COUNTY OF TARRANT
CITY OF GRAPEVINE
The Board of Zoning Adjustment for the City of Grapevine, Texas, met in
regular session Monday, May 1, 1989, at 6:00 P.M., at 307 West Dallas Road,
Room #205, Grapevine, Texas, with the following members present to wit:
Gerald Thompson Chairman
Becky Swann Secretary
Don Bigbie Member

Raymond Truitt lst Alternate
constituting a quorum with Vice-Chairman, Tim Hobbs, and 2nd Alternate, Don
Frieden absent. City Council Representative, Gil Traverse, was also
present and the following City Staff to wit:

The meeting was called to order by Chairman, Gerald Thompson, at
approximately 6:00 P.M.
NEW BUSINESS
BZA 89-08, SUSAN ELAINE PEABODY
The first item of new business was for the Board of Zoning Adjustment to
consider BZA89-08, submitted by Ms. Susan Elaine Peabody, who is requesting
a variance from Grapevine Zoning Ordinance 82-73, Section 15.G.1, "R-7.511,
Single-Family Zoning District Regulations which requires a 30 foot front
yard setback for the existing residence located at 613 Oak Lane, Lot 22,
Block 3, Lakewood Acres. The plot plan shows a 29 foot, six inch (6")
setback, a six inch (6") variance is needed.
Joy Carroll explained that in order for the loan to qualify, the financial
institution is requesting Ms. Peabody apply for the variance.
Ms. Peabody was present to answer any questions.
With no one from the audience to speak either for or against the case,
Becky Swann made a motion to close the Public Hearing. Charles Giffin
seconded the motion which prevailed by the following vote:
Ayes: Thompson, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Hobbs, Frieden
Don Bigbie made a motion that a special condition did exist. Becky Swann
seconded the motion which prevailed by the following vote:
Ayes: Thompson, Swann, Bigbie, Giffin, Truitt

Absent: Hobbs, Frieden
Don Bigbie made a motion stating the special condition being that the house
is existing, and recommends granting an approval for the variance to
Grapevine Zoning Ordinance 82-73, Section 15.G.1, in the amount of six
inches (6"). Becky Swann seconded the motion which prevailed by the
following vote:
Ayes: Thompson, Swann, Bigbie, Giffin, Truitt

BZA89-09, MARK AND LA TONIA HERMAN
The next item of new business was for the Board of Zoning Adjustment to
consider BZA89-09, submitted by Mark and La Tonia Herman, who is requesting

a variance to Grapevine Zoning ordinance 82-73, Section 15.G.1, "R-7.5",
Single-Family District Regulations which requires a 30 foot front yard
setback. The existing plot plan shows a 28.3 foot front yard setback, a
1.9 foot variance for 1738 Chaparral Ct., Lot 11, Block 2, La Paloma I
Addition.
Joy Carroll explained the Hermans were advised by the financial institution
to request the variance in order for the loan to qualify.
Mr. and Mrs. Herman were present to ask any questions.
Mr. Walter Jones, of 1732 Chaparral Ct., Grapevine, took the Oath of Truth
and stated he lives next door to the house in question and has no problem
with the variance.
Since there was no one else to speak either for or against the request,
Charles Giffin made a motion to close the Public Hearing. Don Bigbie
seconded the motion which prevailed by the following vote:

Becky Swann made a motion that a special condition did exist. Don Bigbie

Becky Swann then made a motion that the special condition is the house is
existing and to grant the variance of 1.7 feet, allowing a 28.3 foot front
yard setback, to Grapevine Zoning ordinance 82-73, Section 15.G.1. Charles
Giffin seconded the motion which prevailed by the following vote:
Ayes: Thompson, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Hobbs, Frieden
Chairman Thompson requested BZA89-16 be heard next.
BZA 89-16, LIVING WORD LUTHERAN CHURCH
The next item of new business was for the Board of Zoning Adjustment to
consider BZA 89-16, submitted by the Living Word Lutheran Church who is
requesting variances to Grapevine Zoning Ordinance 82-73, Section 53.H.1.c.
which requires planter islands landscaped with trees every 12 parking
spaces for the church located at 2031 West Northwest Highway. The concept
plan being submitted with a plat indicates that three of the planter
islands provided have 13 parking spaces and one with 15 spaces between
them; therefore, 4 require a variance.
Joy Carroll explained when the church sold the land to the Henry S. Miller
Company, it was with the understanding a drive cut would be possible
between the tracts. However, the City Council would not approve the
cross-access to prevent shopping center traffic from entering Northwest
Highway through the church drives. The church concept plan indicates
115.33 parking spaces required with 116 being provided; therefore, if the
planter islands are provided, parking will be short by four spaces. Twice
the percentage of landscaping is provided than required, so allowing a
planter island one space further apart has little impact on overall
landscaping.
Tony Serus with the Building Steering Committee of the Church took the Oath
of Truth and stated the number of parking spaces does meet the requirements
for the number of seating in the church, but what the problem was, there
were too many spaces between the landscape islands than what is allowed by
the zoning ordinance.
After further discussion, Charles Giffin made a motion to close the Public
Hearing. Becky Swann seconded the motion which prevailed by the following
vote:

