LIVINGSTON MEETING DATE: MONDAY, APRIL 21, 1997 RECOMMENDATION: Staffrecommends the Electrical Board of Appeals deny the request to City of Grapevine Code of Ordinances, Chapter 7, Article 111, Section 7-96 for Lot 2, Block 22, Original Town of Grapevine Addition and addressed as 322 East College Street, Grapevine, Texas as follows: Section 7-96, requires all new, on site service entrance conductors to be located underground. The request is to allow a new electrical service to be run overhead to an existing barn on the property as shown on the plot plan. BACKGROUND INFORMATION_ An application was submitted to the Department of Development Services by Mr. Willie Livingston, the owner of the property. An existing overhead electrical service is located on the property, and serves the residence. This service enters the property from the north and extends approximately 100 feet. The new service extension would be for a distance of approximately 120 additional feet. The Electrical Board, at their August 5, 1996, meeting recommended that the City Council adopt an ordinance requiring underground electrical services. At the August 20, 1996, meeting, Council approved this ordinance. The attached resolution, adopted by NCTCOG's Executive Board, supports adoption of the 1996 National Electrical Code along with the attached regionally formulated amendments. Additionally, for the benefit of builders and contractors, jurisdictions are encouraged to set a regionally consistent "code effective date" of January 31, 1997. Earlier this year, NCTCOG's Regional Codes Coordinating Committee, composed of building professionals from the public and private sector, directed its Electrical Code Subcommittee to review the 1996 Edition of the National Electrical Code. The Subcommittee held several meetings to review the Code and discuss possible regional amendments. Many cities, in addition to the ones represented on the Subcommittee, participated in this forum. Numerous local amendments, obtained from a regional survey, were discussed and many were eventually incorporated into the attached recommendations based on their benefit to business, industry, and property owners and on how well they supported public safety. A major outcome of the review process was the commitment from many of the cities in the region to adopt the regionally recommended code with no local amendments other than the regionally produced amendments. In particular, the region's three largest cities, Dallas, Fort Worth, and Arlington agreed to drop their existing local amendments in favor of adopting the regional amendments. Other area cities and private industry representatives involved in the review process also supported these amendments and agreed that they should be the only ones adopted. A signed declaration of support for this initiative is attached. It should be noted that attached with these recommended amendments is a paper, provided by Mr. John Minick with the National Electrical Manufactures Association, concerning the history and current use of aluminum conductor material. The subcommittee discussed at length the benefits of using or allowing the use of aluminum conductors. This Electrical Code Subcommittee supports allowing aluminum conductors to be used as permitted in the National Electrical Code. The North Central Texas Council of Governments' Regional Codes Coordinating Committee intends, as a follow-up measure, to submit these amendments as proposed changes during the next National Electrical Code Change Cycle. We appreciate your support of this significant step towards a true Regional Electrical Code. Sincerely, Mike Eastland Executive Director North Central Texas Council of Governments O)o Charles Clawson, Chairman Patrick Baugh, Chairm Regional Codes Coordinating Committee Electrical Code Subco 'ttee (Director of Community Development, (Managing Director, Development Services, City of Arlington) City of DeSoto) attachments t RESOLUTION IN SUPPORT OF ELECTRICAL CODE UNIFORMITY AND ENDORSEMENT OF THE NATIONAL ELECTRICAL CODE - 1996 EDITION WHEREAS, the North Central Texas Council of Governments is established to assist local governments in planning for common needs, cooperating for mutual benefit, and coordinating for sound regional development; and WHEREAS, the North Central Texas Council of Governments has been active for the last twenty-nine years in promoting construction code uniformity in the region; and WHEREAS, code uniformity has been documented to lead to a decrease in confusion and delays to builders, developers and architects; a decrease in costs to municipalities in the development of codes; and, ultimately, a decrease in construction costs to consumers; and WHEREAS, the National Electrical Code is published every three years with the 1993 Edition having been previously endorsed by the Executive Board; and WHEREAS, the Regional Codes Coordinating Committee has reviewed the National Electrical Code - 1996 Edition and recommends its endorsement with regional amendments. NOW, THEREFORE, BE IT HEREBY RESOLVED: SECTION 1 That the Executive Board firmly supports the current activities in promoting electrical code uniformity in the North Central Texas region. SECTION 2 That the Executive Board endorses the National Electrical Code - 1996 Edition published by the National Fire Protection Association and recommends its adoption by all cities in the North Central Texas region. SECTION 3 That the Executive Board endorses the attached regional amendments to the National Electrical Code - 1996 Edition and recommends their adoption by all cities in the North Central Texas region. SECTION 4 That the Executive Board encourages all cities to adopt the National Electrical Code - 1996 Edition with no local amendments other than the regionally recommended amendments with an effective date of January 31, 1997. Number of Services. (a) Number. A building or other structure shall be served by only one service. Exception No. 1: For fire pumps...