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None

Joy Carroll explained that the applicant is wanting to erect a screening
fence along Wall Street in lieu • landscaping.

There was discussion among the members about the applicant modifying the
site Plan to comply with the City's regulations.
With no one else to speak either for or against the case, Don Bigbie made a
Motion to close the Public Hearing. Charles Giffin seconded the motion
which prevailed by the following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None
Don Bigbie then made a motion that no special condition exists. Becky
Swann seconded the motion which prevailed by the following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None
Becky Swann made a motion to deny BZA Case 88-20. Don Bigbie seconded the
motion which prevailed by the following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None
The last item of new business was for the Board of Zoning Adjustment to
consider BZA 88-21, submitted by Fox and Jacobs, who is requesting a
variance to Grapevine Zoning Ordinance 82-73, Section 15.G.2, which
requires a twenty-five foot (25) rear yard setback. The applicant is
asking for a one foot-nine inch (119") rear yard variance for 2700 Harmon
Drive, legally described as Lot 48, Block 1, of the Town Park Addition.
Joy Carroll stated that Staff recommends denial of the request because they
feel there is ample lot area for a reasonable sized house.
Tom Houser, Production Manager for Fox and Jacobs, took the Oath of Truth,
and stated that the lot is sold and the owners do not wish to choose
another lot or house plan.
With no one to speak either for or against the request, Tim Hobbs made a
motion to close the Public Hearing. Charles Giffin seconded the motion
which prevailed by the following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None
Charles Giffin commented that he felt the house plans could be modified to
meet the requirements.
After further discussion, Becky Swann made a motion that no special
condition exists. Don Bigbie seconded the motion which prevailed by the
following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None
Becky Swann then made a motion to deny BZA Case 88-21. Don Bigbie seconded
the motion which prevailed by the following vote:
Ayes: Thompson, Hobbs, Swann, Bigbie, Giffin
Nays: None
Absent: None
Tommy Hardy explained to the Board that with side and rear yard variances,
where there is a mistake involved, Staff usually supports the variance.

Gerald Thompson inquired about BZA Case 88-18, and if the Inspector missed
measuring properly for the garage.
To Hardy explained that surveyors set the property pins and the
Inspectors measure the foundations from string lines set up from the
property pins.
