MEMORANDUM DEVELOPMENT SERVICES
MEMO TO: BOARD OF ZONING ADJUSTMENT
FROM: SCOTT WILLIAMS, DIRECTOR DEVELOPMENT SERVICES
BUILDING OFFICIAL
RON STOMBAUGH, ASSISTANT DIRECTOR OF DEVELOPMENT
SERVICES
ALBERT L. TRIPLETT JR, PLANNER II
SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA14-10
218 AUSTIN STREET
MEETING DATE: MONDAY, MAY 5, 2014
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following variances to the
Grapevine Comprehensive Zoning Ordinance 82-73 for property located at 218 Austin
Street, platted as N1/2 of Lots 7 & 8, Block 102, College Heights Addition as follows:
Section 15.F.2, "R-7.5" Single Family District, Density Requirements, requires a
minimum lot size of 7,500 square feet.
The applicant is requesting a variance of 500 -square feet, and if approved by the Board
would allow a lot area of 7,000 square feet for an existing lot.
Section 15.6.1, "R-7.5" Single Family District, Area Regulations, requires a minimum
front yard setback of thirty (30') feet.
The applicant is requesting a variance of sixteen (16') feet, and if approved by the Board
would allow a front yard setback of fourteen (14') feet for an existing lot.
Section 15.6.4., "R-7.5" Single Family District, Area Regulations requires a minimum
lot width of 95 -feet.
The applicant is requesting a variance of twenty five (25') feet and if approved by the
Board, would allow a lot width of seventy (70') feet for an existing lot.
Section 42.D., Supplementary District, Corner Lots, requires the side yard setback on
a street to be the same as the required minimum front yard setback.
The applicant is a requesting a variance of fifteen (15') feet to this requirement and if
approved by the Board would allow a side yard setback on a street side of fifteen (15') feet
for an existing lot.
0ABZA\20141Cases\BZA14-10.4
Staff finds that a special condition exists for the variances requested. Specifically, the
original Lots 7 and 8, Block 102 of College Heights Addition were originally platted in 1909,
predating the City's first zoning ordinance adopted in 1955. The site is an existing
developed lot, and the existing structure was built in 1958 prior to the rezoning of the
subject site in the 1984 City Rezoning to "R-7.5" Single Family District. An alley, right-of-
way and developed platted property exist adjacent to the subject site, eliminating the
possibility to expand the site. Existing dwellings south of the subject site are setback at
various depths ranging from approximately eight (8') feet to twenty-two (22') feet and the
existing front yard encroachment is not inconsistent with what currently exists along this
portion of Austin Street.
BACKGROUND INFORMATION:
The owner intends to expand the existing dwelling from approximately 1,216 -square feet to
approximately 1,788 -square feet by adding an approximate 572 -square foot addition to the
dwelling and a 650 -square foot detached garage on the subject property. On March 26,
2014, the Historic Preservation Commission approved Certificate of Appropriateness
(CA14-15) on the subject site. The application was submitted by Thomas O'Malley.

necessary, use a separate sheet:
R7.5 BUILDING SETBACKS
REMOVE OF NON-STRUCTURAL DAMAGED PORCHES AND REPLACEMENT WITH 572 SQ.FT ADDITION WITHIN FRONT YARD SETBACK
143'-15.5' AND SIDE YARD SETBACK 15.2'. HOME WAS BUILT WITHIN THESE SETBACKS IN 1958.
BUILD NEW DETACHED 2 CAR GARAGE WITHIN R7.5 SIDE AND REAR SETBACKS.
5. State the grounds for the request and detail any special conditions which cause hardships that in your opinion justify the
variance(s) or special exception(s) you are requesting. Examples of special conditions are: hills, valleys, creeks, power poles,
elevations, irregular lot or tract shapes, etc. The Board of Zoning Adjustment must determine a special condition or conditions
exist(s) before making a motion to approve a request. If it is determined that no special condition exists, the motion must be to
DENY the request.
PROPERTY WAS ORIGINALLY PLATTED IN 1909 AS LOTS 7 & 8 FRONTING ON ESTILL STREET. AT SOME POINT IN TIME LOTS WERE
CHANGED TO FRONT ON AUSTIN STREET AND CHANGED TO LOTS 7&8 N AND 7&8 S. HOUSE WAS BUILT IN 1958 FRONTING AUSTIN
STREET WITH SETBACK OF 14.3'-15.5, ESTILL STREET SIDEYARD SETBACK WAS 15.2`
REMODEL IS WITHIN THESE SETBACKS. NEW GARAGE IS WITHIN CURRENT R7.5 SETBACKS.
6. Explain any unique circumstances, if applicable, not considered by the Zoning Ordinance. Examples: (1) If the Grapevine
City Council approved a plat prior to present zoning ordinance requirements; or (2) the ordinance was amended or a policy
change was adopted after initiation of the plans check process for a building permit or other phase of the development process.
IT APPEARS THAT THERE ARE NO RECORDS OF THIS REPLATTING EVEN THOUGH IT NOW SHOWS LOTS 7&8N AND 7&8 S AND HOUSE
AS BUILD IN 1958. (BLOOCK 104, LOTS 7&8 ARE THE SAME AND BUILD FACING AUSTIN STREET WITH CONSISTANT FRONT SETBACKS).
DO NOT BELIEVE R7.5 ZONING EXISTED AT THIS TIME.
7. Attach a detailed diagram of the site drawn to scale, and any other drawings or photographs necessary to help explain the
case to the Board, show on the diagram all easements, building lines, encroachments, and the variance(s) requested. The
requested variance(s) should be quantified by an appropriate measurement (distance, percentage, etc.)
THE DEVELOPMENT SERVICES STAFF WILL DETERMINE THE AGENDA FOR EACH OF THE PUBLIC HEARING DATES.
BASED ON THE SIZE OF THE AGENDA, YOUR APPLICATION MAY BE RESCHEDULED TO A LATER DATE.