{text unchanged}...considered to be one service lateral. Exception No. 8: In supplying electrical service to multifamily dwellings, two or more laterals or overhead service drops shall be permitted to a building when all of the following conditions are met: a. The building height is limited to three stories. b. The building has six or more individual gang meters and all meters are grouped at the same location. c. Each lateral or overhead service drop originates from the same point of service. REASON FOR CHANGE: This is currently the accepted installation practice of the region. No noteworthy complaints have surfaced. It is more reasonable than the current NEC requirements. It allows more than six disconnects grouped at one location, without having to divide the structure into multiple buildings by using area separation walls. This also allows designers more flexibility in the placement of electrical meters and main service disconnects. 230-71. Maximum Number of Disconnects. (a) General. The service disconnecting means for each service permitted by Section 230-2, or for each set of service-entrance conductors permitted by Section 230-40, Exception No. 1, shall consist of not more than six switches or six circuit breakers mounted in a single enclosure, in a group of separate enclosures, or in or on a switchboard. There shall be no more than six disconnects per service grouped in any one location. Exception No. 1: Multi-occupant Buildings. Individual service disconnecting means is limited to six for each occupant. The number of individual disconnects at one location may exceed six. Exception No. 2: For the purpose of this section, disconnecting means used solely for the control circuit of the ground fault protection system, installed as part of the listed equipment, shall not be considered a service disconnecting means. REASON FOR CHANGE: The same reasoning as for multi-family dwellings in Section 230-2 except now it is being applied to multi-occupant buildings. *NOTE: Underlining indicates new words and phrases to be added to the 1996 National Electrical Code. Str4keeats indicate existing words and phrases to be deleted. 1 September 19, 1996 250-81. Grounding Electrode System. If available on the premises at each building or structure served, each item (a) through (d) below, and any made electrodes...[text unchanged)...interconnect electrodes that are part of the grounding electrode system. Exception No. 2: In industrial and commercial buildings where conditions of maintenance and supervision ensure that only qualified persons will service the installation and the entire length of the interior metal water pipe that is being used for the conductor is exposed. Where a metal underground water pipe as described in item (a) is not present a method of grounding as specified in (b)through(d)below shall be used. (FPN): See Section 547-8 for special grounding and bonding requirements for agriculture buildings. REASON FOR CHANGE: Sometimes metal underground water pipe is not available for use as a grounding electrode system. Therefore, to provide a more positive approach for grounding electrical premise systems for safety, a method as specified in (b), (c), or (d) shall be used. This will eliminate the need to depend solely on a driven rod or pipe as specified in Section 250-83. 300-11. Securing and Supporting. [Delete Section 300-11 in the National Electrical Code- 1996 Edition and replace with Section 300-11 from the National Electrical Code- 1993 Edition] REASON FOR CHANGE: The requirements of Section 300-11 in the 1996 National Electrical Code are very cost prohibitive. The section is currently under review by NEC Code Panel 3 for possible revision. 310-16 through 310-19-- Allowable Ampacity Tables. Notes to Ampacity Tables of 0 to 2000 Volts 3. 120/240 Volts, 3-Wire, Single-Phase Dwelling Services and Feeders. For dwelling units, conductors, as listed below, shall be...{text unchanged)...conductors. The grounded conductor shall be permitted to be smaller than the ungrounded conductors, provided the requirements of Sections 215-2, 220-22, and 230-42 are met. This Note to Tables 310-16 through 310-19 shall not be used in conjunction with Section 220-30. REASON FOR CHANGE: To provide a more reasonable margin of safety for dwelling service and feeder conductor allowable ampacities. 2 September 19, 1996 336-5. Uses Not Permitted. (a) Types NM, NMC, and NMS. Types NM,NMC, and NMS cables shall not be used: (1) In any dwelling or structure exceeding three floors above grade. For the purpose of this article, the first floor of a...