HomeMy WebLinkAbout2010-01-11STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Building Board of Appeals for the City of Grapevine, Texas, met on Monday evening, January 11, 2010, at 6:00 P.M. in the Planning and Zoning Conference Room, 2°d Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the following members present to wit: Joe Lipscomb Chairman Russell Kidd Member Clint Hallman Member Jerrold Sklar Member Hal Hardister Member Paul Biesiadny Member constituting a quorum with Vice -Chairman, Dennis Roberts absent. Also present were City Council Representative Sharron Spencer and the following City Staff: Scott Williams Development Services Director / Building Official Connie Cook Development Services Assistant CALL TO ORDER Chairman Joe Lipscomb called the Briefing Session of the Building Board of Appeals to order at approximately 6:00 P.M. NEW BUSINESS Scott Williams briefed the Building Board of Appeals regarding the items scheduled to be heard in the regular public hearing. ADJOURNMENT With no further discussion, the meeting was adjourned at approximately 6:10 P.M. Also present were City Council Representative Sharron Spencer and the following City Staff: Scott Williams Development Services Director / Building Official Connie Cook Development Services Assistant CALL TO ORDER Chairman, Joe Lipscomb called the Public Hearing to order at approximately 6:15 p.m. PUBLIC HEARING BUILDING BOARD OF APPEALS TO CONSIDER BUILDING BOARD OF APPEALS CASE BBA09-07, FLORENTINO AND DAISY VELASQUEZ. The Building Board of Appeals considered BBA09-07 submitted by Florentino Velasquez for property located at 1830 Silverside Drive, legally described as Lot 67, Shorecrest Acres. The request was to Grapevine Code of Ordinances, Chapter 7, Article IV, Fences: Section 7-127, Fences, Front Yard Requirements, requires fences constructed in a required or established front yard to be 36 inches or less in height, and have at least 50 percent through vision. Scott Williams explained that Staff recommended the Building Board of Appeals approve the applicant's request for approval of a decorative masonry arch that exceeded 36 inches in height, not to exceed eight -feet (8) in height, in the established, but not the required, front yard. Mr. Williams explained that Staff found a special condition existed for the request for the decorative masonry arch. Specifically, the lot was significantly larger than those in the average subdivision, and many of the homes were set back much further than the minimum 25-feet required. Mr. Williams stated that a variance request was approved by the Building Board of Appeals in July 2009. The variance allowed the construction of an iron fence with stone columns that exceeded 36 inches in height, not to exceed five -feet (5') in height, with more than 50 percent through vision in the established, but not required, front yard. He stated it was discovered upon inspection that a small portion of the structure exceeded the five-foot (5') height restriction. The revised request was to allow a stone entry feature surrounding the front gate that exceeded thirty-six inches (36") in height, but not to exceed eight -feet (8') in height. The overall openness of the fence would still far exceed 50 percent. Therefore, Staff did not feel that the intent of the ordinance would be violated. With no further questions for Mr. Williams, applicant, Florentino Velasquez addressed the Board; he stated that the masonry archway was a last minute change presented to him by his masonry contractor, and did not realize that it would have been an issue with his permit and previous variance request. He acknowledged he should have included this on his plans to begin with and apologized to the Board for having to come before them again. He requested favorable consideration of his request and offered to answer any questions of the Board. Chairman Lipscomb stated that (1) letters of approval had been received. With no questions for Mr. Velasquez, and no additional speakers, Russell Kidd made a motion to close the public hearing. Jerrold Sklar seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Kidd, Hallman, Sklar, Hardister, Biesiadny Nays: None Absent: Roberts Clint Hallman made a motion that a special condition existed. Hal Hardister seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Kidd, Hallman, Sklar, Hardister, Biesiadny Nays: None Absent: Roberts 2 Building Board of Appeals 1/11/2010 MINUTES Next for the Board to consider was the minutes of the July 13, 2009 Briefing Session and Public Hearing. Hal Hardister made a motion to accept the minutes of the July 13, 2009 Briefing Session and Public Hearing. Russell Kidd seconded the motion which prevailed by the following vote: Ayes: Lipscomb, Kidd, Hallman, Sklar, Hardister, Biesiadny Nays: None Absent: Roberts ADJOURNMENT With no further discussion, Russell Kidd made a motion to adjourn.