Charles Giffin commented that he felt the layout of the parking works well
on the site and that the church has tried to stay with the Ordinance.
Becky Swann made a motion that a special condition did exist. Charles
Giffin seconded the motion which prevailed by the following vote:

Becky Swann than made a motion the special condition being, to preserve any
existing trees that could be saved, the unique shape of the tract, there is
excessive open space, and to grant the variance for four planter islands to
Grapevine Zoning Ordinance 82-73, Section 53.H.1.c. Charles Giffin
seconded the motion which prevailed by the following vote:
Ayes: Thompson, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Hobbs, Frieden
Chairman Thompson announced Items C through H on the agenda would be heard
jointly.
BZA 89-10 THROUGH 15, HARWOOD MILLER AND GIFFIN
The next items for the Board of Zoning Adjustment to consider was BZA 89-10
through BZA 89-15, submitted by Harwood, Miller, and Giffin who is
requesting six (6) variances for corner lots in the Dove Crossing
Subdivision. The variances are to Grapevine Zoning Ordinance 82-73,
Section 42.D which requires a 15 foot side yard setback from the street for
corner lots. The variance being requested for all six lots is for five (5)
feet, leaving a 10 foot side yard.
Joy Carroll explained the same variance applies to six different lots to be
able to eliminate the five (5) foot and to allow a 10 foot setback to the
side street rather than the required 15 foot setback. Ms. Carroll stated
that City Staff did recommend approval, the special condition being the
plat was approved with lots narrower than needed to accommodate the minimum
sized homes planned, which is not the fault of the builders.
Charles Giffin, builder, explained that all lots in the subdivision are 50
feet wide and the lots left over are the corner lots that are too narrow to
build on. He noted the house that is used is 35 feet wide and building one
that is less in width would make it necessary to reduce the 1400 to 1600
square feet of living area.
Raymond Truitt stated he had a problem granting the variances and wanted to
know if the architect could design a house to fit the lots.
Don Bigbie felt it would be a greater disadvantage to the neighborhood if a
smaller house was built on the lots.
Mike May, who lives at 2230 Ryan Ridge of the Dove Crossing Subdivision,
took the Oath of Truth and stated that he felt the detached garage at the
residence located at the corner of Mockingbird and Ryan Ridge was most
unappealing and asked Mr. Giffin if the houses in question would have
detached garages.
Mr. Giffin stated he was not sure at this point whether detached garages
would be built.
Jeff Green of 2216 Ryan Ridge, also took the Oath of Truth, and explained
he would like to see houses on the vacant lots but to provide more yard
space by having the garages attached.
With no one else to speak either for or against the request, Becky Swann
made a motion to close the Public Hearing. Don Bigbie seconded the motion
which prevailed by the following vote:

Raymond Truitt made a motion that a special condition did exist. Don
Bigbie seconded the motion which prevailed by the following vote:

Raymond Truitt then made a motion that the special conditions for the
variances were the lots were nonconforming to the subdivision layout; the
lots were too narrow which would make them difficult to sell, and the
subdivision was already platted. Don Bigbie seconded the motion which
prevailed by the following vote:
Ayes: Thompson, Swann, Bigbie, Truitt
Nays: None
Absent: Hobbs, Frieden
Abstain: Giffin
Don Bigbie made a motion to approve a variance to BZA 89-10, 11, 12, 13,
14, and 15, which is applicable to Grapevine Zoning Ordinance 82-73,
Section 42.D to allow for a five (5) foot variance to a fifteen (15) foot
side building line. Becky Swann seconded the motion which prevailed by the
following vote:
Ayes: Thompson, Swann, Bigbie, Truitt
Nays: None
Absent: Hobbs, Frieden
Abstain: Giffin
Gerald Thompson explained to the audience that detached garages fall under
the City of Grapevine ordinances and is not part of the building code, and
in any subdivision, detached garages can be built unless they are
prohibited by the deed restrictions.
Joy Carroll told the board members to turn in their Zoning ordinances for
updating by City Staff.
Tommy Hardy noted that City Council has amended the ordinance to where
Staff has the ability to amend site plans by shifting landscape islands in
order to save a tree.
Gerald Thompson inquired about terms expiring for the board members and
when the deadline was to refile. Joy Carroll stated the deadline was the
end of the week. Tommy Hardy announced that refiling was necessary for the
terms of Don Frieden, Raymond Truitt, and Tim Hobbs.
Charles Giffin advised the Board that Kountry Donuts was not using the type
of siding that was agreed upon at the Main Street Committee meeting. Tommy
Hardy stated he would check on the matter.
MINUTES
After reviewing the minutes, Don Bigbie made a motion to approve the
minutes of the February 6, March 6, and April 3, 1989 meetings. Becky
Swann seconded the motion which prevailed by the following vote:
Ayes: Thompson, Swann, Bigbie, Giffin, Truitt
Nays: None
Absent: Hobbs, Frieden