[text unchanged}...vehicle parking, storage, or similar use shall be permitted. Exception No. 1: An additional level shall be permitted where the renovation of attic, vehicle parking, or storage space creates a habitable floor level in an existing one family dwelling. Exception No. 2: An additional level shall be permitted in dwellings where the entire structure is protected throughout by an approved automatic sprinkler system. (2) As service-entrance cable. (10) In non-residential metal frame structures. REASON FOR CHANGE: To allow a reasonable expansion for NM cable use in dwelling occupancies, while somewhat limiting the use of NM cable in occupancies where it is more vulnerable to physical damage and where use is somewhat limited by the NEC and building codes. This allows nonmetallic sheathed cable as a wiring method in four story single or multifamily dwellings provided they are fully sprinkled throughout the entire building. It allows designers to be more cost effective in their designs of wiring methods. REGIONAL INTERPRETATIONS 210-52.Dwelling Unit Receptacle Outlets. (d)Bathrooms. NEW BUSINESS FBA97=0 3_, WILLIE IVINGSTON The first item for the Electrical Board of Appeals to consider was EBA97-03 submitted by Willie C. Livingston for 322 East College Street, platted as Lot 2, Block 22, Original Town of Grapevine. The request was to City of Grapevine Code of Ordinances, Chapter 7, Article III, Section 7-96 which requires all new on site service entrance conductors to be located underground. Mr. Williams explained that the request was to allow a new electrical service to be run overhead to an existing barn on the property as shown on the plot plan. Mr. Williams further explained that an existing overhead electrical service that serves the residence is located on the property, and the new service extension would be for a distance of approximately 120 additional feet. Irle Hightower asked if TU Electric allowed two services. Mr. Williams commented that TU Electric would allow it with permission from the Building Official. BBA MINUTES 4-21-97 Mr. Livingston explained that the barn is a historical building in a historical area and at one time had power. Mr. Livingston explained that he wanted to avoid running the line underground because of having to cross two existing sewer lines. Mr. Livingston further explained that there were no accurate records of the location of the sewer lines. Mr. Livingston also explained that the barn would be 120 feet from the existing pole and would be located on the west side of the property. With no one else to speak either for or against the request, Irle Hightower made a motion to close the public hearing. Pat Mitchell seconded the motion which prevailed by the following vote: Ayes: Roberts, Banse, Dawkins, Hightower, Mitchell Nays: None Absent: None After further discussion, Daniel Banse made a motion to grant the request to City of Grapevine Code of Ordinances, Chapter 7, Article III, Section 7-96, for Lot 2, Block 22, Original Town of Grapevine Addition, addressed as 322 East College Street, allowing a new electrical service to be run overhead to an existing barn on the property as shown on the plot plan. Patrick Mitchell seconded the motion which prevailed by the following vote: Ayes: Banse, Hightower, Mitchell Nays: None Abstain: Roberts, Dawkins Absent: None 1996 NAI )NAL ELECTRtCALC_O_DE Scott Williams, Building Official, told the Board that he would like to begin the process of adoption of the 1996 National Electrical Code. Mr. Williams reminded the Board that the Building Department was currently enforcing the 1993 National Electrical Code. He also stated that the North Texas Council of Governments had compiled a list of six amendments that they were asking all area cities to adopt. Mr. Williams told the Board that they could do a great service to the industry by adopting the (6) suggested C.O.G. amendments and deleting all other current amendments. This would provide uniformity and consistency among metroplex jurisdictions and give electrical contractors, designers, and property owners a level playing field when dealing with cities. 2 BBA MINUTES 4-21-97 With the Board posing no objections, Mr. Williams began the review of the City of Grapevine's current local amendments to the Electrical Code. Mr. Williams covered the items one by one, and stated that he felt these items should no longer be included as amendments. The Board did not disagree. The Board asked if the recent amendment requiring new service conductors to be underground would be deleted. Mr. Williams stated that this amendment was an administrative provision, and not an amendment to the Electrical Code itself. Therefore, this provision would remain in effect. With the Board having no further questions, Mr. Williams moved on to outline in detail the C.O.G. recommended amendments (see attachment). He stated that generally these amendments were less restrictive and more cost effective than the unmodified provisions to the N.E.C., yet posed no increased hazard to life safety. Therefore, these suggested amendments would benefit the trade, designers, and property owners, without endangering building occupants. The Board voiced no opposition to these recommended amendments. Mr. Williams stated that this would be a good stopping point. Beginning with the next meeting, he stated he would review with the Board changes to the body of the 1996 N.E.C. Daniel Banse made a motion to close the public hearing.
