HomeMy WebLinkAboutItem 10 - Tax Assessor-CollectorMEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: JUNE 15, 2021 SUBJECT: CONSIDER AN ORDINANCE DESIGNATING A PERSON TO FULFILL DUTIES IMPOSED BY TAX CODE CHAPTER 26 RECOMMENDATION: Consider adoption of an ordinance designating GCISD Tax Assessor - Collector to perform duties imposed by Tax Code Chapter 26. FUNDING SOURCE: This action will have no material effect on City funds. BACKGROUND: The City of Grapevine has historically contracted with the Tax Assessor - Collector of the Grapevine-Colleyville Independent School District to act as the City Tax Assessor -Collector. The City intends to contract with GCISD again for fiscal year 2022. The 86th Texas Legislature in Regular Session, amended Tax Code Section 26.04 requiring each governing body, as part of the tax rate adoption process, to designate by ordinance an officer or employee to do certain tasks including, but not limited to, the calculation of the relevant tax rates and posting of information to the internet. Staff recommends approval. ORDINANCE NO. 2021-021 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, DESIGNATING PERSON TO FULFILL DUTIES IMPOSED BY TAX CODE CHAPTER 26; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the 86th Texas Legislature in Regular Session, amended Tax Code section 26.04 which requires each governing body, as part of the tax rate adoption process to designate an officer or employee to do certain tasks, including, but not limited to, the calculation of the relevant tax rates and posting of information to the web; and WHEREAS, the City of Grapevine has designated by contract the Tax Assessor - Collector of the Grapevine-Colleyville Independent School District as the City Tax Assessor -Collector; and WHEREAS, said Tax Assessor -Collector has been certified as a Registered Texas Assessor by the Texas Department of Licensing and Regulation; WHEREAS, all constitutional and statutory prerequisites for the approval of this ordinance have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this ordinance is in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated herein above are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That Colette Ballinger, RTA, as Tax Assessor -Collector for the City of Grapevine is hereby and herewith designated by the City as the person to perform all such tasks as required of such a designee in Tax Code Chapter 26 for the calculation and adoption of a tax rate. Section 3. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
