The request is to allow a solid six (6) foot high fence within the required and established front yard as shown on the plot plan. BACKGROUND INFORMATION: An application was submitted to the Department of Development Services by Mr. and Mrs. Gordon Moller. The potential violation was discovered by Staff upon the review of a permit application. The fence will not be built beyond the originally platted required twenty-five (25) foot front building line. Because the home is built well behind the building line, the greatest violation will be the fence encroaching into the established front yard.. We hereby request authorization to build a privacy fence on our residence property as shown on the attached plat. This fence will be 6' high and made out of high quality wood grain colored fiberglass pickets, which are not subject to significant degrading or discoloration. We earlier submitted this proposal, however it was rejected because the fence plan on the east side of the property had a section which was located closer to the eastern boundary of the property than the front of our home structure. Therefore we request an associated variance based on the reasons explained herein in both summary and detailed form. 2. We request reconsideration and approval of the variance for our fence plan for the following reasons (Summary): It eliminates the need for us to remove any trees, saving both money and preserving the benefits the trees provide. It provides us a bit more secure enclosed space on our property for family use, which is quite important to us. The additional fencing will not have an adverse affect on the attractiveness of our property or its value. None of the 6 adjacent neighbors to our property have any objections whatsoever to our proposed fence layout. The variance section of the fence will have no adverse affect on traffic visibility or safety at the Wintergreen Terrace and Barberry intersection. 3. We request reconsideration and approval of the variance for our fence plan for the following reasons (Details): The southeast side of our property (where the section of the fence in question is located) is quite heavily wooded with a significant number of very large oak trees. The proposed fence plan was designed to allow us to install the fence in a manner that would bypass all the trees, and therefore would preclude the need to remove any of them. If we were to take the fence design parallel to the front of the house from the front edge of the house or slightly behind it in accordance with the existing requirements, it would intersect a large number of these oak trees (and/or their immediately adjacent root structure), and thus probably necessitate cutting and removal of a number of these large trees, their stumps, and larger roots. This would require the removal of at least two and perhaps as many as five very large, mature trees. A number of labeled photographs are included with this submission (see Enclosure 3) to show the locations of some of these trees and the proposed location of the fence (stakes, rope, and string border). We strongly wish to avoid this and keep all the existing trees intact for the following reasons: These trees not only add value and beauty to our property, but are enjoyed by a number of neighbors all of whose property faces this open section of our lot, as well as by others who drive or walk by. Adding complete tree removal costs would add significantly to the cost of our fencing project, as we have been quoted $1100 per tree for such complete removal, stump grinding, etc. For these cost estimation purposes we so far only solicited a single quote, which is available upon request. Even with the proposed design, there would be a large number of trees located on the property outside the fence perimeter, in addition to those behind it, thereby maintaining a pleasant appearance to the neighborhood and all passersby (see Enclosure 3). Given that a deviation from a layout that is even with the front of our home structure is needed, it is our desire to include the marginally larger amount of our property in our fenced area so as to provide maximum secure play area (protected from traffic on Barberry and Wintergreen Terrace streets) for our 3 children, as well as a larger area for our pets. However, there will still be a substantial property area (belonging to us) between the roads and city property and our proposed fence. The east side dimension of our property is quite long at 230 feet. The proposed fence design will not create an unnatural appearance to the front of the home property as the area of fence proposed to be somewhat eastward of the front of the home structure is quite far to the south of the home, and the angled design will allow a very pleasant presentation of the home structure from a wide viewing angle. In fact, from the front center of the house at the entryway, the forward angle to the outermost section of the proposed fence layout is not more than 15 degrees (see Enclosure 2). Our property slopes substantially from the high southeast end (area of fence in question, near the intersection of Barberry and Wintergreen Terrace) to the low northwest end. With the fence in its current location, drivers or pedestrians on those streets can quite easily see down into our backyard and pool area. By moving 2 the fence higher to the desired area as shown in the proposed layout, we can reduce the visibility into our backyard and increase our privacy. There is a substantial slope and height differential which exists between the south and north sides of our property along with a large retaining wall (shown as a two section wall on the plat, since changed to a single section 5' - 6' pave stone wall), which effectively cuts the property into two very distinct sections from an appearance prospective. The ground level in the southeast area (requested variance area) of the property is probably 10' - 12' above the ground level of the house. Therefore any fence design for this area appears to passersby more like simple fencing around a separate lot, such as for horse boarding, etc. In fact, even with no fence installed, or with it just up to the front of the house, no one on Barberry or even the neighbors across Barberry can easily see that such a fence would protrude in front of the home, because from most angles the front of the home is almost invisible as it well below on the slope of the hill, is blocked by all the trees, and is behind a 6 foot retaining wall at the base of the slope. Several photos showing this topography are included (see Enclosure 3). We recently erected stakes and rope to mark the requested variance area, as well presented plat drawings highlighting our proposed fence design, to show all our neighbors who live adjacent to us or across either Wintergreen Terrace or Barberry from our lot what we desire to do (see Enclosure 3). We informed them that a variance was required for us to do this. We have shown them sample materials of the exact type and color to be used as well. Every one of these neighbors has indicated that they have no objection to our proposed fence layout whatsoever, including the portion which extends somewhat beyond the front of the home structure for which the variance is requested. In fact, our neighbors realize that since moving in to this home some 6 months ago, we have done much to improve it and make it more attractive, which benefits them as well. Such improvements include replacement of decaying railroad tie retaining walls with attractive pave stone walls, trimming up and removal of dead trees and dead tree sections, extensive new landscaping, etc. Replacement of the extremely decayed and unattractive existing fence is the next step. Attached to this document is a "statement of no objection" (Enclosure 4) signed by each of the neighbors whose homes are located adjacent to our lot. The additional fence area requested in the variance will have no adverse impact on the visibility of traffic, bikes, or pedestrians in the vicinity of the Wintergreen Terrace and Barberry intersections, and therefore no negative impact on safety. First of all, this intersection is a 3 way stop already, requiring all traffic to stop and look for other cars before proceeding. Secondly, with the farthest southeast point of our proposed fence layout located about 36 feet from nearest edge of Barberry and 43 feet from the nearest edge of Wintergreen Terrace, it is clear that the fence structure is quite far away from this 3 way stop intersection and in no way can interfere with traffic visibility or safety. A number of labeled photographs are included with this submission (see Enclosure 3) to show the relationship of the proposed fence variance layout and the Wintergreen Terrace and Barberry intersection. 3 4.
