CITY OF GRAPEVINE
The Board of Zoning Adjustment for the City of Grapevine, Texas, met on Monday
evening, May 3, 2021, at 6:00 P.M. in the Planning and Zoning Conference Room, 2nd
Floor, 200 South Main Street, Grapevine, Texas for a Briefing Session with the following
members present to wit:
Tracey Dierolf

Alternate
constituting a quorum, with Alternate John Borley absent. Also present was City Council
Representative Sharron Rogers and the following City Staff:

ITEM 1. CALL TO ORDER
Chairman Tracey Dierolf called the Briefing Session of the Board of Zoning Adjustment
to order at approximately 6:00 P.M.
ITEM 2. ROLL CALL
BRIEFING SESSION
Albert Triplett briefed the Board of Zoning Adjustment regarding the items scheduled to
be heard in the regular public hearing.
ADJOURNMENT OF BRIEFING SESSION.
With no further discussion, Doug Anderson made a motion to adjourn the Briefing
Session. Ben Johnson seconded the motion which prevailed by the following vote:
Ayes: Dierolf, Sheppard, Johnson, Dalton, Anderson, Gaspard
Nays: None
Absent: Borley
The Briefing Session was adjourned at approximately 6:19 P.M.

Adjustment to order at approximately 6:21 P.M.

Chairman Tracey Dierolf called the Public Hearing of the Board of Zoning Adjustment to
order at approximately 6:15 P.M.
ITEM 3. CITIZEN COMMENTS
NEW BUSINESS
ITEM 4: BOARD OF ZONING ADJUSTMENT CASE BZA21-04. LEMOINE WRIGHT,,
600 WEST WALL STREET
The first item for the Board of Zoning Adjustment to consider was BZA21-04 submitted
by Lemoine Wright for property located at 600 W. Wall Street, Lot 1, Block 1, Century
Oak Addition.

Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception to add parking within the front yard
for a proposed non-residential structure as shown on the plot plan.
Mr. Triplett explained that Staff found a special condition existed for the requested
-vafiaru;--aad special exception. Specifically, the zoning ordinance, as currently written,
reserve�> front yards for landscaping including grass, shrubbery vines or trees and
prohibits, paving/parking. A high value, historically significant tree, known as the Witness
Tree, -s located in the southeast corner of the subject site. In recognition of the
historical significance of the tree to the community, the applicant had adjusted the plot
plan by moving the location of the office building and parking in attempt to limit the
disturbance of the root system of the tree.
Mr. Triplett stated that the subject site was located in the Historic Grapevine District
Township. The applicant recognized the historical significance of the 200-year-old
Witness Tree, and voluntarily applied for a Certificate of Appropriateness. On March
25, 2020, the Historic Preservation Commission approved Certificate of
Appropriateness (CA20-13) on the subject site for the location of a new 7,918 square
foot, two story office building and a revised parking plan.
With no questions for Mr. Triplett, Lemoine Wright of 213 E. College Street, Grapevine,
Texas, took the Oath of Truth; he gave a brief presentation to the Board and requested
favorable consideration of his request and offered to answer any questions of the
Board.
John Sheppard asked Mr. Wright if there were any special barriers being placed around
the tree. Mr. Wright stated that with the new lot configuration they did not anticipate
needing to make any barriers, but may consider rod iron if necessary.
With no questions for Mr. Wright, Councilwoman Sharron Rogers addressed the Board.
She stated that the "Witness Tree" was the only one like it in Grapevine, the tree was
the corner marker for locating the surveys each of the four original family's that had
received land grants of 640 acres each from part of the Peters Colony that had
immigrated here in 1844. With no questions for Ms. Rogers and no additional speakers,
John Sheppard made a motion to close the public hearing. Ben Johnson seconded the
motion which prevailed by the following vote:
Ayes: Dierolf, Sheppard
Nays: None
Absent: Borley
Johnson, Dalton, Anderson
Ben Johnson made a motion that a special condition existed for the requested special
exception. Specifically, a historically significant tree known as a "Witness Tree" is
located in the southeast corner of the site. Due to the importance of this tree it is
necessary to allow parking for a non-residential structure within the front yard setback to

limit the damage/disturbance to the root system of the tree. George Dalton seconded
the motion which prevailed by the following vote:
Ayes: Dierolf, Sheppard, Johnson, Dalton, Anderson
Nays: None

Ben Johnson then made a motion to grant the following special exception to Section
43.E.3., Nonconforming Uses and Structures allowing parking within the front yard for a
proposed non-residential structure as shown on the plot plan. Doug Anderson seconded
the motion which prevailed by the following vote:
Ayes: Dierolf, Sheppard, Johnson, Dalton, Anderson
Nays: None
Absent: Borley
ITEM 5: BOARD OF ZONING ADJUSTMENT CASE BZA21-05, MAX DRAPER, 1617
SILVERSIDE DRIVE
The next item for the Board of Zoning Adjustment to consider was BZA21-05 submitted
by Max Draper for property located at 1617 Silverside Drive Street, Lot 1, Shorecrest
Acres Subdivision.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing residential
structure to remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff did not find a special condition existed for the requested
special exception to expand the existing dwelling to encroach into the required Fear yard
and side yard setbacks. The existing dwelling was built in 1965 and met all zoning
requirements of the "R-7.5" Single Family District.
With no questions for Mr. Triplett, property owner, Mr. Guinn Phillips of 305 Preakness
Circle, Southlake, Texas, took the Oath of Truth; he gave a brief presentation to the
Board and requested favorable consideration of his request and offered to answer any
questions of the Board.
With no questions for Mr. Phillips, and no additional speakers, John Sheppard made a
motion to close the public hearing. Ben Johnson seconded the motion which prevailed
by the following vote:
Ayes: Dierolf, Sheppard, Johnson, Dalton, Anderson
Nays: None
Absent: Borley

John Sheppard made a motion that a special condition did not exist for the requested
special exception. Doug Anderson seconded the motion which prevailed by the
following vote:
Ayes: Dierolf, Sheppard, Johnson, Dalton, Anderson
Nays: None

ITEM 6: MINUTES
Next the Board of Zoning Adjustment considered the minutes of the April 5, 2021,
Briefing Session and Public Hearing.
Ben Johnson made a motion to accept the minutes of the April 5, 2021, Briefing
Session. George Dalton seconded the motion which prevailed by the following vote:
Ayes: Dierolf, Sheppard, Johnson, Dalton, Anderson
Nays: None
Absent: Borley
Ben Johnson made a motion to accept the minutes of the April 5, 2021, Public Hearing.
John Sheppard seconded the motion which prevailed by the following vote:
Ayes: Dierolf, Sheppard, Johnson, Dalton, Anderson
Nays: None
Absent: Borley

With no further discussion, John Sheppard made a motion to adjourn. George Dalton
seconded the motion, which prevailed by the following vote:
