The Building Board of Appeals for the City of Grapevine, Texas, met in regular
session, Monday, April 14, 1997, at 6:00 P.M., in the Council Room, 200 South Main
Street, Grapevine, Texas with the following members present:

constituting a quorum, with Members Dennis Roberts arriving late, and Catherine
Cotter Smith absent. Also present was Council Representative Roy Stewart and the
following City Staff:
Scott Williams Building Official
Mike Butler Code Enforcement Officer
Teresa Wallace Secretary
Chairman Joe Lipscomb called the meeting to order at 6:00 P.M.

The first item of business was a follow up to Dangerous Building D1396-01, 845 Dawn
Lane, legally described as Tracts 3B and 3131, Sunshine Harbor Industrial. At the
November 11, 1996, public hearing, the Board determined the structure to be a
dangerous building, ordered a permit to be secured for renovation within thirty (30)
days and repairs to be completed within ninety (90) days.
Mr. Williams stated that following the November 11, 1996 meeting, the applicant was
required to obtain certain zoning variances. Mr. Williams confirmed that a building
permit had been issued the week of April 17th on the property for renovation.
The next item was for the Building Board of Appeals to consider Dangerous Building

Mr. Williams stated the applicant was not in attendance. Also, he stated the
applicant had been notified of the meeting date and time by copy of the agenda.
Further, Mr. Williams told the board he had personally visited the property and related
that the neighbor did have a spotlight on a high pitched gabled roof. There is an
existing eight (8) foot fence on top of a retaining wall.
After delaying the public hearing to allow sufficient time for the applicants to arrive
Charles Bloomberg moved to close the public hearing. Art Gordon seconded the
motion which prevailed by the following vote:
Ayes: Lipscomb, Roberts, Gordon, Bloomberg, Kidd
Nays: None
Absent: Smith
Charles Bloomberg moved, with a second by Art Gordon, to table the request to May
12, 1997 because the applicant was not available to speak to the request. The
motion prevailed as follows:
Ayes: Lipscomb, Roberts, Gordon, Bloomberg, Kidd
Nays: None
Absent: Smith
Staff recommends the Building Board of Appeals ,deny the request to City of
Grapevine Code of Ordinances, Chapter 7, Article IV, Fences, Section 7-127, for Lot
25, Shorecrest Acres Addition and addressed as 1859 Chris Craft Drive, Grapevine,
Texas as follows:
Section 7-127, Front Yard Requirements - prohibits the erection of a fence exceeding
thirty-six (36) inches in the required front yard. The request is to allow a fence to be
constructed exceeding the maximum height by one (1) foot as shown on the plans.
If approved, it would allow a four (4) foot fence to be constructed in the required
front yard.
Scott Williams, Building Official, stated that Staff does not feel this property has any
unusual conditions to warrant an increase in fence height. Mr. Richard Smith,
property owner was introduced to speak to the request.
Mr. Smith had photographs and a copy of a police report as exhibits to show that his

was to have a single national code by year 2000. The 1994 Uniform Codes are a
step in that direction, for although there is not a great deal of technical change, the
1994 Uniform Codes are laid out in the same format, chapter by chapter, as the other
two major codes. Mr. Williams further stated that he felt this was the appropriate
time to change local amendments to the codes if necessary. He also thought that the
board should consider modifying certain other building related ordinances such as the
Fence and Dangerous Building Codes. He stated he would like to begin a study of the
documents at the next meeting to allow everyone the opportunity to review and
understand the revisions. He told the board he would have code books as well as an
analysis of revisions and the City of Grapevine local amendments available at the next
meeting for their review.
Mr. Dick Ward, Fire Marshall, spoke to the board about the proposed building code
changes. He stated there were concerns within the fire industry concerning fire
sprinklers for all commercial buildings. He said he would also be coming before them
to discuss revisions to the fire code.
Mr. Williams requested the board meet at 5:30 p.m. for the next few meetings to
allow additional time to consider the revisions. He told them they would begin with
the building and mechanical code followed by the fire code and fence ordinance.
Dennis Roberts moved to close the public hearing. Russell Kidd seconded the motion
which prevailed as follows:
Ayes: Lipscomb, Roberts, Gordon, Bloomberg,,Kidd
Nays: None
Absent: Smith
The last item for the Building Board of Appeals to consider were the minutes of the
February 10, 1997, meeting.
Russell Kidd made a motion to approve the minutes as read. Charles Bloomberg
seconded the motion which prevailed by the following vote:
Ayes: Lipscomb, Roberts, Gordon, Bloomberg, Kidd
Nays: None
Absent: Smith

Staff recommends the Building Board of Appeals deny the request to City of
Grapevine Code of Ordinances, Chapter 7, Article IV, Fences, Section 7-127, for Lot
25, Shorecrest Acres Addition and addressed as 1859 Chris Craft Drive, Grapevine,
Texas as follows:
