THE BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE THIRD DAY OF NOVEMBER, 1989 AT 5 PM. R •' • i n R it •' I The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session on Monday evening, November 6, 1989, at 6:00 P.M., in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Becky Swann Vice-Chairman Don Frieden Secretary Gerald Thompson Member Don Bigbie Member Raymond Truitt 1st Alternate Patti Bass 2nd Alternate constituting a quorum, with Chairman Charles Giffin absent. Also present was City Council Representative Gil Traverse and the following City Staff: H. T. (Tommy) Hardy Director of Community Development Joy Carroll Administrative Aide Greg Wheeler Assistant Building Official Adrienne Leonard Attorney, City Attorney's Office Gerrie Taylor Administrative Secretary 00 6.I W Gerald Thompson made a motion to place Don Bigbie as temporary chairman due to Becky Swann, who is Vice Chairman, and Don Frieden, who serves as Secretary not being present to call the meting to order. Raymond Truitt seconded the motion. Member Don Bigbie called the meeting to order at approximately 6:05 P.M. OATH OF TRUTH Acting Chairman, Don Bigbie administered the Oath of Truth to those persons of the audience who wished to speak during the meeting. The first item of new business was for the Board of Zoning Adjustment to consider BZA 89-34, submitted by the Waffle House who is requesting a variance to Grapevine Zoning Ordinance 82-73, Section 60.B.2.c. (4) which allows a maximum 12 foot sign cabinet width; a 6 foot variance is needed to allow 18 feet. The variance request is for Lot 3R3, Block I, Hayley Addition. Joy Carroll explained this was a request to amend the site plan in conjunction with a Planned Commercial Center. If the Board of Zoning Adjustment approves the request, it shall be contingent on the City Council approving their Conditional Use Application #CU89-14 scheduled for November 7, 1989. Also scheduled for November 7, 1989, are the proposed amendments to Section 60, Siqn Standards. If approved by the City Council, the proposed amendments will not regulate the sign cabinet width and height; only square footage. The proposed amendment would eliminate the need for this variance request. Mrs. Carroll also stated Staff recommended denial for this request. Jimmy Stone, of 9307 Olive In. N., Sunlake, AZ, and who works for Waffle House, explained he has been working with the planning staff and has come up with a sign that is 18 feet across, 12 inches in cabinet width, and 40 feet in height. Mr. Stone noted that he had agreed to reduce the sign by pushing the letters closer together. He stressed that the size and height was important for late night hours. Gerald Thompson questioned the status of highway signs. Tommy Hardy stated the amendments, being heard at the next nights City Council meting, would be to eliminate the height and width of signs in conjunction with Planned Commercial Centers. Becky Swann seconded the motion which prevailed by the following vote: Ayes: Swann, Frieden, Thompson, Bigbie Nays: None Absent- Giffin After further discussion, Becky Swann made a motion that a special condition did exist. Don Frieden seconded the motion which prevailed • the following vote: Ayes: Swann, Frieden, Thompson, Bigbie Nays: None Absent: Giffin Ayes: Swann, Frieden, Thompson, Bigbie Nays: None Absent: Giffin NOTE: Acting Chairman, Don Bigbie, announced his resignation from the Board at which time he had to leave the meeting for another engagement. Vice Chairman, Becky Swann, at this time, chaired the reminder of the meting. I Joe Lipscomb, applicant and property owner, explained that by relocating the house, the Senior Center can be expanded. Also, Mr. LipscaTb showed the Members how the house was going to be restored to its original condition and how masonry would be inappropriate. Ayes: Swann, Frieden, Thompson, Truitt, Bass Nays: None Absent: Giffin A motion was then made by Gerald Thompson that the special condition was that the house is a historical structure and to eliminate the masonry requirement relative to Grapevine Zoning Ordinance 82-73, Section 54, Masonry Requirem-te-nts. Don Frieden seconded the motion which prevailed by the following vote: Ayes: Swann, Frieden, Thompson, Truitt, Bass Nays: None BOARD • ZONING ADJUSTMENT NOVEMBER • 1•8• PAGE 3 Absent: Giffin BZA 89-36, SIGNGRAPHICS (GRANDY'S) The next item of new business was for the Board of Zoning Adjustment to consider BZA 89-36, submitted by Signgraphics who is requesting variances to the Grandy's sign located at 301 State Highway 114. The variances being requested are from Grapevine Zoning Ordinance 82-73, Section 60.B.2.c. (4) which allows a maximum 12 foot sign cabinet width (an 11 foot, 8 inch variance is needed to allow a 23 foot, 4 inch width); a 14 inch maximum cabinet depth (a 10 inch variance is needed to allow a 24 inch cabinet depth); and a maximum 108 square foot sign cabinet (a 140 square foot variance to allow 248 square feet). The BZA minutes of November 2, 1987, indicate a variance approval for the subject pole sign height of 40 feet. Signgraphics did note that the sign was 47 feet high. Also approved at that meting was a 16 foot by 12 foot-1 1/2 inch cabinet size. Joy Carroll stated that Staff does not recognize any special condition to warrant a wider, taller sign, therefore, recommends approval only for the sign cabinet depth. Bill Dunlap of 2625 Rochelle, Irving, Texas, and project manager for Signgraphics explained that Grandy's wanted to get more business from traffic traveling on Highway 114. Mr. Dunlap explained that traveling east on 114, the Grandy's sign cannot be seen before the Main Street exit. Also the public traveling south on Main Street can barely see Grandy's over the McDonalds building. Mr. Dunlap also noted that the property had limited access in which they need more exposure from the size of the sign and for it to be accessible for maintenance reasons. After further discussion, Raymond Truitt made a motion to close the Public Hearing. Patty Bass seconded the motion which prevailed by the following vote: Ayes: Swann, Frieden, Thompson, Truitt, Bass Nays: None Absent: Giffin Becky Swann explained she did not have a problem with the depth of the sign due to maintenance reasons. After further discussion, Patti Bass made a motion that a special condition did exist. Gerald Thompson seconded the motion which prevailed by the following vote: Patti Bass then made a motion that the special condition was that the type of sign requires a wider cabinet depth of 24 inches for a person to be able to enter the sign for maintenance and to grant the variance to Grapevine Zoning Ordinance 82-73, Section 60.B.2.c.4 for the cabinet depth only, and to deny the variance for the 11 foot-8 inch sign cabinet width. After discussion, Gerald Thompson made a motion to change the January 1, 1990, meting date to Tuesday, January 9, and the September 3, 1990, to Tuesday, , September 4.
