JOINT PUBLIC HEARINGS CONDITIONAL USE APPLICATION CU13 -01 - RIVERWOODS MEMORY CARE AND BEAR CREEK LODGE ASSISTED LIVING First for the Commission to consider and make recommendation to City Council was conditional use application CU13 -01 submitted by Rosco Construction for property located at 3721 & 3729 Ira E Woods Avenue and platted as Lots 1 & 2, Block 1, Riverwoods. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU08 -30 (Ord. 08 -68) for a planned office center specifically to allow the development of a 37,000 square foot, 60 bed skilled nursing center (Lodge at Bear Creek) and a 40,250 square foot, 48 bed assisted living facility (Rivervines). 041613 1 P & Z JOINT PUBLIC HEARING APRIL 16, 2013 The applicant proposed to develop the remaining two lots on the property along Ira E. Woods Avenue. The proposed Lodge at Bear Creek will be a 37,000 square foot, two story, 60 bed, state licensed skilled nursing /rehabilitation center that will provide care and rehabilitation services for patients released from a hospital but are not ready for total independence for a period of 45 -60 days. The applicant also proposed Rivervines to be a 40,250 square foot, two story, 48 bed, state licensed assisted living facility /memory care center similar in nature to the existing Dancing River, with larger rooms geared towards couples. Mr. Robert Johnson, the applicant, was available to answer questions and requested favorable consideration. Mr. Johnson stated that the Lodge at Bear Creek would be built first followed by Rivervines. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Herb Fry moved to approve conditional use application CU13 -01. B J Wilson seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, E. Martin and Luers Nays: None CONDITIONAL USE APPLICATION CU13 -04 - 7- ELEVEN Next for the Commission to consider and make recommendation to City Council was conditional use application CU13 -04 submitted by Brian Nebel for property located at 1700 State Highway 26 and platted as Lot 2R1, Block 1, Grapevine Mills Addition, Phase 2. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU12 -41 (Ord. 2013 -01) for a planned commercial center in excess of 1,000,000 square feet of gross leasable space for gasoline services, a monument sign with changeable copy in excess of 30 percent and the possession, storage, retail -sale, and off - premise consumption of alcoholic beverages (beer and wine only) in conjunction with a convenience store, specifically to revise the building area and elevations. Due to a design requirement from 7- Eleven to require additional separation between the fueling canopy and the convenience store, the applicant proposes the following revisions: the fueling canopy and the convenience store have been repositioned and the building elevations have been changed to allow for rooftop screening of mechanical equipment Mr. Brian Nebel, the applicant, was available to answer questions requested favorable consideration. 041613 2 P & Z JOINT PUBLIC HEARING APRIL 16, 2013 With no further questions, guests to speak, one letter of support, the public hearing was closed. In the Commission's deliberation session, Dennis Luers moved to approve conditional use application CU13 -04. Elaine Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, E. Martin and Luers Nays: None CONDITIONAL USE APPLICATION CU13 -06 - COUSIN'S BAR -B -Q Next for the Commission to consider and make recommendation to City Council was conditional use application CU13 -06 submitted by C & H Foods LP for property located at 1000 International Parkway, Terminal B, Columns 128 -129. The applicant was requesting a conditional use permit to allow the possession, storage, retail sale, and on- premise consumption of alcoholic beverages (beer, wine, and mixed beverages) in conjunction with a restaurant. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Herb Fry moved to approve conditional use application CU13 -06. Dennis Luers seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, E. Martin and Luers Nays: None AM13 -02 - AMENDMENTS TO APPENDIX D, SECTION 41A, ENTERTAINMENT AND ATTRACTION OVERLAY Next for the Commission to consider and make recommendation to City Council was amendments to the Grapevine Code of Ordinances, Appendix D, Comprehensive Zoning Ordinance No. 82 -73 relative to the addition of Section 41A, Entertainment and Attraction Overlay. At a January 14, 2013 workshop, discussion was held relative to the creation of a new zoning district category specifically designed to facilitate the development of entertainment and attraction type uses along with hospitality, retail, and restaurant uses that are customarily associated with this type of development. Given the few remaining tracts left to develop within the city and the competitive pressure from other cities within the Dallas /Fort Worth metroplex area, adoption of such an ordinance would demonstrate the city's willingness to consider and validate such uses. 041613 3 P & Z JOINT PUBLIC HEARING APRIL 16, 2013 A subsequent Council workshop was held on March 5, and several changes have been made to the proposed ordinance as a result of that workshop, primarily to the Standards section with the removal of two paragraphs that appeared to have conflicting intent and the addition of the "PO" Professional Office District and the "CN" Neighborhood Commercial District to the list of districts that are prohibited from the establishment of the overlay. In addition to defining the concept of "attraction" the proposed ordinance allows special consideration to be given relative to: • Building setbacks, area, open space, density, buffer and landscaping requirements • Reducing or eliminating minimum district size requirements • Increased building /structure height • Signage, particularly increased height, area, moving sign copy and identification highway signage • Parking • Uses, in particular consideration given to "boutique" hotels with a room count below 300 rooms • Masonry requirements With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Dennis Luers moved to approve AM13 -02 amendments to Appendix D, Section 41A, Entertainment and Attraction Overlay. Martin and Luers Nays: None AM13 -03 - AMENDMENTS TO APPENDIX D, SECTION 49, SPECIAL USES Next for the Commission to consider and make recommendation to City Council was amendments to the Grapevine Code of Ordinances, Appendix D, Comprehensive Zoning Ordinance No. 82 -73, Section 49, Special Uses relative to requiring a special use permit for new parking lots and parking lot expansions within the Grapevine Historic Township District At a March 5, Council workshop to discuss the matter and a subsequent discussion at a March 19, Council workshop, it was generally agreed that Council oversight should be required for new parking lots and the expansion of existing parking lots in the downtown area of the city. Section 49, Special Uses was amended to require a special use permit for stand alone new parking lots or the expansion of existing parking lots in excess of four spaces within the Grapevine Historic Township District. 041613 4 P & Z JOINT PUBLIC HEARING APRIL 16, 2013 With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, Herb Fry moved to approve AM13 -03 amendments to Appendix D, Section 49, Special Uses. Martin and Luers Nays: None END OF PUBLIC HEARING PRELIMINARY PLAT APPLICATION - LOTS 1 & 2, BLOCK 1, REAGAN SHORES ESTATES Next for the Commission to consider and make recommendation to the City Council was the Statement of Findings and Preliminary Plat Application of Lots 1 & 2, block 1, Reagan Shores Estates on property located at 1384 Shannon Street. The applicant was preliminary platting 0.663 acres to subdivide one lot into two lots. In the Commission's deliberation session B J Wilson moved to approve the Statement of Findings and Preliminary Plat Application of Lots 1 & 2, Block 1, Reagan Shores Estates. Elaine Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Fry, Wilson, E. Martin and Luers Nays: None CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the March 19, 2013 Planning and Zoning joint public hearing. Herb Fry moved to approve the Planning and Zoning Commission minutes of March 19, 2013.
