The following variance for BZA97-12, 2818 Woodland Hills Drive, Lot 30, Block 3, Western Oaks Addition, was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1., R-7.5, Single Family District Regulations requires a thirty (30) foot front yard setback. The approved variance allows a three (3) foot encroachment of the existing house into the required thirty (30) foot front yard setback, allowing the existing house a twenty-seven (27) foot front yard setback as shown on the plot plan. Also present was City Council Representative Roy Stewart and the following City Staff: Scott Williams Marcy Ratcliff Ron Stombaugh Gerrie Anderson CALL TO ORDER Building Official City Planner City Planner Secretary Chairman Randy Howell called the meeting to order at 6:05 P.M. BZA97-12. MIKE SWIMELAR The first item for the Board of Zoning Adjustment to consider was a request from Mr. Mike Swimelar who requested a variance for 2818 Woodland Hills Drive, platted as Lot 30, Block 3, Western Oaks Addition, Grapevine, Texas. The following variance was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1., R-7.5, Single Family District Regulations requires a thirty (30) foot front yard setback. The proposed variance would allow a three (3) foot encroachment of the existing house into the required thirty (30) foot front yard setback. Mr. Williams explained that Staff found special conditions for the request, as the structure was existing, and the encroachment was not the fault of the current owner. Mr. Williams also explained that the structure was constructed in 1989 after the implementation of setback inspections. BZA Minutes 6/2/97 Mr. Mike Swimelar, applicant, took the Oath of Truth and explained he had bought the house in April, which at that time, the survey showed the southwest corner encroaching three feet into the front yard setback. With no one else to speak either for or against the request, Carl Hecht made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis Carl Hecht made a motion that a special condition existed, as the encroachment was not the fault of the current owner. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis Carl Hecht made a motion to approve the variance to Section 15.G.1., R-7.5, Single Family District Regulations to allow a three (3) foot encroachment of the existing house into the required thirty (30) foot front yard setback allowing the existing house a twenty- seven (27) foot front yard setback as shown on the plot plan. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis BZA97-13, FIRST UNITED METHODIST CHURCH The next item for the Board of Zoning Adjustment to consider was BZA97-13 submitted by the First United Methodist Church who requested a variance for 300 West College Street, platted as Lot 1, Block 1, First United Methodist Church Addition. The following variance was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 54, Masonry Requirements requires a minimum of 80% of the exterior walls on structures in the R-TH, Townhouse Zoning District, be constructed of masonry. 2 BZA Minutes 6/2/97 The proposed variance request would allow a 100% reduction of the masonry requirement. If approved, it would allow an existing wood framed structure that was moved onto the site with no exterior masonry as shown on the plot plan. Mr. Williams explained that Staff found that special conditions existed for the request. Mr. Williams noted that the financial burden of adding masonry veneer would prevent the utilization of this valuable historic resource. Mr. Williams noted that an application was submitted to the Department of Development Services by Mr. Ray Andrae representing the First United Methodist Church. Mr. Williams also noted that the structure was previously located in Colleyville on John McCain Road and had been moved as a result of development. The structure will be used as an office for the church. After discussion concerning the plans for the parking area, Ery Meyer made a motion to close the public hearing. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis Ery Meyer made a motion that special conditions existed being that the existing building was originally designed without masonry veneer. Allowing the existing wood siding to remain would allow the structure to be visually compatible with other buildings in the district. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis Ery Meyer then made a motion to approve the variance to Section 54, Masonry Requirements to allow a 100% reduction of the masonry requirement, allowing an existing wood framed structure that was moved onto the site with no exterior masonry as shown on the plot plan. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis 3 BZA Minutes 6/2/97 BZA97-14. PAYTON-WRIGHT FORD SALES. INC. The next item for the Board of Zoning Adjustment to consider was BZA97-14 submitted by Payton Wright Ford Sales, Inc., who requested variances for 417 and 441 East Dallas Road, platted as Lot 1, Block 1, Payton Wright II Addition. The following variances are from Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.2., Changing Non -Conforming Uses allows the Board of Zoning Adjustment to grant a change of use from one non -conforming use to another non -conforming use provided such change is a permitted use in that zoning district. Ms. Ratcliff explained that the requested special exception would grant Payton -Wright the ability to change the non -conforming Chamber of Commerce office use and development to a permitted vehicle leasing facility use and remain as developed in conjunction with the development of display/storage area on Lot 1, Block 1, Payton -Wright II Addition. Ms. Ratcliff also explained that the major use will be vehicle leasing and the office use is a secondary use to that. Ms. Ratcliff noted that this would go before Planning and Zoning on June 17, 1997, contingent on BZA's approval. Jimmy Payton, Chairman of the Board for Payton Wright Ford, Inc., took the Oath of Truth and explained how the property would be used for fleet sales and that the Chamber of Commerce building would be used for their fleet sales office for four to five people. There was discussion on the different phases the applicant had planned for developing the property. With no one else to speak either for or against the request, Carl Hecht made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis Carl Hecht then made a motion that a special condition existed as the applicant was proposing to bring the use of the property into conformance, while using the existing non- conforming Chamber of Commerce development. GRAPEVINE HERITAGE FOUNDATION The next item for the Board of Zoning Adjustment to consider was BZA97-16, submitted by the Grapevine Heritage Foundation for 701 South Main Street. The following variance was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 54, Masonry Requirements requires a minimum of 70% of the exterior walls on structures in the GU, Governmental Use Zoning District, be constructed of masonry. The proposed variance would allow a 100% reduction of the masonry requirement. Mr. Williams explained that staff found special conditions existed for the request, as the structure was located on the same lot as several wood clad structures recently listed in the National Register of Historic Places. Mr. Williams explained that in this environment, the concrete block building created a significant visual distraction, and new wood siding would help make this structure more compatible with the site. With no one to speak either for or against the request, Ery Meyer made a motion to close the public hearing. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis 5 BZA Minutes 6/2/97 Ery Meyer then made a motion that a special condition existed, being the structure is located on the same lot as several wood clad structures recently listed in the National Register of Historic Places and new wood siding would help make this structure more compatible with the site.
