The Board of Zoning Adjustment for the City of Grapevine, Texas, met in
regular session, September 6, 1988, at 6:00 P.M., in the Conference Room
#204, 307 West Dallas Road, Grapevine, Texas, with the following members
present to wit:

was Gil Traverse, City Council Representative, and the following City Staff:

Vice Chairman, Tim Hobbs, called the meting to order at 6:05 P.M.

The first item of new business was for the Board of Zoning Adjustment to
consider BZA 88-19, submitted by Doyle and Arlene Dickerson who is
requesting variances for 627 Bellaire Drive.
Joy Carroll stated that Staff recommnded approval for the variance to
Grapevine Zoning Ordinance 82-73, Section 16.6.5, which requires a 100 foot
lot depth for the "R-5.0" Zoning District, because the existing lot is 95
feet deep, requiring a 5 foot variance; approval to Section 16.H which
requires a 40 foot buffer strip; approval to Section 42.F.5, which requires
20 feet between the garage door and the property line, making the variance
five feet, allowing a 15 foot setback; and denial to the variance to
Section 16.F.6, which requires a 1200 square foot floor area, and allowing
1008 square feet instead, a 192 square foot variance. Joy Carroll also
explained that the variances will be needed if the second reading of the
rezoning request from the "R-TH", Town House to "R-5.0", Zero Lot Line is
approved later that evening by the City Council and Planning and Zoning
Commission. The first reading of the rezoning request was approved by the
Council August 16, 1988.
Fred Joyce, of 1017 W. D. Tate Avenue, and builder, took the Oath of Truth,
and explained that the Dickerson have owned the lot since 1971 and to
build a house any larger, a large pecan tree would. have to be removed. Mr.
Joyce stated that they are requesting "R-5.0" because the lot would not be
big enough to build a two-unit townhouse.
Because most of the houses in that area are frame, some of the members felt
that a frame house would fit in better than all brick.
Fred Joyce stated that they would rather build a frame house but did not
apply for a variance to the masonry requirements.
With no one else to speak either for or against the request Charles Giffin
made a motion to close the Public Hearing. Don Bigbie seconded the motion
which prevailed by the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Thompson
The Board suggested tabling the case so the applicant could apply again for
a variance to the masonry requirements. Chris Caso reminded the Board that
the second reading from the Planning and Zoning Commission later tonight
would also have to be tabled.

After further discussion, Raymond Truitt made a motion that a special
condition exists. Charles Giffin seconded. the motion which prevailed •
the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Thompson
Raymond Truitt made a motion that the special condition is due to the fact
that the lot was there prior to the 1984 City rezoning which applied
Townhouse, zoning to the area, and that the "R-TH" restrictions
cannot be met with the existing lot size. Charles Giffin seconded the
motion which prevailed • the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt

Becky Swann then made a motion to approve the variance to Grapevine Zoning
Ordinance 82-73, Section 16.G.5 which requires a 100 foot lot depth, th-

prevailed by the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None

Raymond Truitt made a motion to approve the variance to Grapevine Zoning
Ordinance 82-73, Section 16.H which requires a 40 foot buffer strip next to
a single family residential district. Charles Giffin seconded the motion
which prevailed • the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Thompson
Raymond Truitt made a motion to grant the variance to Grapevine Zoning
Ordinance 82-73, Section 42.F.5, which requires 20 feet between the garage
door and the property line, making the variance five feet, allowing a 15
foot setback in the interest of saving a 100 year old Pecan tree. Charles
Giffin seconded the motion which prevailed by the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Thompson

The next item of new business was for the Board of Zoning Adjustment to
consider BZA 88-22, submitted by Moretti's Italian Cuisine, who is
requesting several variances for 2709 Mustang Drive in order to meet the
site plan requirexcients of the Conditional Use Permit that was also applied
for.

Joy Carroll noted that the first reading of the Conditional Use Ordinance
was September 6, 1988 by the Council and P & Z, and the second reading will
be heard tonight contingent on approval of the variances.
The variances being requested are to Grapevine Zoning Ordinance 82-73,
Sections 24.F.1 which requires a .20 floor area ratio, a .09 variance is
needed; Section 4.F.4 which requires 1 acre minimum district size for the
"CN" District, a 8,080.38 square foot variance is needed; Section 24.F.3
which requires 200 of the lot to be landscaped, an 18% variance is needed;
Section 24.F.6 which allows a maximum 80% impervious area, an 18% variance,
is needed; Section 24.G.3 requires a 25 foot front yard landscaped setback;
Section 24.G.5 requiring a 25 foot rear yard, a 14 foot variance is needed;
Section 24.H requiring a buffer equal to the height of any building
adjacent to a residentially zoned district, a 10 foot-8 inch variance is
needed on the east side and a 14 foot variance is needed on the south side;
Section 24.M.4 and 53 requiring a landscaped buffer screen; Section 24.K
requiring a five foot landscaped. buffer when parking abuts a property line,
a five foot variance is needed; Section 53.H and 53.1 which requires
special landscape requirements, none is provided; and to Sections 56.C.5
and 56.C.3 requiring I space for every 200 square feet for retail and 1
parking space for every 3 seats plus five, 45 spaces are provided.
Charles Giffin stated. that he had no probleins, with the variances but did
not want the variances to be permanent on the property.
Chris Caso suggested putting stipulations concerning a time frame in the
motion.
Since there was no one present to speak representing Moretti's Italian
Restaurant, Becky Swann made a motion to close the Public Hearing. Don
Bigbie seconded the motion which prevailed by the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Thompson
After further discussion, Charles Giffin made a motion that a special
condition does exist and the condition is that the tract was developed
prior to the 1984 City rezoning. Don Bigbie seconded the motion which
prevailed by the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None

