307 Rest and Meal Periods
The City of Grapevine allots rest periods twice a day and a meal break in order to
assure the employee time to refresh and take care of personal necessities. When
possible, rest periods will be provided in the middle of the work periods. Because of
the need to cover office operations over the noon hour, employees may be assigned
different meal periods.
.01 When possible, rest periods are provided to full-time non-exempt employees twice
daily and not to exceed 15 minutes in length.
.02 Federal law states that rest periods are not required and therefore not cumulative for
use at later time or other purposes.
.03 Meal periods are time away from the duty station of not less than 30 minutes nor
more than one hour as assigned/approved by the supervisor.
.04 Meal periods of less than 30 minutes or spent at the duty station is compensable time
and will be used in the calculation of total hours for the determination of overtime pay
for non-exempt employees.
.05 Effective March 23, 2010, employers are required to provide reasonable break time
for a non-exempt employee to express breast milk for her nursing child for one
year after the child’s birth each time such employee has the need to express the
milk. Employers are also required to provide a place, other than a bathroom, that
is shielded from view and free from intrusion from coworkers or the public, which
may be used by an employee to express breast milk. For non-exempt employees
who need more than two 15 minute breaks each day, the additional break time will
be unpaid, or with the agreement of their supervisor, the additional time may be
made up each day. For example, an employee who needs two 30 minute breaks
each day could:
(1) take a 30-minute meal break instead of 60 minutes, or
(2) could work 30 minutes past the end of the work shift, or
(3) could take 30 minutes of vacation time each day.
.06 Exempt employees are not subject to these policies under FLSA and therefore not
compensated for any missed rest or meal periods due to work requirements.