Becky Swann made a motion to grant the variances to Grapevine Zoning
Ordinance 82-73, Section 24.F.1, the variance being .09 ratio; Section
24.F.3, requiring 200 of the lot to be landscaped, a 18% variance; Section
24.F.4, granting a 8,080.38 square foot variance; Section 24.F.6, requiring
80% impervious area, allowing for an 18% variance; Section 24.G.3, granting
a 100% variance to the required 25 foot front yard landscaped setback;
Section 24.G.5, granting a 14 foot variance to the required 25 foot rear
yard setback; Section 24.H, granting a 10 foot-8 inch variance on the east
side and a 14 foot variance on the south side to the buffer requirements;
Section 24.M.4 and Section 53, granting a 100% variance to the landscaped
buffer screen; Section 24.K, allowing a five foot variance to the five foot
landscaped buffer when parking abuts a property line; Section 53.H and
Section 53.1, allowing a 100% variance to the special landscape
requirements; Section 56.C.5 and 56.0.3 to the parking requirements, which
the present provides 45 spaces, and Becky Swann also made a motion
requiring that these variances shall exist only as long as the existing
improvements remain. Charles Giffin seconded the motion which prevailed by
the following vote:

The next item of new business was for the Board of Zoning Adjustment to
consider BZA 88-23, submitted by D. T. Construction who is requesting a six
inch variance to Grapevine Zoning Ordinance 82-73, Section 15.G.1, Single

Family Zoning District Regulations which requires a 30 foot front yard
setback for the house at 1724 Altacrest Drive, legally described as Lot 2,
Block 2, Glade Landing Subdivision.
Mike Herndon, of 7708 Sabel, North Richland Hills, Texas, took the Oath of
Truth and stated that the house is two years old and has been used as a
model home. He explained that the house as been sold and the variance is
needed because it sets approximately 1/2 foot off the front yard setback.
With no one else to speak either for or against the request, Charles Giffin
made a motion to close the Public Hearing. Don Bigbie seconded the motion
which prevailed by the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None

Charles Giffin then moved that a special condition exists and the special
condition being that the house is existing. Don Bigbie seconded the motion
which prevailed by the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt

Don Bigbie made a motion to approve the variance to Grapevine Zoning
ordinance 82-73, Section 15.G.1, allowing for a 6 inch variance. Becky
Swann seconded the motion which prevailed by the following vote:

The next item of new business was for the Board of Zoning Adjustment to
consider BZA 88-2/,L� submitted by Carswell Federal Credit Union, who is
requesting needed variances so that the existing non-conforming development
may comply with current zoning ordinance requirements for the construction
of a drive through adjacent and north of the building.
Don Bigbie made a motion to table BZA Case #88-24 until the October 3,
1988, meeting. Charles Giffin seconded the motion which prevailed by the
following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Thompson
The last item
Joy Carroll explained that because of the distance between the t%K)
residences and because the Maness' cannot utilize their rear yard for a
pool due to the excessive drainage easemnt, they have requested a variance
to the side yard requirements to construct their pool. Joy stated that the
pool would encroach into the side yard 14 feet, necessitating an 11 foot
variance.

Mark Maness, of 1519 Brookwood Drive, Grapevine-, Texas, took the Oath of
Truth and explained how they would like to be able to utilize more of their
yard and to enhance their property with the construction of a swimming pool.
With no one else to speak either for or against the request, Don Bigbie
made a motion to close the public hearing. Becky Swann seconded the motion
which prevailed by the following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Thompson
Raymond Truitt made a motion that a special condition does exist. Charles
Giffin seconded the motion which prevailed by the following vote:

Rwmond Truitt then made a motion that the special condition is because of
the excessive easement in the rear yard which limits reasonable use. Don
Bigbie seconded the motion which prevailed by the following vote:

Ra-Nm-ond Truitt made a motion to approve the variance to Grapevine Zoning
Ordinance 82-73, Section 42.D, allowing an 11 foot variance to the 25 foot
side yard setback for reverse frontage lots in the "R-5.0", Zero Lot Line
Zoning District. Charles Giffin seconded the motion which prevailed by the
following vote:
Ayes: Hobbs, Swann, Bigbie, Giffin, Truitt
